Armstrong, Assistant City Attorney <br /> <br />Re: Chapter 25, Article IV, Section 25-60, et. seq. <br />of the Code of Ordinances of the City of La Porte, <br />the Truck Route Ordinance <br /> <br />Dear Ladies and Gentlemen: <br /> <br />In the fall of 1981, the La Porte Police Department, the Municipal <br />Judge, and the Municipal Prosecutor of the City of La Porte, brought <br />to the attention of the office of the City Attorney a difficulty in <br />our present Truck Route Ordinance. The difficulty centered upon the <br />fact that la-wheeler trucks and truck tractors were parking in <br />residential subdivisions within the city limits of the City of <br />La Porte. Upon an attempt by the Police Department to prosecute <br />under the terms of our current Truck Route Ordinance, it was dis- <br />covered that the drivers of said trucks were claiming that the <br />residential property upon which they were parking was a truck terminal, <br />and that, under an exception that existed to the Truck Route Ordinance, <br />the parking of said trucks on said residential property was permissible <br />under the terms of our current ordinance. <br /> <br />The Municipal Prosecutor suggested to the office of the City Attorney <br />that an amendment to the Truck Route Ordinance, said amendment <br />defining the term "truck terminal", so as to negate the claim by the <br />truckers that their residential property was indeed a truck terminal <br />under the terms of the current ordinance. To shore up enforceability <br />of the current Truck Route Ordinance, then, the office of the City <br />Attorney prepared a definition of truck terminal, said definition <br />appearing before the City Council in its agenda packet this evening. <br />
