ORDINANCE NO. 1298 - AN ORDINANCE CALLING THE REGULAR ANNUAL ELECTION OF THE CITY OF LA PORTE~ CALLING A RUN-OFF ELECTION, IF NECESSARY~ DESIG- NATING ELECTION PRECINCTS AND POLLING PLACES~ PROVIDING FOR THE USE OF VOTING MACHINES~ APPOINTING ELECTION OFFICIALS~ PRO- VIDING FOR METHOD AND DATES OF ABSENTEE VOTING~ PROVIDING FOR RETURN AND CANVASS OF VOTES OF SAI D ELECTION ~ PROVIDING FOR NOTICE~ PROVIDING FOR FILING DEADLINE AND FILING FEES FOR CANDI- DATES~ PROVIDING FOR THE HOLDING OF A JOINT ELECTION WITH THE LA PORTE INDEPENDENT SCHOOL DISTRICT~ PROVIDING A SAVINGS CLAUSE~ FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW~ AND PROVIDING AN EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: . Section 1. An election shall be held wi thin the corporate limits of the City of La Porte, Texas, on the 3rd day of April, 1982, such day being the first Saturday in April, 1982, between seven o'clock (7:00) A.M. and seven o'clock (7:00) P.M., for the purpose of electing the following City officials: Mayor, for a 3 year term Councilperson--District 2, for a 3 year term Councilperson--District 3, for a 3 year term Councilperson-at-large--position A, for a 1 year term Councilperson-at-large--position B, for a 2 year term A run-off election, if necessary, shall be held on April 17, 1982, between the same hours. Said election, and said run-off election, if necessary, shall be held in conjunction with a ~ Trustee's election to be held on the same date(s) by the La Porte Independent School District. Section 2. Said election shall be held at each of the following voting places within said City, and the following named persons are hereby appointed as officers of said election, to-wit: Election Precinct No.1: All voters living in such Pre- cinct No. 1 (consisting of that portion of the Ci ty of La Porte which is located north of an imaginary line 900 feet south of and parallel to Avenue "H", and west of the Southern Pacific . Railroad) shall vote at the Lomax Elementary School, which is located at 10615 North Avenue "L" in the City of La Porte, Texas, . e . Ordinance No. 1298 , page 2. with the following election officers: Sara Armand , Presiding Judge Jerri Neuman ,Alternate presiding Judge ~ Election Precinct No.2: AIl voters living in such Precinct NO. 2 (consisting of that portion of the City of La Porte which is west of Big Island Slough and south of an imaginary line 900 feet south of and parallel to Avenue II H") shall vote at the Baker School Cafetorium, which is located at West Main Street and Underwood Road, La porte, Texas, with the following election officials: Bertha Cook , presiding Judge Georgette Oliver ,Alternate presiding Judge . Election precinct No.3: AIl voters living in such Precinct No. 3 (consisting of that portion of the City of La Porte which is enclosed by Big Island Slough, Fairmont Parkway, the Southern pacific Railroad, and an imaginary line 900 feet south of and parallel to Avenue "H") shall vote at the Fairmont Park Baptist Church, which is 10cated at 10401 Belfast Road, La porte, Texas, with the following election officials: Ed Ferguson , presiding Judge Janet Graves ,Alternate presiding Judge ~ Election Precinct No.4: All voters living in such precinct No. 4 (consisting of that portion of the City of La Porte which is east of the Southern pacific Railroad, north of "B" Street and west of Broadway) shall vote at the DeWalt Special Services Center, which is located at Madison and N. 6th Street, La porte, . e . Texas, with the following election officials: Lou Lawler , Presiding Judge Ruby Phillips , Alternate presiding Judge ~ Election Precinct No.5: All voters living in such Precinct No. 5 (consisting of that portion of the City of La Porte which is enclosed by Broadway, Little Cedar Bayou, Galveston Bay, Donaldson Avenue, and Barbour's Cut Boulevard) shall vote at the La Porte Senior High School, which is located at 301 E. Fairmont parkway, La Porte, Texas, with the following election officials: D. o. Laird , presiding Judge Arbila' Ralston , Alternate presiding Judge . Election Precinct No.6: AIl voters living in such Precinct No. 6 (consisting of that portion of the City of La Porte which is enclosed by the Southern Pacific Railroad, "B" Street, Broadway, Little Cedar Bayou,. Galveston Bay, and the north line of the Bayshore Municipal utility District) shall vote at the La Porte City Hall, which is located at 604 W. Fairmont parkway, La Porte, Texas, with the following election officials: Nadine Jones , presiding Judge Lois Compton , Alternate presiding Judge ~ The presiding Judge at each of the above specified polling places shall appoint as many clerks as he or she deems neces- sary for the proper conduct of said election at said polling place, provided that at least two clerks shall be appointed in each case. e e . Ordinance No. 1298 , Page 4. ~ Section 3. voting at said election, including absentee voting, shall be by the use of voting machines, and the ballots of said elections shall conform to the Texas Election Code, as amended. Section 4. Absentee voting by personal appearance shall begin on the 20th day and shall continue through the 4th day preceding the day of the election. Except as authorized herein, the clerk shall not permit anyone to vote absentee by personal appearance on any day which is not a regular working day for the clerk's office, and under no circumstances shall he permit anyone to vote absentee by personal appearance at any time when his office is not open to the public. Absentee voting by mail shall begin on the 20th day pre- ceding the date of the election and shall continue until ten o'clock (10:00) A.M. on the second day preceding election day. Absentee voting shall be conducted by a clerk for absentee voting, namely, Lou Lawler , and the place at which the absentee voting shall be conducted is designated as the La Porte City Hall, 604 West Fairmont Parkway, La Porte, Texas, to which address ballot applications and ballots voted by mail may be mailed. Said clerk shall keep said office open for absentee voting during his regular working hours and in any event for at least eight (8) hours on each day which is not a Saturday, a Sunday, or an official State holiday. ~ . Section 5. That all election materials including notice of the election, ballots, instruction cards, affidavits and other forms which voters may be required to sign and all absentee voting materials shall be printed in both English and Spanish, or Spanish translations thereof shall be made available in the circumstances permitted and in the manner required by law. . . . Ordinance No. 1298 , Page 5. Section 6. The City Secretary of the City of La Porte shall forthwith issue Notice of said election by causing a substantial copy of this Ordinance to be published one time in the BAY SHORE SUN, which is hereby found and declared to be a newspaper of general circulation in said Ci ty, not less than ten (10) days nor more than thirty (30) days prior to the date of the said election. ~ Section 7. Upon a candidate tendering his application on the form prescribed, the' Ci ty Secretary shall furnish to such candidate all information relative to the qualifications for the office being sought~ the method of placing the candidate I s name on the ballot~ the amount of the required filing fee~ and any other pertinent information concerning said election. Section 8. Each candidate for the office of Mayor or Council- person must be a resident elector of the City. Each candidate for the office of District Councilperson must also be a resident of the district for which he files. ~ Section 9. The deadline for a candidate to make appl ica- tion to have his name appear upon the ballot for such election, is hereby designated and established as 5:00 o'clock P.M., Wednesday, March 3, 1982. No application shall be accepted for filing prior to February 4, 1982. The filing fee for each candidate for the office of Councilperson is hereby established as Fifty Dollars ($50.00). The filing fee for each candidate for the office of Mayor is hereby established as One Hundred Dollars ($100.00). The filing fees shall be used to defray the cost of the election, and said fees shall be prorated and any surplus shall be refunded to said candidates. As an alternative to paying a filing fee, a candidate may obtain a place on the . . . ~ Ordinance No. 1298 , Page 6. ballot by filing a petition as provided for in City of La Porte Home Rule Charter, Article 2.04 c.3. Section 10. Said election shall be held in accordance with the provisions of the City Charter of the City of La Porte, and the general election laws of the State of Texas governing general and municipal elections, so far as same may be applicable thereto. ~ Section 11. Immediately after said election, the officers holding the same shall make and deliver the returns of the results thereof and the accompanying records for use in the off icial canvass to the City Council of the Ci ty of La Porte, and the City Council shall canvass said returns at the earliest practicable time, and shall, immediately after canvassing the returns, declare the resul ts of the election. The Mayor shall immediately thereafter deliver to the candidate for whom the majori ty of votes has been polled for each respective office, a certificate of election. Such elected officials shall assume their duties wi thin ten (10) days thereafter, Sundays excluded, upon their taking the oath of office. ~ Section 12. Each and every provision, paragraph, sentence and clause of this Ordinance has been separately considered and passed by the City Council of the City of La Porte, Texas, and each said provision would have been separately passed without any other provision, and if any provision hereof shall be ineffec- tive, invalid or unconstitutional, for any cause, it shall not impair or affect the remaining portion, or any part thereof, but the valid portion shall be in force just as if it had been passed alone. . Section 13. This Ordinance shall be in effect immediately upon its passage and approval. e . .' Ordinance No. 1298 , Page 7. Section 14. The City Council officially finds, determines, reci tes and declares that a sufficient written notice of the date, hour, place and subject of this meeting of the City Council was posted at a place convenient to the public at the City Hall of the City for the time required by law preceding this meeting, as required by the Open Meetings Law, Article 6252-17, Texas Revised Civil Statutes Annotated; and that this meeting has been open to the public as required by law at all times during which ~ this ordinance and the subject matter thereof has been discussed, considered and formally acted upon. The Ci ty Council further ratifies, approves and confirms such written notice and the contents and posting thereof. PASSED AND APPROVED this the 3rd day of February, 1982. Dicha elecci6n, y dicha eleccion en caso de empate, si necesarias, se celebran conjuntas con una eleccion de los comisarios escolares durante la misma fecha por el distrito escolar independiente de La Porte. Seccion 2: Dicha eleccion se celebrara en cada uno de los siguientes lugares de votacion dentro de dicha ciudad, y las siguientes personas por esto estan designadas como oficiales de dicha eleccion, precisamente: precinto electoral num. 1: Cada votante viviendo en tal distrito num. 1 (consistiendo en aquella porcion de la ciudad de La Porte ubicada al norte de una linea imaginaria 900 pies al sur de y paralela con la avenida "H", y al oeste del ferrocarril Southern Pacific) votara en la escuela elementaria de Lomax, ubicada a 10615 North Avenue "L" en la ciudad de La Porte, Tejas, con los siguientes oficiales electorales: Sara Armand Juez principal Jerrie Neuman Juez alternativo precinto electoral num. 2: Cada votante viviendo en tal precinto num. 2 (consistiendo en aquella porcion de la ciudad de La Porte al oeste de Big Island Slough, y al sur de una linea imaginaria 900 pies al sur de y paralela con la avenida "H") votara en la cafeteria de la escuela Baker, ubicada a la calle West Main y Underwood Road, La Porte, Tejas, con los siguientes oficiales electorales: Bertha Cook Juez principal Georgette Oliver Juez alternativo '" e e Ordenanza Num. 1298 , 'Page 2 precinto electoral num. 3: Cada votante viviendo en tal precinto num. 3 (consistiendo enaquella porcion de la ciudad de La Porte rodeada por Big Island Slough, Fairmont Parkway el ferrocarril Southern Pacific, y una linea imaginaria 900 pies al sur de y paralela con da avenida "H") votara en la Fairmont Park Baptist Church, ubicada.a 10401 Belfast Road, La Porte, Tejas, con los siguientes oficiales electorales: E. Fairmont Parkway, La Porte, Tejas, con los siguientes oficiales electorales: Nadine Jones Juez principal Lois Compton Juez alternativo El juez principal de cada de 10s ya mencionados lugares de votacion nombrara tantos dependientes como el cree necesarios para llevar a cabo correctamente dicha eleccion en dicho lugar de votacion, con tal que nombre por 10 menos das en cada caso. Seccion 3: La votacion en dicha eleccion, inclusive la votacion en ausencia, sera por medio de maquinas de votacion, y las balotas de dichas elecciones conformaran al codigo electoral Tejano, como enmendado. Seccion 4: La votacion en ausencia por aparecer personalmente comenzara el dia 20, y continuara durante el dia 4 antes del dia de la eleccion. Excepto como autorizado por esto, el dependiente no dejara que nadie vote en ausencia por aparecer personalmente durante un dia que sea dia de trabajo regular en la oficina del dependiente, y bajo ningunas circunstancias pueda alguien votar cuando la oficina esta cerrada al publico. ~ e e , Page 3 Ordenanza Num. 1298 La votacion en ausencia por medio del correo comenz ara el dia 20 antes de la fecha de la eleccion, y seguira hasta las diez (10) de la manana durante el segundo dia anbes del dia de la eleccion. La votacion en ausencia se conducira por un dependiente para esta, precisamente, Lou Lawler , Y el lugar de la votacion en ausencia se designa como la casa del ayuntamiento de La Porte, 604 West Fairmont Parkway, La Porte, Tejas, y a esta direccion se puede conseguir balotas y mandar balotas terminadas. Dicho dependiente guardara abierta su oficina para este proposito 'durante las horas'regulares de traoajo, y en todo caso, por 10 menos 8 horas cada dia que no sea sabado, domingo, 0 dia de vacacion oficial del estado. Seccion 5: Que todas 105 materiales de la eleccion inclusive noticias de la eleccion, balotas, tarjetas instruc- tivas, atestaciones y otras formas que necesiten los votantes para firmar y todos los materiales de la votacion en ausencia se escriben en espanol e ingles, 0 sea que traducciones espanolas esten disponibles bajo las circunstancias permitidas y de la manera requerida por la ley. Seccion 6: La secretaria de la ciudad de La Porte pronto dara noticias de dicha eleccion por causar que una porcion substanciel de esta ordenanza sea publicada una vez en al Bay- shore Sun, 10 cual por esto se halla y se declara un periodico de circulacion general en dicha ciudad, no menos de diez (10) dias ni mas de treinta (30) dias antes de la fecha de la eleccion. Seccion 7: Al ofrecer un candidato su aplicacion en la forma requerida, la secretaria municipal dara a tal candidato toda la informacion tocante alas calificaciones referentes a la oficina deseada; el metodo de poner el nombre sobre la balota, cuanto cuesta para hacerse candidato, y otra informacion pertinente. Seccion 8: Cada candidato para la oficina de alcalde 0 consejero tiene que ser residente que pueda votar de la ciudad. Cada candidato en busca de la oficina de consejero de distrito tambien tiene que vivir en ese distrito. Seccion 9: La fecha mas tarde en la que un candidato puede dar su aplicacion para' que aparezca su nombre en la balota para tal eleccion por esto se designo y se establece como las 5 de la tarde, miercoles, el 3 de marzo, 1982. No se puede hacer aplicacion antes del 4th de febrero, 1982. El gasto para cada candidato deseando hacerse consejero por esto se establece como cincuenta dolares ($50.00). El gasto para cada candidato que quiere hacerse alcalde por esto se establece como cien dolares ($100.00). Estos gastos se usaran para disminuir el coste de la eleccion, y dichas gastos se usaran de forma prorrata y si que de algo de los gastos, este se devolvera a dichos candidatos. En vez de pagar, un candidato puede lograr un lugar en la balota por hacer un pedido 0 peticion conforme con la carta de reglamiento municipal de La Porte, articulo 2.04 c~3. Seccion 10: Dicha eleccion se celebrara conforme con;~las provisiones de la carta municipal de la ciudad de La Porte, y las leyes generales electorales del estado de Tejas que gobiernan las elecciones generales y municipales, tanto que estas se aplican. Seccion 11: Anmediatamente despues de dicha eleccion, los oficiales contaran y entregaran 10s resultados y records acompanantes de uso en el cuente oficial al ayuntamiento de la ciudad de La Porte, y el ayuntamiento contara estos resultados tan pronto posible, entonces inmediatamente declarara los resultados de la eleccion. Entonces el alcalde inmediatamente dara al candidato que gano la mayoria de la votacion en cada lugar de votacion un certificado de eleccion. Tales oficiales ~ ~ . e , Page 4 Ordenanza Num. 1298 eligidos tomaran sus tare as dentro de diez (10) dias, no inclusive 105 domingos, al tomar su juramiento de oficina. Seccion 12: Cada y todo provision, parrafo, oracion, y clausula de esta ordenanza ha side seperadamente,considerado y pasado por el ayuntamiento de la ciudad de La Porte, Tejas, y cada dicha provision hubiera sido pasada seperadamente sin otra provision cualquiera, y si una provision de esta resulte inefectiva, invalida, 0 contra la constitucion, no importa la causa, esto no danara 0 afectara la porcion que queda, ni ninguna otra parte, sino la porcion valida quedara en vigor como si la hubieran pasado por si sola. Seccion13: Esta ordenanza estara efectiva inmediatamente despues de ser aprobada y pasada. Seccion 14: El ayuntamiento oficialmente halla, determina, recita, y declara que noticias escritas suficientes de la fecha, la hora, el lugar, y el sujeto de esta reunion del ayuntamiento fueron puestas en un lugar conveniente al publico en la casa del ayuntamiento de la ciudad durante 'tiempo requerido por la ley antes de esta reunion, como requerido por la ley de las sessiones abiertas, articulo 6252-17, las leyes tejanas civiles revisadas anotadasi y que esta session ha estado abierto al publico todo el tiempo cuando esta ordenanza y otras cosas tocante a esta han sido discutidas, consideradas, 0 cuando se han tornado acciones oficiales tocante a esta, como requerido por la ley.
