<br />. <br /> <br />e <br /> <br />OR1G\NAl <br /> <br />ORDINANCE NO. 95-1466- G-' <br /> <br />AN ORDINANCE AMENDING CHAPTER 70, "TRAFFIC AND VEHICLES", SECTION <br />70-104 et seq, "FIFTY MILE PER HOUR ZONES", OF THE CODE OF ORDINANCES <br />OF THE CITY OF LA PORTE; FOR THE PURPOSE OF DESIGNATING MAXIMUM <br />SPEED LIMITS UPON STREETS WITHIN THE CITY OF LA PORTE; PROVIDING <br />THAT ANY PERSON VIOLATING THE TERMS OF THIS ORDINANCE SHALL BE <br />DEEMED GUILTY OF A MISDEMEANOR AND UPON CONVICTION SHALL BE FINED <br />IN A SUM NOT TO EXCEED TWO HUNDRED DOLLARS; FINDING COMPLIANCE <br />WITH THE OPEN MEETINGS LAW; PROVIDING A SAVINGS CLAUSE AND A <br />SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE HEREOF. <br /> <br />WHEREAS, Section 545.356 of the Texas Transportation Code provides that <br /> <br />whenever the governing body of the City of La Porte shall determine upon the basis of an <br /> <br />engineering and. traffic investigation that any prima facia speed therein set forth is greater <br /> <br />or less than is reasonable or prudent under conditions found to exist at any intersection or <br /> <br />other place or upon any part of a street or highway within the City of La Porte, taking into <br /> <br />consideration, but not limited to, the width and condition of the pavement and other <br /> <br />circumstances on such portion of said street or highway, as well as the usual traffic <br /> <br />thereon, said governing body may determine and declare a reasonable and prudent <br /> <br />prima facie speed limit thereat or thereon by the passage of an ordinance, which shall be <br /> <br />effective when appropriate signage giving notice thereof is erected at such intersection or <br /> <br />other place or part of the street or highway; and <br /> <br />WHEREAS, the City Council of the City of La Porte has directed that an <br /> <br />Engineering and Traffic Investigation take place for the purpose of ascertaining <br /> <br />reasonable and prudent prima facie speed limits upon State Highway 225 frontage roads <br /> <br />from the west city limits of La Porte to State Highway 146 within the City of La Porte; and <br /> <br />WHEREAS, the results of said Engineering and Traffic Investigation have become <br /> <br />known unto the City Council of the City of La Porte; and <br />
