ORDINANCE NO. 1501-A
AN ORDINANCE AMENDING ORDINANCE NO. 1501, THE CITY OF LA PORTE
ZONING ORDINANCE, BY CHANGING THE CLASSIFICATION OF THAT CERTAIN
PARCEL OF LAND HEREIN DESCRIBED; AND PROVIDING AN EFFECTIVE DATE
HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE:
Section 1. The City Council of the City of La Porte here-
by finds, determines and declares that heretofore, to-wit: on
the 16th day of July, 1987, at 7:00 P.M., a public hearing was
held before the Planning and Zoning Commission of the City
of La Porte, Texas, pursuant to due notice, to consider the
question of the possible re-classification of the zoning c1assi-
fication of the hereinafter described parcel of land. There
is attached to this Ordinance as "Exhibit A," and incorporated
by reference herein and made a part hereof for all purposes, a
copy of "Notice of Public Hearing" which the Ci ty Council of
the City of La Porte hereby finds was properly mailed to the
owners of all properties located within two hundred feet
(200') of the properties under consideration.
section 2. The Publisher's Affidavit of Publication of
notice of said hearing is attached hereto as "Exhibit B,"
incorporated by reference herein and made a part hereof for
all purposes.
section 3. Subsequent to such public hearing, the City of
La Porte Planning and Zoning Commission met in special session
on July 16, 1987, to consider the changes in classification
which were the subject of such public hearing. The City Council
of the City of La Porte is in receipt of the written recommen-
dations of the City of La Porte Planning and Zoning Commission,
by letter dated July 21, 1987, the original of which letter is
attached hereto as "Exhibit C," incorporated by reference
herein, and made a part hereof for all purposes.

Section 4. On the 10th day of August, 1987, at 6:00 P.M.,
a public hearing was held before the City Council of the City
of La Porte, pursuant to due notice, to consider the question
of the possible re-c1assification of the zoning classification
of the hereinafter described parcel of land. There is attached
to this Ordinance as Exhibit "DII, and incorporated by reference
herein and made a part hereof for all purposes, a copy of
"Notice of Public Hearing" which the City Council of the City
of La Porte hereby finds was properly mailed to the owners of
all properties located wi thin two hundred feet (200') of the
properties under consideration.
Section 5. The Publisher's Affidavit of Publication of
notice of said public hearing before the City Council of the
City of La Porte is attached hereto as IIExhibit E,II incorporated
by reference herein and made a part hereof for all purposes.
Section 6. Subsequent to such public hearing, the City
Council of the City of La Porte reveiwed the written recommenda-
tions of the Ci ty of La Porte Planning and Zoning Commission,
and all of the evidence presented before it, and the City Council
of the City of La Porte hereby accepts the recommendation of the
City of La Porte Planning and Zoning Commission, and the zoning
classification of the hereinafter described parcel of land,
situated within the corporate limits of the City of La Porte,
is hereby changed and the zoning classification of said parcel
of land shall hereafter be "Neighborhood Commercial with a
special Conditional Use Permit requiring compliance with Section
6-600 of Ordinance No. 1501, Special Condition Use Performance
Standards, subsection A (required fencing, screening, and land-
scaping) and subsection B (open and outdoor storage)." The des-
cription of said parcel of land re-zoned is as follows, to-wit:
Being a 0.5303 acre tract (23,100 sq. ft.) located
in the W.M. Jones Survey, A-482, La Porte, Harris County,
Texas. The 0.5303 acre tract as surveyed by H. Carlos
smith, Engineers & Surveyors, Inc., on July 1, 1987, is
more particularly described by metes and bounds as follows:

Commencing at a 5/8 inch rod (set August 1984) for
the Southwest corner of that certain 0.6440 acre tract as
conveyed by Texas Commerce Bank-Pasadena to J.P. Jackson
(H.C.C.F. No. K465917); said corner being coincident with
the North right-of-way line of Fairmont Parkway (based on
a width of 250 feet).
Thence, North 0 degrees 06 minutes 10 seconds West;
coincident with the West boundary line of the 0.6440 acre
tract; a distance of 201/25 feet to a 1/2 inch iron rod (1
foot long) (set August 1984 on top of a 36 inch R.C.P.)
for the Northwest corner of this 0.6440 acre tract, the
Southwest corner of this 0.5303 acre tract and the POINT
OF BEGINNING.
Thence, continuing North 0 degrees 06 minutes 10 seconds
West; a distance of 165.00 feet to a 5/8 inch iron rod set
for the Northwest corner of this 0.5303 acre tract.
Thence East; a distance of 140.00 feet to a 5/8 inch
iron rod set for Northeast corner of this 0.5303 acre tract.
Thence South 0 degrees 06 minutes 10 seconds East; a
distance of 165.00 feet to a punch mark set on a manhole
corner for the Southeast corner of this 0.5303 acre tract
and the Northeast corner of the 0.6440 acre tract.
Thence, West; coincident with the North boundary line
of the 0.6440 acre tract; a distance of 140.00 feet to the
POINT OF BEGINNING.
Section 7. The City Council officially finds, determines,
recites and declares that a sufficient written notice of the
date, hour, place and subject of this meeting of the City Council
was posted at a place convenient to the public at the City Hall
of the City for the time required by law preceding this meeting,
as required by the Open Meetings Law, Article 6252-17, Texas
Revised Civil Statutes Annotated; and that this meeting has been
open to the public as required by law at all times during whiCh
this ordinance and the subject matter thereof has been discussed,
considered and formally acted upon.
The Ci ty Counc i1 further
ratifies, approves and confirms such written notice and the
contents and posting thereof.
Section 8. This Ordinance shall be effective fourteen (14)
days after its passage and approval. The City Secretary shall
give notice of the passage of this ordinance by causing the
caption hereof to be published in the official newspaper in the
City of La Porte at least twice within ten (10) days after the

J. P. Jackson/Eddie Gray's request to rezone a 165 ft.
x 140 ft. tract of the W.M. Jones Survey from "R-3" to
General Commercial (G.C.)

SUBJECT:
Mr. J. P. Jackson's request to rezone the above mentioned tract
from "R-3" to G.C. was considered by the Planning and Zoning Commission
during the July 16, 1987 meeting. The following concerns were raised
by the Commission while discussing this matter:
(1) That approval of this request would not be in keeping with
the City's firm intention of avoiding spot zoning.
(2) That this request deviates from the intent of the City's
Comprehensive plan, specifically the land use portion of the
plan.
Based on these considerations, the Commission passed a motion
recommending the denial of this request.
