ORDINANCE NO. 96-197&~A
AN ORDINANCE AME~DING ORDINANCE NO. 94-1976, WHICH GOVERNS THE RENTAL
FEE POLICY AND SCHEDULE FOR THE LA PORTE LIVESTOCK/RODEO ARENA;
FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN
EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE:
Section 1. That Section Four and Section Five of Ordinance No. 94-1976 shall be amended
to hereafter read as follows, to-wit:
"Section 4. Reservations for the use of the Arena may be made, after January 15th, for
each current calendar year either by phone or in person at the Parks and Recreation
Administration office or any other place that may be designated from time to time.
Reservations must be accompanied by a Reservation and Damage Deposit (Deposit)
of $100.00. The Deposit must be received by the Parks and Recreation Administration
office by close of business of the second business day after the day the reservation was
made. The Deposit will reserve the facility for the Lessee until rental payments are
made and will apply toward any damage to the Arena caused by the Lessee. The
Deposit will be refunded to the Lessee within fifteen (15) days after the event, less any
deductions for damages incurred. The maximum Deposit amount for anyone individual
or organized group for multiple reservations shall be $100.00, unless the individual or
organized group cancels two (2) reservations in a calendar year. If the individual or
organized group cancels two (2) reservations in a calendar year, they will then be
required to post an additional $100.00 Deposit for each reservation made for the
remainder of the calendar year in which the cancellations were made. If reservation is
made with less than two (2) weeks notice, rental fee and deposit are due by close of
business of the next business day, and must be paid in cash, cashier's check, or money
order.
Section 5. For rental dates that are canceled, the Lessee shall provide written notice
of the cancellation to the City at least two (2) weeks prior to reservation date in order to
receive a full refund. Reserved dates that are canceled less than two weeks prior to the
event, will result in forfeiture of the Deposit for that date, and no refund of rental fees
shall be given. Rental fees may be applied to another date, pending availability."

Section 2. If any section, sentence, phrase, clause, or any part of any section, sentence,
phrase, or clause, of this Ordinance shall, for any reason, be held invalid, such invalidity shall
not affect the remaining portions of this Ordinance, and it is hereby declared to be the intention
of this City Council to have passed each section, sentence, phrase, or clause, or part thereof,
irrespective of the fact that any other section, sentence, phrase, or clause, or part thereof, may
be declared invalid.
Section 3. This Ordinance shall take effect and be in force from and after its passage and
approval.
Section 4. The City Council officially finds, determines, recites and declares that a sufficient
written notice of the date, hour, place and subject of this meeting of the City Council was posted
at a place convenient to the public at the City Hall of the City for the time required by law
preceding this meeting, as required by the Open Meetings Law, Chapter 551, Texas
Government Code; and that this meeting has been open to the public as required by law at all
times during which this Ordinance and the subject matter thereof has been discussed,
considered and formally acted upon. The City Council further ratifies, approves and confirms
such written notice and the contents and posting thereof.
