ORDINANCE NO. 95- 2015
AN ORDINANCE REGARDING A CERTIFIED REFERENDUM PETITION TO THE CITY
SECRETARY, SEEKING THE REPEAL OF ORDINANCE NO. 94-1994; CONSIDERING
SUCH REFERRED ORDINANCE BY CITY COUNCIL AND THE FINAL VOTE UPON
SUCH RECONSIDERATION BY CITY COUNCIL; FINDING COMPLIANCE WITH THE
OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE:
Section 1.
The City Council has received from the City
Secretary, a certified referendum petition pursuant to Section 6.04
of the Home Rule Charter of the City of 'La Porte, a copy of which
certification is attached to this ordinance as Exhibit "A" and made
a part hereof for all purposes.
Section 2.
Pursuant to Section 6.04 (b) of the Home Rule
Charter, city Council has considered Ordinance No. 94-1994, and has
taken a final vote upon such reconsideration upon the question,
"Shall the ordinance and the referendum petition be repealed?"
section 3. The City Council of the City of La Porte hereby
determines that the ordinance in the referen~um petition, Ordinance
No. 94-1994, shall not be repealed.
Section 4. The City Council officially finds, determines,
recites, and declares that a sufficient written notice of the date,
hour, place and subject of this meeting of the City Council was
posted at a place convenient to the public at the City Hall of the
City for the time required by law preceding this meeting, as
required by the Open Meetings Law, Article 6252-17, Texas Revised
civil Statutes Annotated; and that this meeting has been open to
the public as required by law at all times during which this
ordinance and the subj ect matter thereof has been discussed,
considered and formally acted upon.
The City Council further
ratifies, approves and confirms such written notice and the
contents and posting thereof.

section 5. This Ordinance shall be effective from and after
its passage and approval, and it is so ordered.
PASSED AND APPROVED, this 13th day of February, 1995'.

Gentlemen:
On January 6, 1995, a Referendum Petition was filed with the City
Secretary of the City of La Porte, seeking repeal of Ordinance No.
94-1994.
Pursuant to Article VI of the Home Rule Charter of the City of La
Porte, I have examined each paper of the Petition to determine if
it has a proper statement of the circulator and whether the
Petition is signed by a sufficient number of qualified electors.
Based upon my examination, I have found and determined that the
Petition has been signed by a sufficient number of qualified
electors.
By letter dated January 19, 1995, I advised the circulators of the
Petition of certain legal insufficiencies. The legal
insufficiencies have now been corrected.
I hereby certify as sufficient the Referendum Petition, as amended,
under Article VI, of the Home Rule Charter of the City of La Porte.
The certified Referendum Petition is delivered to City Council
herewith, for its consideration under section 6.04 of the Home Rule
Charter of the City of La Porte.
