<br />e <br /> <br />.' <br /> <br />City of La Porte, Texas, Ordinance No. 41i-1350 <br /> <br />AN ORDINANCE ENLARGING THE BOUNDARIES OF REINVESTMENT ZONE <br />NUMBER ONE, CITY OF LA PORTE, TEXAS; CONTAINING FINDINGS AND <br />PROVISIONS RELATED TO THE FOREGOING SUBJECT; FINDING COMPLIANCE <br />WITH THE OPEN MEETINGS LAW; PROVIDING A SEVERABlLITY CLAUSE; AND <br />PROVIDING AN EFFECTIVE DATE HEREOF. <br /> <br />WHEREAS, the City Council of the City of La Porte pursuant to the provisions of Chapter <br />311, Texas Tax Code, created Reinvestment Zone Number One, La Porte, Texas, (the ItZonelt) by <br />Ordinance 99-2325, passed May 24, 1999; and <br />WHEREAS, the City may enlarge the boundaries of an existing reinvestment zone pursuant to <br />Section 311.007(a); and <br />WHEREAS, the City Council finds that the area proposed to be included in the Zone is located <br />wholly within the corporate limits of the City of La Porte and is contiguous to the existing boundaries <br />of the Zone. <br />WHEREAS, the City Council finds that the area meets the requirements of Section 311.005 of <br />the Texas Tax Code because the area proposed to be added to the Zone substantially impairs and <br />arrests the sound growth of the City because it contains substantial areas that are predominantly open <br />and underdeveloped, and lack public water distribution, wastewater collection and storm drainage <br />facilities, and have defective or unusual conditions of title, and exhibit deterioration of site or other <br />improvements, which conditions substantially impair and arrest the sound growth of the City. <br />WHEREAS, less than ten percent of the property proposed to be included in the enlarged <br />Zone, excluding property dedicated to public use, is used for residential purposes, as defined in Section <br />311.006 of the Texas Tax Code; and <br />WHEREAS, the total appraised value of taxable real property in the enlarged Zone and in any <br />other existing reinvestment zones does not exceed fifteen percent of the total appraised value of <br />taxable real property in the City and in the industrial districts created by the City; and <br />WHEREAS, the enlarged Zone does not contain more than fifteen percent of the total <br />appraised value of real property taxable by Harris County or the La Porte Independent School District, <br />within whose boundaries the Zone, as enlarged, is located; and <br />WHEREAS, the proposed improvements in the enlarged Zone will significantly enhance the <br />value of all taxable real property in the Zone and will be of general benefit to the City. <br />
