<br />.- <br /> <br />e <br /> <br />ORIGINAL <br /> <br />ORDINANCE NO. 97- 2202 <br /> <br />AN ORDINANCE GRANTING TO CITY EMPLOYEES ADDITIONAL RIGHTS AND CREDITS IN THE TEXAS <br />MUNICIPAL RETIREMENT SYSTEM AS AUTHORIZED BY SECTION 853.303, TITLE 8, OF THE <br />GOVERNMENT CODE; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN <br />EFFECTIVE DATE HEREOF. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF LA PORTE, TEXAS: <br /> <br />Section 1. Any employee of this City who is a member of the Texas Municipal Retirement System <br />and who performed service as a probationary employee for this City prior to September 1, 1989, for <br />which the employee did not receive credited service in the System because the person, as a <br />probationary employee was not enrolled as a member of the System during the period of probationary <br />employment, is hereby allowed to obtain prior service credit for the period of such probationary service <br />(not in excess of six months), pursuant to the provisions of Section 853.303, Title 8 of the Govemment <br />Code. <br /> <br />Section 2. To obtain prior service credit allowable under Section 1 of this ordinance, any employee <br />entitled thereto shall file a detailed written statement of the service claimed with the Human Resources <br />Manager within one year from the effective date of this ordinance, <br /> <br />Section 3, As soon as practicable after the employee has filed a claim for the prior service credit <br />under Section 853.303, Title 8 of the Government Code, the Human Resources Manager shall, if said <br />officer determines that such service was performed as claimed, verify the prior service allowable (not <br />exceeding six months) and the average monthly compensation paid the member during the period of <br />probationary employment, and shall certify to the Board of Trustees of the System the creditable prior <br />service approved, and the average monthly compensation paid to the person by the city during the <br />period of probationary employment. <br /> <br />Section 4, The City Council finds, determines, recites and declares that a sufficient written notice of <br />the date, hour, place and subject of this meeting of the City Council was posted at a place convenient <br />to the public at the City Hall of the City for the time required by law preceding this meeting, as required <br />by the Open Meetings Law, Chapter 551, Texas Government Code; and that this meeting has been <br />open to the public as required by law at all times during which this ordinance and the subject matter <br />thereof has been discussed, considered and formally acted upon.
