NO. 2002-31
AUTHORIZATION TO FILE CHALLENGE TO
APPRAISAL DISTRICT DETERMINATION
WHEREAS, property tax values form a chief source of funding for the City of La Porte;
and
WHEREAS, the City of La Porte believes that it is unquestionably in the best interests of
its constituents to secure maximum funding at the lowest possible tax rates; and
WHEREAS, it shall be the stated policy of the City of La Porte to reVIew all
determinations which erode the City's tax base; and
WHEREAS, it is noted that the City of La Porte is within Harris County, and certain
property tax valuations and other determinations as defined in the Texas Property Tax Code are
solely performed by the Harris County Appraisal District; and
WHEREAS, the terms of the Texas Property Tax Code permit the filing of a challenge by
an affected taxing authority should it be dissatisfied with a determination of the Appraisal
District; and
WHEREAS, certain challenges to Appraisal District determinations must be timely filed
within a very short time following notification ofthe taxing unit;
NOW THEREFORE BE IT RESOLVED by City of La Porte that the challenge filed by
Robert T. Herrera of the City of La Porte prior to the adoption of this resolution on Harris
County Appraisal District account number 006-117-000-0014 is hereby ratified by the City
Council of the City of La Porte.

The Applications for Exemption are Conflicting
The property owner has filed two conflicting applications for exemption of the property
with the Harris County Appraisal District. The first application was filed on June 30t 2000 and
stated that 80% of the land is used of the residence. The first application for exemption was
denied because of use by the appraisal district. On January 30, 2002 a second application was
filed with the appraisal district. In the second application stated that approximately 10% of the
land is used of the residence. The applications filed in 2000 and 2002 are in direct conflict with
each other on the issue of the use of the propertYt and as such bring into question the actual use
of the property.
The Property is Zoned "Rl" for Single Family Residence
The property is bay front property located in one of the most affluent subdivisions in the
City of La Porte. The property is a siflgle-family residency with an appraised value of
$189,330.00. The property is zoned "RI't which only allows the property to be used for the
pwpose of residential single family occupancy. Thereforet it appears that the property is not
being used for the purposes that would qualify it for a religious or charitable exemption.

SUMMARY & RECOMMENDATION
On February 11, 2002, City Council passed Resolution #2002-20 placing a ISO-day moratorium on new
construction of mid to high density residential development for the purpose of reviewing current regulations and
possibly adopting new regulations. That moratorium will expire on July 11,2002.
At present, the Planning and Zoning Commission has forwarded Zoning Ordinance recommendations to
Council which have been reviewed by Council during the June 10 and 24, 2002 meetings. However,
preparation of the formal Ordinance changes incorporating Council modifications will not be finalized prior to
the July Sth Council meeting. Therefore, staff is recommending extending the moratorium for an additional 60
days. This would establish a new moratorium expiration date of September 6,2002 and provide sufficient time
for staff and the City Attorney to review the formal document and for Council to conduct the required Public
Hearing.
Action Required by Council:
1. Consider adopting a Resolution extending the moratorium on mid to high density residential development
for an additional 60 days.

SUMMARY & RECOMMENDATION
Harris County Appraisal District has granted a Religious Exemption on property located at 1718 Roscoe
Street, La Porte, Texas. This area is zoned by the City of La Porte as R-l Low Density Residential. A
challenge was filed with Harris County Appraisal District on May 31, 2002 on behalf of the City of La
Porte to challenge them granting a religious exemption on property that does not meet zoning
requirements. This challenge was reviewed and recommended by the City of La Porte's Audit Committee
on June Ii, 2002. We are now asking that the City Council ratify this challenge by approving Resolution
2002- .
ACTION REQUIRED BY COUNCIL:
Approve the resolution to ratify the challenge filed on Harris County Appraisal District account number
006-117-000-0014.
