RESOLUTION NO. 2002 - J!L
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LA PORTE, TEXAS,
ESTABLISHING POLICIES AND PROCEDURES FOR THE SELECTION Of
ENGINEERING AND ARCHITECTURAL CONSULTANTS FOR PROJECTS
AWARDED FEDERAL FUNDING AND ADMINISTERED THROUGH THE TEXAS
DEPARTMENT OF TRANSPORTATION (TxDOT); FINDING COMPLIANCE WITH
THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the Texas Department of Transportation (TxDOT) administers
federal funding awarded projects through the Statewide Transportation Enhancement
Program and the congestion mitigation for air quality program within the State of Texas;
and
WHEREAS, cost reimbursement program funding has been awarded to
the City for the project identified as "Date Palms and Oleanders for SH 225 at Sens
Road" (CSJ 0912-71-795); and
WHEREAS, TxDOT'S administrative process requires the City to establish
specific procedures for the selection of consultants, including engineers and architects;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF LA PORTE, TEXAS:
SECTION 1. The City Council of the City of La Porte finds and determines that
the premises hereof are true and correct.
SECTION 2. The procedures set forth herein shall be followed by the City of La
Porte, Texas for the selection of consultants (engineers, architects, etc.) for projects
awarded federal funding administered by the Texas Department of Transportation.

Procedures and Responsibilities
i. Authorize advertisement for Professional Services/Qualifications
ii. Prior to advertising, develop the scope of work to be accomplished and an
estimate of the anticipated fee (for comparison during the negotiation process). A
notice of the solicitation for Professional Services will be published in the official
newspaper of the City, and the Houston Chronicle. The first day of publication
shall occur no less than fourteen (14) days before the date the
Proposals/Qualifications are opened.
iii. Provide Proposal Packets to all interested Engineers/Architects and maintain a
log of recipients. Inform potential providers that, if selected, they will be required
to fill out Debarment, Lower Tier Debarment and Lobbying Certifications per
TxDOT requirements. Also inform potential providers of the requirement for a
15% Disadvantaged Business Enterprise goal.
iv. Proposals are to be received in the City Secretary's office, 604 W. Fairmont
Parkway, La Porte, Texas in sealed envelopes marked with the assigned
Proposal number. Publicly receive and record the submission of requested
Proposals, including the time and date proposals are received.
v. Open the Proposals in the City of La Porte Council Chambers on the date and
time specified in the notice.
vi. The Parks & Recreation Director or his designee shall evaluate the
ProposalslQualifications and make recommendations to City Council. The criteria
used to evaluate the proposals shall be:
1. Similar Work Experience
2. Present Work Load
3. Past Performance with TxDOT
4. Staffing Capabilities
5. Qualifications of individual staff members proposed for project.
vii. The City of La Porte will request a pre-negotiation audit by TxDOT of providers'
books prior to contract execution. Contract will be Lump Sum or Cost Plus Fixed
Fee. The contract for design will not be a percentage of construction cost. The
Design Contract and scope of work will be reviewed and approved by TxDOT
before execution by the city. Provider will be required to submit Debarment,
Lower Tier Debarment and Lobbying Certifications upon contract execution.
viii. The City of La Porte will monitor the contract for design in conjunction with
TxDOT. TxDOT will assign a permanent Project Manager. The Parks &
Recreation Director or his designee will be Project Manager for the City. TxDOT
and the City will schedule meetings, verify work completed, and review costs.
The City will pay the provider and request reimbursement from TxDOT. TxDOT
and the City will jointly approve and process contract amendments for additional
time, changes in scope and additional costs. The City and TxDOT will mutually
provide an evaluation of the provider's work. The City and TxDOT will
cooperatively determine responsibility for errors or omissions and settle all
contractual or administrative issues.

SECTION 3. The City Council officially finds, determines, recites and declares
that a sufficient written notice of the date, hour, place and subject of this meeting of the
City Council is posted at a place convenient to the public at the City Hall of the City for
the time required by law preceding this meeting, as required by the Chapter 551, Ix.
Govt. Code; and that this meeting has been open to the public as required by law at all
times during which this resolution and the subject matter thereof has been discussed,
considered and formally acted upon. The City Council further ratifies, approves and
confirms such written notice and the contents and posting thereof
SECTION 4. This Resolution shall be effective from the date of its passage and
approval, and it is so ordered.
