ORDINANCE NO. 2002- J5IJ$ AN ORDINANCE ESTABLISHING A RATE STRUCTURE FOR THE CITY OF LA PORTE EMBRGENCY MEDICAL SERVICE, CONTAINING A SEVERABILITY CLAUSE, FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW, AND PROVIDING AN EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: Section 1. The rate structure as shown on Exhibit "A" attached hereto, incorporated by reference herein, and made a part hereof for all purposes, is hereby established for the provision of emergency medical services by the City of La Porte Emergency Medical Service. Section 2. The rates established under this Ordinance shall be effective the 1st day of October, 2002. Section 3. Any future changes to fees for procedures/drugs will be approved by the city Manager, who shall give notice of such changes to City Council. Section 4. If any section, sentence, phrase, clause or any part of any section, sentence, phrase, or clause, of this ordinance shall, for any reasons, be held invalid, such invalidity shall not affect the remaining portions of this ordinance, and it is hereby declared to be the intention of this City Council to have passed each section, sentence, phrase or clause, or part thereof, irrespective of the fact that any other section, sentence, phrase or clause, or part thereof, may be declared invalid. Section s. The City Council officially finds, determines, recites, and declares that a sufficient written notice of the date, hour, place and subject of this meeting of the City Council was posted at a place convenient to the public at the City Hall of the . e City for the time required by law preceding this meeting, as required by the Open Meetings Law, Chapter 551, Texas Government Code; and that this meeting has been open to the public as required by law at all times during which this ordinance and the subject matter thereof has been discussed, considered and formally acted upon. The City Council further ratifies, approves and confirms such written notice and the contents and posting thereof. Section 6. Two additions to the base rate structure for Paramedic Intercept for Mutual Aid and a Out of Service Area Charge were addressed as well as numerous charges for procedures or medications that are in place due to advances in protocols. Some of these changes are quite expensive and need to be included in our charges. Also in the Ordinance under Section 3 is a sentence allowing changes to the rate structure by the City Manager with notification to the City Council. The effective date of the ordinance is October 1, 2002. We request that council approve ordinance for the Rate Structure for EMS charges.
