HomeMy WebLinkAboutR-2001-01 e e RESOLUTION NO. 2001-01 THIS IS A RESOLUTION ADOPTING AMENDMENTS TO THE COMPREHENSIVE PLAN OF THE CITY OF LA PORTE, UPON RECOMMENDATION OF THE PLANNING AND ZONING COMMISSION OF THE' CITY OF LA PORTE; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. WHEREAS, Section 211.004 of the Texas Local Government Code provides that Zoning regulations must be adopted in accordance with a Comprehensive Plan; WHEREAS, said statute also provides that a majority of the City Council of the City of La Porte may amend a Comprehensive Plan at any time; and, WHEREAS, Chapter 106, Zoning, Article 1, Section 106-65, of the Code of Ordinances of the City of La Porte, delegates to the Planning and Zoning Commission the duty to review and make recommendations relevant to modifications of the Comprehensive Plan; and, WHEREAS, the City of La Porte has a Comprehensive Plan which Plan was adopted by the City Council of the City of La Porte, by Resolution No: 35-86, passed on the 8th day of December, 1986, and which was previously amended by the City Council of the City of La Porte, by Resolution No: 94-11, pa~sed on the 12th day of December, 1994; and, "".... WHEREAS, pursuant to Zoning Ordinance mandate, the Planning Commission of the City of La Porte has reviewed various elements of the Comprehensive Plan as follows, to wit: a} At the Planning and Zoning Commission meeting which occurred on March 9, 2000, the Introduction, Community Vision, Community Profile, and Land Use Plans were reviewed; b} At the Planning and Zoning Commission meeting which occurred on March 16,2000, the Transportation, and Utility Systems Plans were reviewed; RESOLUTION NO. 200. e PAGE 2 c) At the Planning and Zoning Commission meeting which occurred on April 13, 2000, the Parks and Recreation, Community Facilities and Services, Residential Development, and Beautification and Conservation Plans were reviewed; d) At the Planning and Zoning Commission meeting which occurred on May 24, 2000, the Public safety, Redevelopment Strategy, and Implementation Plans were reviewed; and, WHEREAS, the Planning and Zoning Commission of the City of La Porte held a public hearing, duly posted and held in accordance with state law, on the 21st day of September, 2000, for the purpose of considering the aforementioned various components of the Comprehensive Plan; and, WHEREAS, after due consideration of comments made by the public at said public hearing together with the recommendations of staff presented at said Planning and Zoning Commission meetings and said public hearing, the Planning and Zoning Commission has recommended amendments to the Comprehensive Plan, more particularly outlined on Exhibit "A" attached to this Resolution; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LA PORTE, TEXAS, THAT: Section 1. That the revisions to the Comprehensive Plan of the City of La Porte attached to this Resolution, and which are incorporated by reference herein, be and are hereby authorized, approved, and adopted pursuant to the recommendations of the Planning Commission of the City of La Porte. Section 2. That the City Secretary of the City of La Porte or her designated representative be required to append said amendments to said Comprehensive Plan and duly mark and note said changes on the Comprehensive Plan of the City of La Porte. RESOLUTION NO. 200. e PAGE 3 Section 3. The City Council officially finds, determines, recites and declares that a sufficient written notice of the date, hour, place and subject of this meeting of the City Council is posted at a place convenient to the public at the City Hall of the City for the time required by law preceding this meeting, as required by the Chapter 551, Tx. Gov't Code; and that this meeting has been open to the public as required by law at all times during which this Resolution and the subject matter thereof has been discussed, considered and formally acted upon. The City Council further ratifies, approves and confirms such written notice and the contents and posting thereof. Section 4. This Resolution shall be effective fourteen (14) days after its passage and approval. The City Secretary shall notice of the passage of this Resolution by causing the caption hereof to be published in the official newspaper in the City of La Porte at least twice within ten (10) days after the passage of this Resolution. Resolution adopting Comprehensive Plan SUMMARY & RECOMMENDATION In late February, 2000, you received a three-ring binder with the second draft of the Comprehensive Plan Update. This document was the result of reviews by the Steering Committee and City staff The Planning and Zoning Commission reviewed this document and recommended the following modifications: . Add an Objective under Chapter 4, Land Use to consider creating a large lot residential zoning district and provide the associated regulations. . Include as part of Figure 5.3, La Porte Thoroughfare Plan, the extension of Farrington to North "H" Street. The Commission did not recommend the extension of Farrington beyond "II" Street. . Delete the "H" Street Bridge over Big Island Slough. . Delete the connection of "K' Street with Barbours Cut Blvd between Sens Road and North 16th Street. . The Unified Crime Report prepared by the Police Dept. should be included in Chapter 8, Community Facilities and Services City Council conducted a public hearing on January 8, 2001 regarding the draft Comprehensive Plan Update. Testimony heard at this 'meeting was similar to previous testimony heard by the Steering Committee and P & Z. The testimony was singularly focused on'The connection of Farrington with North "K' Street. At this time Council may make modifications to the document prior to approval of the adopting Resolution.
