Stablor, his heirs, successors and assigns, to construct, build, extend, maintain and operate, an electric light, eloctric palos, stringing whaes in and upon all of the public thoroughfares, streets, alleys, roads and highways, within the corporate limits of the City of La Porte, Harris County Texas; and the building of a power plant to generate tho electric current for heating,lighting, and power purposes, and defining the rights, priveleges and powers hereto, including the fixing of a tariff to be charged for the electric current. BE IT ORDAINED:-by the Board o~ Aldermen of the City of La Porto, Harris Coupty Texas. ~ection One: J. U. Stabler, his heirs, succes- sors and assigns, be and are hereby granted the right, prive1ege and franchise, to enter upon any and all streets, squares, parks, alleys or other public thoroughfar,es and highways in the Ci ty of La Porto, Harris County, Texas, to erect polos of a substantial size and material, string wires thereon for the conveying of elec- (\' tric current for heating, lighting and power purposes, in, upon, over and acros~ any stream or streams, bridge or bridges, owned or controlled by the City of La Porto, and to maintain and operate his or their electric polos, wires and power plants, and all other. necee sary apparatus,used in connection with and incident to the build- ing, establishment and operation of an electri~ power plant for the /,manUfacture and distribution of electric current for heating, light- ng and power purposes. , , , Section Two: That all poles and wires placed, erected, or con- structed for the distribution of electric current for heating, lighting and power purposes, shqll be so placed as not to impede or interfere in any manner with the usel of the streets or sidewalks' by the travelling public; shall be of standard eqipment and construc tioD, and so constructed as to minimize the risk of life and pro- perty, and shall be placed, erected, built and constructed at such places, and in such manner as may:' be designated and specified by the board of Aldermen of the City of La Porte, or such persons as they may authorize to act for them; and the surface of said streets, alleys, parkS or other public thoroughfareS and highways, when ex- cavated or used in any manner by the said J. U. Stqbler, his heirs, \._~)'! successors and assigns shall be restored and placed in good condi- tion as they were before said excavation was made; and all poles, ,arms, wires and other material and apparatus, including implements and tools used in erection, construction or repair of said electric light plant, shall at all times be kept off the streets and side-' walks so as not obstruct the reasonable use thereof by the public. In case the City Council of the City of La Porte shall grant the use of the streets or alleys for,the purpose of moving build- ings, the wires shall be raised or lowered at the cost of said J.U.' Stabler, his heirs, successors and assigns shall furnish a good first-class, high grade, electric power plant, and provide electric current for heating, li~hting and power purposes to the residents of the City of La Porte a~ a rate of one Dollar a month as a minimum charge, and regular rates to be 25 per cent above those charged the citizens of Houston Texas, by the Houst6n lighting and power 6ompany, said power to be operated, and said electric current furnished and supplied,between the hours of 5 P.M. and 7 A.M. from the first day of March until the first' day of October of each year; and from the hours of 4 P.M. to 7 A.M. from the first d,ay of November until the first day of March during each year. ...: . , '6. U. Stabler, his heirs, 'successors and assignR, shall be subject at all times to the insPQction of the authorized agent of the City of La Porto, and the said J. U. Stabler, his heirs, successors B.nd assigns hereby SUbject themselves to the Ordinance now in force or may be hereafter enacted and enforced, governing weights and mea- sures. Section ~ive: That the said J. U. Stabler, his heirs, ~ucces- sors and assigns shall begin the construction of said electric power plant, and the erection of poles and stringing of wiros for ta the conveying of electric current within t~irty days after the final passage and taking effect of this Ordinance; and shatl con- tinue the construction of said electric plant, and the erection of said poles and stringing of said wiros, for the conveying of said electric current for heating, lighting and power purposes, to the greater portion of the people of the tnroe principal settlemen~s of the City of La Porto, within (12) months of the passage and ta- ki~g effect of this Ordinance; upon default of a substantial com- ( ~ pliance of which, the Board of Aldermen of the City of La Porte /:ay, 'at its option declELre, by resolution or ordinance, this fran- chise and the priveloge hereunder, forfeited; provided the said J. U. Stabler, his heirs, successors and assigns shall have thirty days written notice of the introduction of said. resolution or ordin- ance shall be finally passed, and a certified copy of said resolu- tion or ordinance shall accompany said written notice. Section Six: Upon the said J. U. Stabler, his heirs, succes- sors qnd assigns accepting the provisions of this franchise, they shall have and enjoy the rights and prive1~ges herein granted for the term of Thirty Years from the date this Ordinance takes effect. Section Seven: All the provisions of this franchise, end the rights and privoleges herein granted, shall apply to any and all streets, ~quares, parks, alleys, bridges or other thoroughfares or highways, which are now within the corporate limits of the City of La Porte, or which may hereafter' come within the corporate limits of the City of La Porte by reason of an extension of the limits or otherwise. ' ; Section Eight: The City of T.la Porte reserves the right to itself and its successors, to purchase the entire plant at its fair appraised value, ~t the end of Fifteen (15) years, or at the end of ~ive (5) years term thereafter, during the life of the franchise, by givi,ng Twelve (12) months notice of stIch intent~on. Section Nine: That the said J. U. Stabler, for himself, his heirs, successors or assigns, shall"" within Twenpy (20) days after the passage of this Ordinance, file with the ~[ayor of theCity of La Porte his written acceptance of the terms and provisions of this franchise. Stabler, his heirs, successors and assigns, shall be subject at all times to the inspection of the authorized agent of the City of La Porte, and the said J. U. Stabler, his heirs, successors and assigns hereby subject themselves to the Ordinance nov in force or may be hereafter enacted and enforced, governing weights and mea- sures. Section Seven: All the proviSions of this franchise, and the rights and priveleges herein granted, shall apply to any and all streets, .squares, parks, alleys, bridges or other thoroughfares or highways, which are no~ within the corporate limits of the City ot La Porte, or which may hereafter' come within the corporate limits of the City of La Porte by reason of an extension of' the limits or otherwise. ~ -. Section Eight: The City of La Porte reserves tho right to itself and its successors, to purchase the entire plant at its fair appraised value, ~t the end of ~ifteen (15) years, or at the end of ~ive (5) years term thereafter, during the life of the franchise, by giving Twelve (12) months notice of such intention. Section Nine: That the said J. U. Stabler, for himself, his heirs, successors or assigns, shall 11#I within Twenty (20) days after the passage of this Ordinance, file with the Uayor of theCity of La Porte his written acceptance of the terms and provisions of this franchise.
