An Ordinance, establishing a standard of Weights and Measures for the City of La Porte, providing for the office of a Sealer of weights and measures,for his appointment and qualification for the appointment of deputies, prescribing powers, duties and compensa- tion, and prOViding for a penalty. ' Be it ordained by the City Council of the City of La Porte:- Section 1.; There is hereby created the department of weights and Measures of the City of La Porte; such department shall 'be in charge of and under control of an Officer to be known as the Sealer of Weights and Measures of the City of La Porte, who shall be appoint- ed by the Mayor, by and with the consent of the majority of the City Council. He shall hold his office for the term of One Year, or until the first UOllday in April following' his appointment, and until his successor is elevteo and qualified. Before entering upon the discharge of the duties of his office he ,Shall take the Constitutioaal Oath of office, and execute such bOIlld as may be prescribed by the Oi ty Council of the City of La- Por'te. Hi s compnllation, and the payment thereof shall be fixed by the Mayor and ,City Council. Section 2. There may be appointed such Oeputy Sea)ers of weights and~ measures, as the Mayor may deem expedient, who shall take the sante oath and give the same bond as is reqUired of the Sealer. SectioD 3. The ~ealer of Weights and Measures may procure a com- petent set of accurate weights and ~easures of the ~tate of Texas, ,.'Whun so directed by the City Council and cause the same to be trie4 l prc)ved, sealed and certified to by the official Custodian of Weights /~ and Measures of the S~ate of Texas; 'and thereby such weights and ' " measures shall be for the City of La Porte, and all vendors therel~ ,i ThE~ Sealer shall be the custodian of such standard set of weights ancl measures when so procured, and the same shall at all times con- fOJ~m ,to the standard of weights and measureS prescribed by law. The Selller shall prescribe the amount of tolerance to be allowed on weights and measures. Section 4., It shall be the duty of the Sealer of weights and mea SUlres to visit, form time to time as may be necessary, all places in said City where weights or scales of any kind or character are used, and to inspect the same, and for that purpose it shall be law- ful for him, and he is empowered at any respectable hour to enter ap an'Y' store-house or oth~r building where any such, weightS or scales H{!&j'lJj'fllHHJ~.fJIfJff~~""-#!.I4HHHHl=fMJ#1I<<!4lfH=l!:fHffOl or measures' are used;: such Bealer shall have supervision and control of all matters relating to measures and scales thereby, and he is charged with the enforcement or all Laws and Ordinances relating thereto. Whero any duty 1s placed upon the Sealer of Weights and ~!easures'under any Ordinance of the City of La Porte, the same may b~ performed by a duly appointed and qualified neputy, who shall in. the performance of his duties, have all the power of the Sealer. , ~ection 6. It shall be the duty of said'~ealer of Weights and Meiasures, not less than once in each year, and as much as may in his j'\Jldgment be necessary, to inspect and test the accuracy of all .'Iights, measures, s~ales, scal~beams, balances, steelyards, automa- ti,c and computing scalas, and all other instruments used in weighing arlY article Intendedto be sold or purchased in said City, and to stamp with a suitable seal, or otherwise certify as to the accuracy ccmforming tq the City standard, and deliver to the owner thereof a cortificate of such accuracy; and shall keep a register or all such WE)ights, meaSures 8cc., certified, and of all certificates issued, aud to whom. ; i.. ~ _ _~::..l. If the ~ealer of Weights and Measures shall find that ~lny weights and measures, or instruments for weighing and measuring ilre inco~rect, inaccurate or unreliable beyond the limits of ~61i&lft 1;ole~ance allowed, such weights or instruments for weighing may be c,ondemned. Section 8. The standard of Weights and Measures established and t>>rescribed by the laws of, the ~tate of Texas, shall be and consti- 1:ute, the standard of weights and measures for all vendors of all clommodi ties in, the City of r.la Porte, and all weights and measures used by th e vendors in the City of rJa Porte shall conform to such ~Itandard; and all commodities bought or sold wi thin the 11m! ts of 1;he City shall be '!,veighed or, measured in accordance therewith. ~ection 9. Every person, firm or corporation, using weights, Dleasures, scalebeams, patent balances, steelyards, gaSOline-pumps, ~Lppliances for measuring gasoline, or any instrnment used in weigh- 1,ng and measuring any article intended to be purchased or sold in 1:heCi ty, or in weighing and measuring any thing, commodity, merchas elize, wares, person or animal for hire or reward, shall cause the ~.ame to be inspected and sealed' by thq Sealer of Weights and neasure tn accordance with the provisions of this Ordinance, and the failure ~Lnd refusal so to do shall be an Offense, and it shall be inlawful j~orany person, fi 1"'m or corporation, to sell, offer for sale, or pep permit or cause to be sold, or buy or offer to buy, any commodity by any standard of wetghts and measures except the proper standard herein prescrihed. Section 10. Every vender of ice in the City of La Porte shall at 1ihe t.ime of actual delivery of any ice sold, weigh the quantity of tce delivered; and for that purpose shall use a steolyard balance or other apparatus., for weighing *uel) ice, which shall conform to the standard of weights and measures in accordance with the provis- ~Lons of the ordinances;' and all ice delivered to conr-umers wi thin ' 1:he City shall be Bold by avoirdupois weight, ,unless it is otherwise specially agreed upon between the buyer and seller: Eaoh and every set of tongs used in the delivery of City, shall have prominently and oonspicuously the exact avoirdupois weight of said tongs. I Section 12. That a standard measurement of a cord of firewood :Ls hereby fixed at one hundred and twenty-eight (128)$iil cubic :reet. It shall be unlawful for any person, firm or oorporation, be ]"ecG!iver, trustee, agent, servant or empolyee of such, to sell or (ieliver, or cause or permit to be sold or delivered to any purchaser :ri,re!wood in any quanti ties or by any measure, except by the cord or l)r f'ractional part, thereof; or to ca.use or permit to be sold or de- livered a less quantity represented to be sold or delivered. ~ection 11. :Lce wi thin said I:.tamped thereon ~ectlon 13. It shall be unlawful for any person, firm or corp~ra- 1;10n or trustee, receiver or officer, agent, servant or employee 1~hel'eor, to sell or to manufacture; or offer or expose for sale, or ()r cause or perm! t to be sold or manufa.ctured, or offered or exposed j~or sale 1n his, premises, or to have in possession, or keep for sale nny bread, un1ess he Sh~ll have' posted in a conspicuous place in the ).oom where said bNR.d 1s exposed for s'ala, a sign in sufficiently large letters t:o be read by customers, stating the ,veight of each loaf of bread, the trade name of the different kinds offered for sale, and the prioe per, loaf. ~eotion 14. Every person, firm or corporation Offending against ~Lny of the provisions of this ordinance, or failine; to comply therell ld th" shall be deemed guilty of a mi sdemeanor, and shall upon con- viotion be puntshed by a fine of not less that $1.00, and not more than $100.00.
