AND WHEREAS, the Oi ty of La Porte hu not. heretofore issued
time 'WarreDts duriDg the current oalendar year without publioatiOn of utice
and right to referendum as provided in House Bill No. 312, passed by the 42nd
Legislature at its Regular Session, in 1931, and therefore said $2,3'14.31 time

WHEREAS. there is oertain outst8Dding indebtedness which is
a legal ob1igat10n of the CUy of La Ports, and said C1ty is w1thout money with
which to pay sSlDe, and this City Council having had under cona1deration the
advisability 8Dd nec888ity of postponing the time of pQDl8Jlt thereof, in con-
sideration of 'the pQD1ent ot interest thereon, and issuiDg in lieu thereof,

This warrant is one ot a series ot five warrants, numbered trom
1 to 5 inclusive, in the denomination ot $500.00 each, except :Number 1 tor
$374.31, aggregating ~2,374.31, all ot which warrants are issued tor the
:;urpose ot funding an equal amount ot indebtedness of the City ot La Porte
duly and legally inourred tor lawful city purposes, the claims tor which
were duly audited and allowed by the City Council ot said City prior to
their issuance, and for which said City received full value and consideration
and hereby aCknOWledges receipt ot same; and whioh evidenoes ot indebtedness
were authorized by ordinanoes and orders duly and legally passed prior to their
issuance, made and entered upon the Minutes of the City Council ot the City
ot La Porte, Texas, and the holder hereof' shall and will be subrogated to all
the rights and priVileges against said City had and possessed by the holders
of said original evidences ot indebtedness, in accordanoe with the constitu-
tion and laws of the State Of Texas, and pursuant to an ordinance passed by
the City Council ot sa1d City ot La Porte, Texas, which ordinance is recorded
in the Minutes of said Council.
And it is further certified and recited that all aots, conditions
and things required to be done precedent to and in the issuance of this
watrant, have been prop arly done, have happened and been performed in regular

debtedness of' said City, including this warrant, does not exceed any consti-
tutional or statutory limitation; and that provision has been made f'or the

The date of' this warrant, in conformity with the ordinance above
mentioned, is August 16: 1931.

It is further QJ:datned that in the event it shall not be necessary
to issue the fUll amount of warrants herein contemplated, then in such event,
such amount 01' City ot La Porte Funding Warrants aB shall not be based upon
olaims duly approved by the Council shall be oancelled and destroyed, the
numbers and amounts ot warrants so cancelled and destroyed to be made a matter
of record upon the l\I1nutes of the City Council.
It is fUrther ordained by the City Council 01' the City of La Porte,
Texas, that to pay the interest on said warrants and create a sinking fUnd
with which to pay the principal as it matures, and to provide 10% attorneys'
fees in the event of default, a tax 01' 5 cents on each @100 valuation of
all taxable property in said City, shall be annually levied on all said
property and annually assessed and collected until said warrants and interest
thereon are paid, and said tax ot 5 cents on each $100 valuation of all taxaltle
property in said City, or 80 much thereof as may be necessary, or 80 much
more, if any, as may be necessary is here now levied for the year 1931 and
for each succeeding year while said warrants or any of them are outstandiDg;
and that the same shall be aBsessed and collected tor the current year and
annually thereafter, and applied to the purpose named.
Be it further ordained that the Mayor 0 t the City ot La Porte, be
and he is hereby authorized and directed to take and have Charge of said
Funding Warrants and he shall have authD27ity to deliver said warrants to
the owner and holder of the or ig1nal evidences of indebtedness herein listed,
and addl tional evidences of indebtedness to be hereafter issued, when said
original evidences ot indebtedness have been surrendered to him and can-
celled, Under further orders or said Council.
The fact that it will be a public banef'it to the City of' La Porte
to have the hereinbstore described indebtedness fUnded constitutes an amer-

seney and an imperative public necessity that the rule requiring ordinanoes
to be read at more than one meeting be suspended, and said rule is hereby
suapanded, and that this ordinance take ef1'ect and be in force from and atter
its passage and approval, and lt is so ordained.
