AN ORDIHANC,!; DEFINING VAGRAi'J'CY M1D PRO-
VIDING A PENALTY THEREFOR.
BE IT ORDAINED by the city Council of the City of La ~orte
mthat vagrancy shall be defined as follows:
The following persons are and shall be punished as vagrants,
viz:
(a) Persons knovm as trampe, wandering or strolling about in
idleness, who are able to work ~.nd have no property to support them.
(b) Persons leading an idle, immoral or profligate life, who
have no prop&.rty to support them, WhO are able ;0 work and do not work.
(c), All persons oble to work, have no property to support them,' ,I

livelihood. The term "visible or known means of !ii, fair, honest and re-

AN ORDINANCE PROHIBITING AND DECLARING IT UNLAWFUL FOR HORSES,
1ruLES, JENNETS, CATTLE, SHEEP, GOATS OR HOGS OR ANY OF THEM TO RUN AT LARGE
WITHIN, THE CITY LIM.ITS OF THE CUY OF LA PORTE, HARRIS COUNTY, TEXAS, AS
DEFINED IN VOL. 8, PAGE 16, MAP RECORDS OF HARRIS COUNTY, TEXAS, PROVIDING
FOR THE IMPOUNDING, SALE AND REDEMPl'ION OF ANY SUCH ANIMAI.S PERMI'l'TED TO
RUN AT LARGE; AND DECLARING THE RUNNING AT LARGE OF SUCH ANIMALS TO BE A
NUISANCE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTEI
SECTION 1. The territory included within the city limits of the
City of La Porte as shown in the map and plat of said city, recorded in
Vol. 8, page 16, ~~p Records of Harris County, Texas, and defined as
follows :
Beginning in the East line of West loth Street where it inter-
sects the Center line of North, D Street; thence East along the Center
line of North D Street, 5028.1 feet to the West line of Brownwell Avenue;
thence North 900 feet along the West line of Brownell Avenue to the South
line of North F Streot; thence East 1120 feet along the South line of
F Street to a point 10 feet East of the West line of North Donaldson
Avenue; thence South 284.9 feet along a line parallel to and 10 feet East
of the West line of North Donaldson Avenuo; thence South 21 degrees
15 minutes Est, 3965-3 feet along on a lino parallel to and 10 teet

East of the West line ot South Donaldson Avenue to the shore of Galveston
B~~ thence South 31 degrees 45 minutes West 1158.9 teet to the North-
east quarter of the ~hite tract (now Doctor Beazley's Homestead) a sub-
division ot the Johnson Hunter League in Harris County, Texas; thence
with the Bay Shore South 31 degrees 39~ minutes West 2021.2 feet; thence
South 26 degrees West 1816.6 feet to Doctor Fordham's Southeast corner;
thence North 64 degrees Wesi1524 feet along Doctor Fordham's South line
and South line produced to the North line of South K Street; :,thence West
4411.2 feet along the North line ot South K Street to the East line of
West 10th Street;:.thence'North 1oL~5 feet. along the Ea.ti'line of:,West loth
Street to the Canter line ot North D Street, the place of beginning,
containing 1218 & 11/100 acres of land, all in the Johnson Hunter League,
Harris County, Texas,
shall constitute the stock limits of the City of La Porte and the running
at large of horses, mules, jacks, jennets, cattle, sheep, goats and hogs

within such stock limits is hereby declared to be a nuisance and shall be
unlawi'ul.
SECTION 2. The term lito rtUl at large" or "running at large" as
used in this ordinance includes any animal whatsoever whioh may be staked,
tied or hobbled in any manner within the limits defined, in suo~ ~ler
as to ~llow such animals to go or get upon the adjacent sidewalk or, when
not in use, upon the street.
SECTION 3. It shall be the dut,}r of the City j'iIarshal 'l;~ establish
a public pound in the City, at such place as may be designated by the
City Council, where all anirr!8.ls of the above description found running at
large in violation of 'che flbove precodin.?; sections shall be reoei'lred and
taken oare of. It shall be the dut-.f of the Cit-.r Marshal to cause all
horses, mules, jacks, jemlErcs, ca:ctle, sheep, goats and hogs found running
at large within the limits mentioned in Section L cOlltrar-.( to the pro-
visions of the preceding sec'cions to be gathered and impounded in the
public pound, and the City Marshall shall sell. 'the same at public 3,uction
for ca3h, first giving five days' notioe of the time, terms and place of
sale,in some daily newspaper published in the Cr~ of La Porte, and by
notioe placed at the court house door of Harris County and a'b said public
pound, describing the animal impounded, and tha'c 'a fee of f~ cents shall
be oharged for eaoh a.ni:ll1al impounded, and all fees collected shall be re-
mitted to the Cit-.r Assessor and Collector, or to the City Treasurer, as
may be provided by ordinance.
SECTION 4,. The ovmer of any animal or animals impounded, as
provided for in the preceding section, may redeem the same as follo~:
(1.) BEFORE SOLD--~.r paying seventy-five cencs for taking up
and keeping, ~ld the offioer's fee of fi~i cents for impounding the soone,
together with' the 75 cents per day for the feed or care of such ani-mals.
(2.) AFTER SOLD--Dy paying to the purchaser double the amount
bid by him for such animal or animals, and his reasonable expenses for
keeping the same; pravided the owner redeems said animal, as hereul pro-
vided, within thirty days after the date of sale, otherwise said animal
to become the absolute property of the purohaser_
SECTION 5- If at the time of the sale no purchaser can be found
for aDf of the animals impowlded under the provisions of the preceding
sections, the City Marshal shall kill all suoh animals, or cause them to
be killed, and shall deposit the oarcasses in such place as may be desig-
nated for such matter.

SECTION 6. This chapter shall not be so construed as to prevent
any person or persons from bringing or driving any of the animals herein-
before mentioned into the City for sale. the same being under the immediate
Charge of themselves or their agents, nor shall it be so construed as to
interfere with parties in transi"t through the City with any of said animals.
Miloh cows in charge of any person going or ooming from pasture shall also
be exempt from the operations of this chapter.
SECTION 7. It shall not be law1'ul for any person other than
the City Marshal of the City or his deputy, to engage in the catching
or impounding of animals, nor shall any reward be given for such catohing
or impounding, and any person detected in driving any of said animals
into said prescribed area other than as hereinbefore authorized. and
any officer authorized to catch and impound said animals detected in
offering a reward of aqy kind whatsoever to any person or persons to catoh
or impound said animals, or a re,vard to drive them within the presoribed
limits, shall be deemed gu:i,l'tiy of an offense, and upon trial and conviction
shall be fined in a sum not leas than Ten Dollars ($10.00) nor more than
Twenty-five Dollars ($25.00), for each and every offense.
SECTION 8. Any money roceived into the City Treasury from the
net proceeds of the sale of impounded stock shall be paid to 'the owner
thereof.
SECT ION 9. This ordinanoe shall take effect thirty days after
its passage and it is so ordained.
SECTION 10. The City Council shall have the authority to
appoint a Deput-f Marshal to help enforce the above provisions of this
.
ordinanoe and fix his salary for same.
