REFERRING TO ORDnlANC~ NO 261
RESOLUTION
WHEREAS, the City of La Porte has heretofore passed and approved
Ordinanoe No. 261, regulating traffic upon the publio streets of the City of
La. porteJ and,
WHEREAS, such Ordinanoe provides that the City Counoil shall, by
resolution, dete~ine and designate the oharaoter of all offioial traffic
signs and signals and shall designate the looation where the same shall be
installed;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL THAT: the standing
or parking of any vehio1e is prohibited within the spaoe, Twenty-Four (24) feet
in width, on the north side of the street in front of and adjacent to the pro-
perty on which is looated the"Port Theater", on \'Vest Main Street, between First
and Second Streets, in the City of La Porte, Texas, and fUrther that the Police
Committee is hereby authorized and instruoted to properly mark and sign said
plaoe as a "no parking zone".
AND IT IS SO ORDERED.

ARTICLE I
Section 1. \'lherever in this Ordinanoe the following terms are used, they
shall have the meanings respectively ascribed to them in this section.
Intersection - The area embraced ~~thin the prolongation of the lateral
curb lines or, if none, then the lateral boundary lines of tVIO or more streets or
hiGhvJ8..Ys whioh join one another at an angle whether or not one suoh streGt or high-
,,::ay crosses the other.
Vehicle - Every device in, upon or by 'Which any person or property is or
may be transported o~ dravm upon a public highway.
Official Traffio Signals - All signals, not inconsistent wi.th this Ordi-
nllnce, placsd or ereeted by the City Council, .for the purpose of directing, 'Warning
or regule.:i:ii:n.g traffio.
Crosswalk - That portion of II roadway ordinarily included ;;i thi.n the pro-
l,ongation of' curb and property lines at intersections, or a:ny other port::'on of a
r,)advray clearly indioated for pedestrian crossing by lines or other ~rldngs on
the surface.
Traffic - Pedestrians, ridden or herded animals, vehicles t,n.d. other con-
vayances either singly or together while using any street for purposes of travel.
Operator - ~ person who is in actual physical control of a vohicle.
ART ICLE II
Section 1. I't shall be the duty ot the Polioe Depar"bnent of this City to
el~orce the provisiollS of this Ordinance. Officers of 'the Police Depar~~ent are
hE~reby authorized to direct all traffic either in person or by means of visible or
audible signal in oonformance with the provisions of this Ordinanoe, provided "chat
in the evont of a fire or other emergency or to expedite traffic or sl.l.:f.'eguard pedes-
tl'ians. officers of the Polioe or Fire Department may direct traffic, as conditions
mJJ.y require, notwithstanding the provisions of this Ordinance.
Sec'l;;ion 2. It shall be unla'wful for auy person to refuse 'to or fail to
ccmply ~ith a~~ lawfUl order, signal or direotion of a police officer.

Section 6. It shall be unlawful for any person to ride on any portion of

is in motion. This pr:)vis1~n does not apply to an employee engaged in the necessary
discharge of his duty ::lor to persons riding within truok bodies intended for merchan-
diee.

Section 2. If any vehiole is found upon any roadway in violation of any
pro~~sion in this Ordinance regulating the stopping, standing, or parking of vehicles
and the identity of the operator oannot be determined, the m9ner, or person in whose
n~e such vehicle is rezistcred, shall be held prima facie responsible for ~uch vlo-
la.tion.

or invalid for any reason such shall not effect the validity of the remaining parts

has determ1ned, upon the basis of an engineering and traffic in-
vestigation that the maximum reasonable and prudent speed over and
along that section ot West Main Street, between the intersection
of Broadway Street and West Main street and the intersection of
I Tenth street and West Main Street, 1s Twenty (20) miles per hour,
taking into consideration the width, condition of the pavement and
the amount of vehicular and pedestrian traffic, over, along and
accrols such section of West Main Street;
NOW, THEREFORE, BB IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF LA PORTE, TEXAS THAT:
The operation of a motor vehicle or any other vehicle,
! however propelled, over and along West Main street, between Broad. y
~ Street and Tenth Street, at a speed in excess ot twenty miles per
hour i8 prohib1ted and that such section ot West Main street shall
be a "20 mile per hour" zone for traffic.
The Police Committee is hereby authorized and instructed
to place 20 mile speed signs at the intersection ot West Main stre t
and Broadway Street and at the intersection ot West Main street a
Tenth Street.
