Section 2 ot Ordinanoe No. 254, passed by .the City Caunci , of. 'i;he City of La Porte, Texas Deoember 2, A. D. 1935, be amended so as to hore llfter road as {'ollOW's: There is hereby levied, and there shall be oollected frcm\ every perse o domiciled with~,o. the oorpora.~ limits of the Ci'ty of La Porte 't';ho has bean is- sued, by the Texas Liquor Control Board, a perr.:Lit of any of the following claases: Brewers, Distillers, Vlineries, Rectifiers, V~olesa1era, Paokage StoTa , Vlin.e and Beer Retailers, Bonded Warehouses, Wine Bott1ors and :Uedie~.na.l, as de- I timJd in House Bill No.5, as passed by the Regular Session of the 15th Legis- ltl.turo, and lmown as the "Texas Liquor Control Act", the following schedulo of foes, respectively: (a) The annual permit fee tor a Brewer's permit shall b0 the sum ot Five Hundred Dollars ($500.00). \ (b) The annual permit fee tor a Distiller's per.mit 6~11 be the suru of Five Hundred Dollars ($500.00). (0) The annual permit tee for a Class A Winery pe~i't shall be tho sum ot Tv~nt7-Five Dollars (~25.00). (d) The annual per.mit fee tor a Rectifier's permit Ghall be tho U~ or ~ive Hundred Dollars ($500.00). .I( e) The annual permit fee for a Vlho1esaler t s permi t sha~l be the sum. of Six Hundred Twenty-Five Dollars ($625.00). ; /(f) The annual permit fee for a Class B Wholesaler's per.nit shall be the sum ot One Hundred Dollars ($100.00). v{g) The annual permit fee tor a Paokage store permit shull be the Sunl of Sixty-Two and 50/100 Dollars ($62.50). (h) The annual permit fee for a Wine and Beer Retailer'S permit shal be the sum. of Fifteen Dollars ($15.00). (1) Before any permit roquired by this Seotion of this Ordinanoe sha i be issued, the annual permit fee required therefor shall be paid to the City I Secretary tOl- the use and benefit of the general tund of the City. Upon appli- ! I cation aooompanied by said permit tee, it shall be the duty of the City Seore.. I ta.ry to forthw1,th issue the proper permit. All permit foes levied by this Seo- tion shall be paid in advanoe for one (1) year unless such fee be oolleoted for only a portion of the year. In SQoh event the fee required shall oOV'ar the per- iod of time frCi:n the date of the permit to midnight of August 31st next suc- oeeding and only the proportionate part of the tee levied for such permit shall be colleotsd. The traotional part of any month remaining shall be oounted as one (1) month in caloulating the fee that shall be due. No permittoe shall ob- tain any retund upon surrender or non-use of any permit issued under this Seo- tion of this Ordinanoe. (m) It shall be unlawful for any person who has been issued, by the I Texas Liquor Control Board, any permit ot the olasses mentioned in this Seotion ot the Ordinanoe, to engage in the business authorized thereunder \~thin the oorporate limits of the City without first having paid the City permit tee as levied by this Ordinanoe. Seotion 2. If any Seotion or parts ot Seotions or a:ny provision, paragraph, sentence, clause, phrase or word oontained in this Ordinance shall be held by the Courts to be unoonstitutional or for any reason invalid, suoh holding shall ::lot ef'fPeot -the remaining portions of' this Ordinance and the City I Council of the City of La Porte, Texas hereby deolares that it would have passe L suoh remaini:cg portions despite such invalidity. :i Section 3.
