AN ORDINANCE ESTABLISHING FIRE LlM ITS; REGULATING BUILD- ING CONSTRUCTION AND ALTERATIONS; PROVIDING FOR PERMITS AND FEES; AN.D PROVIDING THE FOLLOWING: ANY PERSON VIOLATING ANY OF THE PRO- . VISIONS OF THIS ORDINANCE SHALL BE DEEMED GUILTY OF A MISDFMEANOR, .AND UPON CONVICTION SHALL BE FINED IN ANY SUM NOT TO EXCEED $100.00. EACH DAY A VIOLATION IS PE~ITTED TO CONTINUE SHALL CONSTITUTE A SEPARATE OFFENSE, AND DECLA~ING AN E:I~ERGENCY.. BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY '. i. OF LA PORTE, TEXAS, THAT: Section 1. The following shall be and are hereby de- .clared to be the fire limits of the City of La Porte, Texas: Beginning at a point on the City Limit Line on Tenth Street in the centerof the alley of Block #46 of the Town of La Porte; Thence in an easterly direction along the center of the alley to the center of South Third Street; Thence sout~ along the center of South Third Street to a point in the center of South A Street; Thence in an easterly direction along the center of South A Street to San Jacinto Avenue; across San Ja- cinto Avenue in a direct line to the center of South A Street between blocks #198 and #201 of the Town of La Porte; thence in an easterly direction along the center of South A Street to a point in the center of Sbuth~Seyenth Avenue; Thence north along the center of South Seventh Avenue to a point in the center of the alley in block #197 of the Town of La Porte; Thence in an easterly direction along the center of the alley to a point in the center of South Tenth Avenue; thence in a northerly direction along the center of South Tenth Avenue across East Main Street and along the center of North Tenth Avenue to a point in the center of the alley thrpugh block #184 of the Town of La Porte; Thenoe in a westerly direction along the center of the alley to a point in the center of North Broadway Street; thence in a westerly direction to the center of the elley in block ~O of the Town of La Porte; thence in a westerly direction along the center of the alley to the City Limit Line on Tenth Street; . .V\ )...". \ i I Thence in a southerly direction along the City Limit ~ine on Tenth Street to the place of beginning. Section 2. No wall, structure, building or part thereof shall hereafter be built, enlarged or altered until a plan of the proposed work together with a statement of the materials to be used shall have been submitted to the buinding inspector or designated officer of the City of La Porte, Texas, who shall, if in accordance w'ith provisions herein contained, issue a permit for the proposed construction. Before such permit is issued, the buinder, his re- presentative or contractor, shall.be required to furnish 4etailed information regarding the name of the owner, proposed 10cation, character of occupancy, 1ftam&'1" and kind of material, plumbing, :\ , I / I . l \- .; / \ \ i - I te 'e -2- wiring, roofing, chimney and flue construction, mar~er and kind of heaD to be used, estimated cost of building, estimated time tor completion and the name of the contractor. On securing this information, it shall be the duty of the building inspector or other authorized agent to ~ssue a building per- mit upon the payment of $1.00 by said owner which gives the builder the right to erect said building and the right to place the materials required for said construction upon the streets and alleys adjacent to the lot where said bUilding is to be erected, provided that in no event shall such materials be p~aced in any street or al- ley so that it will interfere with the trAffic over or through said street or alley or endanger the public in passing such building. All other applicable Ordinances must be complied with. Permits are re- quired on all buildings erected within the corporate limits of the (~ity of La Porte, Texas, with the exception of buildings where the total cost does not exceed $25.00. Structures hereafter erected without permit or not in conformity with. this Ordinance shall be :r~emoved. ." The building inspector or other designated officer shall 'be required to keep a record of all building permits issued in a lIrell-bound volume that shall be available for the inspection of the 'public. No building shall be moved from one location to another within the City Limits of La Porte, Texas, until a permit has been obtained therefor. A permit shall be issued only in case the con- struction is in accordance with this Ordinance. \/j Section 3. Every building herearter erected, altered or e:olarged within the fire limits, shall be enclosed on ali sides with .,alls constructed wholly of stone, well"burned brick, reinforced con- c:t"ete, hollow tUe, concrete' bloclcs or ironclad on steel frame. No structure whose walls are wholly, or in pELrt, constructed of wood, shall hereafter be built or moved into . the fire limits as herein designated or as they may hereafter be e~ltab11shed except as follows: (a) Temporary one-story frame build.ings for the use of builders, (b) Wooden fences not over 8 feet high with- out cover or roof. Any existing frame or ironclad building, within the fire \ limits, which may hereafter.be damaged by fire, decay or otherwise, i / to an amount greater than one-half of its present value exclusive of the foundation shall not be repaired or rebu1lt, but shall be re- moved. Extensions to or remodel~ng to change the type of construction of existing buildings shall not be considered as repairs. Repairs to existing wood shingle roofs shall be limited to minor repairs, and where exceeding 5<>% of the value of the roof, shall be replaced only with incombustible mater1als. Section 5. Any person viola~1ng any of the provisions of this Ordinance shall be deemed guilty of a miSdem~anor, and upon con- vi.~tion shall be fined in any sum not to exceed $100.00. Each day a '~iolation is permitted to continue shall constitute a separate o.(:E'ense. Section 6. All Ordinances or parts of Ordinances in- consistent or in conflict with the provisions of this Ordinance Shllll be and the same are hereby repealed.. Section 7.
