POUND OR IN ANY l'ANN1!:R INTERFERING WITH THE SAFE-KEEPING OF DOGS THEREIN. ************************* BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LA PORTE: ,:t Section 1. That it shaJ.l be unlawful for any person or persons o'\"ming or having in their possession,' any dog, to allow same to be at large upon the streets, sidewalks, or public grounds of the City of .LIa Porte, Texas, and any dog found upon the aforesaid public places, shall be considered to be at'large and the owner or owners thereof, the person or persons having the care, control or , -custody thereof; shali be -deemed -to have violated this Ordinance; save and except a dog under tho control of a person or persons b,y means of a chain, rope, cord or leash of not more than fifteen feet in len~th and suitable to control the action of said dog. Section 2. It shall be unlawful for any person or persons to a, . tamper with the City Dog Pound or in any manner interfere with the safe-keeping of the dogs therein.... Section 3. It shall be. the duty of the officer designated by the City of La Porte, Texas, to take up and take charge of any and all dogs found at large upon the places aforesaid and to take said dogs to the City Dog Pound, or other suitable place, there to be impounded and detained for a period of three (3) calendar days. Section 4. Notice of Impounding. As soon as possible after any dogs have been delivered to the city dog pound it shall be the duty of the City to post a notice at the door of the dog pound describing each of said dogs, vmether bearing a license tag or not, and giving the number of the t~and the ,~ name of the person registerine the dog in each case where the dog bears a license tag. '" \,oJ., If' .. . .' .- --.. ,e as required herein, it shall be the duty of the City to notify the person to whom such license tag was issued by letter, postal card or telephone. The mailing of said letter or postal card shall be deemed sufficient notice 'Whether the person addressed shall receive the same or not. Section 5. Redemption of impounded dogs. The person entitled to the possession of any dog taken up and delivered to the city dog pound, upon pr.oper application with~n three o.ays from the date -of impoundinp; said dog, shall be entitled to have the dog delivered to him; provided, that such dog is not affected or thought to be affected with rabies, hydrophobia, mange or other in- fections or contagious disease, upon the payment of a $1.50 impounding fee for ~ I 4Il;: each and every dog impounded in accordance with the provisions Gi of this article and in addition thereto, in the case of unlicensed dogs, upon the payment of the current year's license fee of $1.00, plus 50~ per day for each day of care by the City. Section 6. Sale of unredeemed dogs. It shall be the duty of the City to offer for sale at public outcry any and all healthy dogs impounded under the terms of this article and IJDt redeemed within three days, and to sell the same for cash; provided, that no dog shall be sold for less than $2.00, and that the person entitled to the possession of any dog shall be entitled to redeem said dog upon paying the purchaser double the amount paid by him for the doe and his .-_..... . ." reasonable expenses for keeping the same. Any dog not so redeemed vdthin thirty days from the date of sale shall become the absolute property of the purchaser. rlo dog shall be sold for less than the amount of accrued charges. Section 1. uisposal of dogs not redeemed or purchased. It shall be the duty of the City to cause all dogs taken up under the terms of this article not redeemed or purchased as provided above, to be destroyed by some manner de- signated in writing by the City Commission. ~he carcasses shall be deposited in such place as may be designated by the City Commission. Any person or persons violating the provisions of this Ordinance by suffering or permitting dogs oVll1ed or controlled by them to run at large in the aforesaid places shall be deemed guilty of a misdemeanor and upon conviction shall be fined a sum of $10. 00, and each day that a dog is so permitted to run at large shall be deemed a distinct and separate offense. ' Section 9. Any person or persons violating Section 2 of this Ordinance shall be deemed guilty of a misdemeanor and upon conviction shall be fined the sum of $100.00. Section 10. If ~ portion of this Ordinance shall, for any -I: reason, be found invalid, such invalidity shall not affect the remaining portions thereof but same shall remain in full force and effect. Section 11. All Ordinances in conflict herevdth, if any, are here- by expressly repealed to the extent of such conflict only. Section 12. That the City Clerk of the City of La Porte, in accordance vdth the provisions contained in Section 25 of the Charter of said City, shall give notice of the passage of this Ordinance by causing the caption thereof to be published in the official newspaper of the City of La Porte, Texas, at least twice wi thin ten days after the passage thereof and shall note on this Ordinance and the record thereof, the fact that same has been publiShed as required by said, ----...~ ...... Charter; and the date of such publication and promulgation of this Ordinance. ,.'
