PROVIDING QUALI-j FICATIONS :OF THE MEMBERS OF THE PLANNING COMMISSION. PROVIDING THE METHOD OF I APPOINTING THE MEMBERS OF TUE PLANNING COMMISSION. AND PRESCRIBING THE POWERS I AND DUTIES THEREOF. 1 . . . I BE IT ORDAINED BY TH;E CITt COMMISSION OF THE CITY OF LA PORTE. TEXAS. THAT: I Section 1. There is hereby created a Board to be designated "City of La Porte Planning COmmissionn I herein sometimes referred to as the Planning Com- mission. for the purpose of promoting and aiding the general development Df the City of ta Porte. . ~'.he Planning Commission shall consist of seven (7) members. appointed by tbe City Commission of the City of La Porte. Section 2. Each member of the Planning Commission shall be a resi- I I I. I Section 3. The initial members of the Planning Commission shall be I . appointed to serve until the first day of MaYI A. The object and purpose of the Planning Commission is to act as an Advisory Board to the City Commission relating to all nature of public ~ :. improvements] civi.c:improvements. To adopt and recommend to the City Commission plans and methods of promoting and aiding the purposes and objects set out in the first patagraph of this Section. and the Planning Commission may also propose to the City Commission plans and methods for the clearance of slum districts and rehabilitation of blighted areas. (b) To investigate '~ny plan) plat or s~bdivision. of land within the City of La Porte! or within five miles of the corporate limits of the City of La Porte, and deter~ine whether such plan, plat or subdivision conforms to the general plan of the City in its streets, playgrounds and. public utilities facilities. including those which have been or ma.y be laid out. and to the general plan for the ex- tension of the City and its roads, regard being had for access to. and extension ~f. sewer and water mains and instrumentalities of the public util~ties. . (c)' To require the 'owners of land within the City of La PorteJ or , within five miles of the corporate limits of the City of La Porte, .: who desire to lubdivide. plat or re-plat land for urban develop- ment. to provide for setback building linesJ to dedicate streets and alleys of adequate width in conformity with the extension and widening' .of exi:sting and ~uture streets and alleys in the vicinitYI to coordinate street layouts and stre~t planning with municipal- ities! _bether they adj~in or notJ with County I State and Federal designated highways so that a coordinated street and traffic plan may be established and continued for the best interest of the general public. (d) . If any s.~chplan, plat or subdivision conforms to such general rul es and regulations of the City' of La Porte. then it is the duty of the Planning Commission to endorse their approval on the plan, plat or 'subdivision. The Planning Commission shall act upon such plan, plat, o.r su.bdivision within thirty days from the date such plan, plat or subdivision is filed with the Planning Commission and if suchplan~ plat or subdivision has not been disapproved within thirty (30) days after such date it shall be deemed approved and a certificate showing the filing date and failure to take action ,thereon shall. on demand. be i.ssued by the Planning Commission and such certificate shall be sufficient and shall be in lieu of the written. endorsement of approval required herein. If such plan. plat or. subd~visjon is approved Or disapproved) the Planning Com- mission shall indicate such approval or disapproval by a certifi- cate endorsed on the plan or plat and signed by the Chairman of the Commission .nd attested by the Secretary, or signed by a major- ity of the members of the Planning Commission.
