HomeMy WebLinkAboutO-1958-533_, __ __ _ ,_ • • • ORDINANCE N0. 533 '!AN ORDINANCE VACATING, ABANDONING AND CLOSING THE PORTIONS OF THE STREETS AND ALLEYS LYING WITHIN THE AREA BOUNDED BY ARIZONA, EAST G, TEXAS,E AST J STREETS, 'iAND PARK AVENUE, IN THE TOWN OF LA PORTS, HARRIS COUNTY, TEXAS, AND RESERVING AN EASEMENT FOR THE REPAIRING, MAINTAINING AND REPLACING OF THE EXISTING WATER LINES AND SANITARY SEWER LINES WITHIN THE SAID AREA. WHEREAS, the Board of Trustees of the La Porte Independent School • District has unanimously adopted a Resolution determining and declaring the nece i ~sity for the acquisition of the said School District of the herein described ;tract of land lying within the City Limits of the City of La Porte., to be used `, gfor grounds for a public school building or buildings, and appurtenances or additions thereto, and playgrounds in connection therewith, more particularly described as follows, to-wit: Beginning at a common point, being an old stake in the center of the in- tersection of Broadway, Main. and San. Jacinto Streets, in the Town. of La Porte, in Harris County, Texas; thence in a Southerly direction along the center line of San Jacinto Street, a distance of 3130 feet to a point; thence at right angles in a Westerly direction 50 feet to a point, being the most Northerly corner of Block No. Two Hundred Seventy-Six (276) of the said Town of La Porte, and continuing in a Westerly direction along the Northerly line of said Block No. Two Hundred Seventy-Six (276) a distance of 326 feet to the most Northerly corner of Block No. Two Hun- dred Seventy-Five (275) of said Town of La Porte., being the place of beginning of the herein described tract; Thence South 27015' East a distance of 1360.1 feet along the most Souther- ly line of Arizona Street to a point for corner, also being the South- easterly corner of Block No. Three Hundred Three (303) of said Town of La Porte; • Thence in a Northeasterly and Easterly direction around a curve to the right, whose radius is 382 feet, a distance of 357.3 feet to a point for corner, also being the Southeasterly corner of Block No. Three Hundred Four (304) of said Town of La Porte; Thence South 26°22' West a distance of 617.8 feet to a point for corner; Thence due West a distance of 1412 feet along the North right-of-way line of Avenue "J" to a point for corner; Thence due North a distance of 1340 feet along the East right-of-way line of Texas Street to a point for corner; Thence North 62°53' East along the Southerly right-of-way line of Avenue "G" a distance of 811.3 feet to the place of beginning, and containing 43.5 acres more or less; and WHEREAS it is necessary that the said School District acquire those portions of the hereinafter described streets and alleys which lie within the ~- • • C` labove described tract; and _2_ WHEREAS, the said portions of the herein described streets and alleys 'flying within the said above described tract have never been opened or used as a i,public road or street; and WHEREAS, the City Commission of the City of La Porte has determined • ~;iand does hereby find, determine and declare that the hereinafter described por- !tions of the hereinafter named streets, and the hereinafter described alleys, i dying within the above described tract of land to be acquired by the La Forte ;:.Independent School District are not suitable, needed, or beneficial to the pub- lic as a public road or street or alley, and should be vacated, abandoned and ;permanently closed; NOW, THEREFORE, HE IT ORDAINED BY THE CITY C0~9~ISSION OF THE CITY OF LA PORTE, TEXAS, THAT: Section 1. Under and by virtue of the power granted to the City of • 'La Porte under its Home Rule Charter and Chapter 13, Title 28, Article 1175, of 'the Revised Civil Statutes of the State of Texas, 1925, all of the portions of the streets and all of the alleys lying within the boundaries of the above des- cribed tract, and lying in and between Blocks No. Two Hundred Seventy-Three (273 Two Hundred Seventy-Four (274), Two Hundred Seventy-Five (275), Two Hundred Nine. ty-Six (296), Two Hundred Ninety-Seven (297), Two Hundred Ninety-Eight (298), Two Hundred Ninety-Nine (299), Three Hundred One (301), Three Hundred Two (302),, Three Hundred Three (303), Three Hundred Nineteen (319), Three Hundred Twenty (320), Three Hundred Twenty-0nc (321), and Three Hundred Twenty-Two (322), of the Town of La Porte, Harris County, Texas, and Block No. Fifty-One (51) of Syl- van Beach First Subdivision, Harris County, Texas, all according to the maps or plats thereof recorded in the office of the County Clerk of Harris County, Texasl are hereby permanently vacated, abandoned and closed by the City of La Porte; provided, however, there is hereby excepted and reserved to the City of La Portej an easement for the purpose of repairing, maintaining and replacing all water lines and sanitary sewer lines now existing within the above described tract. ~ u .a + • • • `J -3- Section 2. WHEREAS, the Gity of La Porte, on April 25, A. D. 1950, filed a cer- tain notice of assessment for street improvements against Blocks No. One Hundred and Ninety-Nine (199) and Two Hundred (200) of the Town of La Porte, Harris County, Texas, such notice being filed under Harris County Clerk's File No. 736436; and XHEREAS, the City of La Porte has not constructed the street inpTOVn-- ments described in said notice and does not intend to construct such n<~r~ov-~nt:s; and WHEREAS, the City does not havc or claim any indebtedness and/or paving lien against said property; NOA THEREFORE BE IT RESOLVED BY THE CITY COE~~IISSION OF TH ITY E C OF LA PORTS, TEXAS, THAT H. P. Pfeiffer, and Frank G. Baker, Mayor Pro-Tem. and City Clerk of said City, respectively, be, and they are hereby} authorized and direc- ted to execute, acknoxledge, and have recorded in the office of the County Clerk of Harris County, Texas, an instrument releasing any and all rights, titles, in- terests and/or claims which the City may have heretofore had under and by virtue of the hereinabove mentioned notice of assessment for street improvement.
