AN ORDINANCE AMENDING ORDINANCE N0, 494 INTRODUCED, APPROVED AND PASSED BY THE
CITY COMMIISION OF THE CITY OF LA PORTS, ON ITS FIRST READING, ON THE 20TH DAY
OF MARCH, A. D. 1956, FIXING THE BOUNDARY LIMITS OF THE CITY OF LA PORTS, TEXAS,
AND ENLARGING AND EXTENDING THE BOUNDARY LIMITS OF SAID CITT' AND ANNEXING ADDI-
TIONAL TERRITORY LYING ADJACENT TO SAID CITY WITHOUT THE CONSENT OF THE TERRI-
TORY AND THE INHABITANTS ANNEXED; PROVIDING FOR PUBLICATION OF THE ORDINANCE AF-
TER ITS INITIAL INTRODUCTION AND PASSAGE BY THE CITY COMMISSION OF SAID CITY;
PROVIDING THAT ANY CITIZEN OF THE SAID CITY OR OF THE TERRITORY TO BE ANNEXED
SHALL HAVE THE RIGHT TO CONTEST SUCH ANNEXATION AND SHALL BE GIVEN AN OPPORTUNIT
TO BE HEARD; AND PROVIDING A SAVINGS CLAUSE.
WHEREAS, under and by virtue of Section 2, Article 1175, of the Re
t
vised Civil Statutes of the State of Texas, of 1925, as amended, and Section 10
of the Hame Rule Charter of the City of La Porte, the said City is authorized
and empowered to fix the boundary limits of said City, and to provide for the
extension of said boundary limits and the annexation of additional territory ly-
ing adjacent to said City, with or without the consent of the territory and the
inhabitants annexed; and
WHEREAS, the City Commission of the City of La Porte, after due an
careful consideration, determined that the territory within the hereinafter des-
cribed limits, lying adjacent to the City of La Porte, is adaptable to, and
necessary for, the economical and municipal needs any: growth of the City of La
Porte, and should be annexed to said City;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY
OF LA PORTS, TEXAS, THAT:
Section 1. Ordinance No. 494, introduced, approved and passed by
the City Commission of the City of La Porte, upon its first reading, on the 20th
;day of March, A. D, 1956, shall hereafter read, and is hereby amended to read,
jas follows, to-wit:
Section 2. The boundary limits of the City of La Porte, Texas, be
enlarged and extended, as hereinafter set out, so as to include within the boun-
dary limits of said City all that territory lying adjacent to said City within
the following described limits,without the consent of the territory and the
inhabitants annexed, to-wit:
All the territory lying within the limits described as follows, to-wit:

Beginning at the intersection of the center line of Rest Madison Street
(formerly known as North "D" Street) and the Rest right-of-way line of
North Second (2nd) Street;
Thence in a Northerly direction along the Rest right-of-way line of
North Second (2nd) Street to the point where the Rest line of said North
Second (2nd) Street projected North. intersects with the North right-of-
way line of the T ~ N 0 Railroad (also known as the G H & S A Railroad);
Thence in a Northwesterly direction along the North right-of-way line
of said T G N 0 Railroad to the point where the same intersects with
the East boundary line of the Town of Lomax, Texas;
Thence in a Northerly direction along the East boundary line of the
Town of Lomax, Texas, to the Northeast corner of the said Town of Lomax;
Thence in a Resterly direction along the Northernmost bonndary line of
the said Town of Lomax to the point where the said boundary line inter-
sects with the North right-of-way line of the said T ~ N 0 Railroad;
Thence in a Northwesterly direction along the North right-of-way line
of the said T G N 0 Railroad to the point where Lhe same intersects
with the Easterly right-of-way line of the Battleground Road., projec-
ted around the curve of said right-of-way line in a Southerly and Easter-
ly direction;
Thence in a Northerly direction along the said projected right-of-way
line of the said Battleground Road, around the curve of said right-of-
way line, and continuing in a Northerly direction along the said Easter-
ly right-of-way line of the said Battleground Road, to the point where
the same intersects with the Easterly right-of-way line of the Park
Road;
Thence in a Northerly direction along the said Easterly right-of-way
line of the said Park Road, to the point where the same intersects with
the Southerly boundary line of the San Jacinto Battleground State Park;
Thence in a Southeasterly direction along the said Southerly boundary
lice of the said State Park to the Southeast corner of said State Park;
Thence in a Northerly direction along the Easterly boundary line of said
State Park to the point where the same projected intersects with an
imaginary line twenty-five hundred (2500) feet distant from, and parallel
to, and Southwest of, the center line of the Houston Ship Channel;
Thence in a Southeasterly direction along an imaginary line twenty-five
hundred (2500) feet distant from, parallel to, and Southwest of, said
center line of the Houston Ship Channel, to the point where said imaginary
line intersects with the North boundary line of the La Porte Independent
School District;
Thence in a Resterly direction along the said North boundary line of the
said La Porte Independent School District, a distance of four hundred
(400) feet to a point;
Thence in a Northwesterly direction along an imaginary line twenty-nine
hundred (2.900) feet distant from, parallel to, and Southwest of, said
center line of the Houston Ship Channel, to the point where said imaginary
line intersects with an imaginary line four hundred (400) feet distant
from, parallel to, and East of, the East boundary line of the said San
Jacinto Battleground State Park projected;
Thence in a Southerly direction along an imaginary line four hundred (400)
feet from, parallel to, and East of, the East boundary line of said State

Park projected and along an imaginary line four hundred (400) feet dis-
tant from, Parallel to, and East of, the said East boundary line of the
said State Park, to the point where the said imaginary line intersects
with an imaginary line four hundred (400) feet from, parallel to, and
South of, the South boundary line of the said State Fark projected;
Thence in a Resterly direction along an imaginary line foar hundred (400)
feet from, and parallel to, and South of, the South boundary line of the
said State Park, and continuing on said imaginary line four hundred (400)
feet from, and parallel to, and South of, the said South boundary line
of the said State Park to the point where the said imaginary line inter-
sects with an imaginary line four hundred (400) feet from, parallel to,
and East of, the said Park Road;
Thence in a Southerly direction along an imaginary line four hundred
(400) feet from, parallel to, and East of, the East boundary line of
the said Park Road to the point where the said imaginary line intersects
with an imaginary line four hundred (400) feet from, parallel to, and
East of, the East right-of-way line of the said Battle Ground Road;
Thence in a Southeasterly direction along an imaginary line four hundred
(400) feet from, parallel to, and East of, the Easterly right-of-way line
of the said Battle Ground Road, and continuing on said imaginary line
four ,hundred (400) feet from the East right-of-way line of said Battle-
ground Road and around the same curve as that of said Road, to the point
where said imaginary line intersects with an imaginary line four hun-
dred (400) feet from., parallel to, and North of, the North right-of-way
line of the said T G N 0 Railroad;
Thence in a Southeasterly direction parallel to, and four hundred (400)
feet from., and North of, the North boundary line of said T G N 0 Rail-
road to a point where an imaginary line running parallel to, and four
hundred (400) feet from, and North of, the North right-of-way line of
the saidT G N 0 Railroad intersects with an imaginary line running East
anal West, parallel to, and four hundred (400) feet from, and North of,
the Northernmost boundary line of the said Town of Lomax;
Thence in an Easterly direction parallel to, and four hundred (400) feet
from, and North of, the said Northernmost boundary line of the said Town
of Lomax to a point where an imaginary line running in an Easterly and
Westerly direction parallel to, and four hundred (400) feet from, and
North of, the Northernmost boundary line of the said Town of Lomax inter-
sects with an imaginary line running North and South parallel to, and
four hundred (400) feet from, and East of, the East boundary Iine of the
said Town of Lomax;
Thence in a Southerly direction parallel to, and four hundred (400) feet
from, and East of, the East boundary line of the .said Town of Lomax, to
a point where an imaginary line running North and South parallel to, and
four hundred (400) feet from, and East of, the East boundary line of the
said Town of Lomax intersects with an imaginary line running Northwes-
terly and Southeasterly parallel ta, and four (400) feet from, and North
of, the North right-of-way line of the said T R N 0 Railroad;
Thence in a Southeasterly direction parallel to, and four hundred (400)
feet from, and North of, the North right-of-way line of the said TEN 0
Railroad to a point where an imaginary line running Northwesterly and
Southeasterly parallel to, and four hundred (400)feet from, and North of,
the North right-of-way line of the said TEN 0 Railroad intersects with
an imaginary line projected North from the East right-of-way line of
North First (1st) Street;

Thence in a Southerly direction along said projection aad the East
right-of-way line of North First (lst) Street to the center line of
hest Madison Street, same being on the present City limits of the
City of La Porte;
Thence in a Westerly direction along said City limit line and the
center line of hest Madison Street, to the place of beginning.
Section 3. The territory included within the above described boun-
dart' limits be hereby annexed to, and made a part of, the City of La Porte,
Texas, and the inhabitants thereof shall be entitled to all rights and privi-
leges of other citizens of said City and shallbe bound by the acts, ordinances,
resolutions and regulations of said City.
Section 4. If any portion or portions of the territory included in

the above described limits is validly included. within any other incorporated
City, Town of Village, then such portion or portions of such above described
territory is hereby excluded anal the remaining territory is hereby annexed to
the City of La Porte, Texas, and the boundary limits of said City are hereby
amended to conform to the boundary limits of such other City, Town or Village,
'~~or such other Cities, Towns or Villages along the area of conflict.
Section 5. If any portion or portions of the above described terri-
'tort' legally may become included within. the limits of any other incorporated
iCity, Town or Village, by reason of a valid annexation ordinance heretofore in-
troduced before the Council, Commission or other governing body of such City,
Town or Village, than such portion or portions of the above described territory
is hereby excluded and the remaining territory is hereby annexed to the City of
La Porte and the boundary limits of said City of La Porte are hereby amended to
conform to the boundary limits of such other City, Town or Village or such other
Cities, Towns or Villages along the area of conflict.
Section 6. If any legal impediment exists, preventing the valid an-
vexation of any portion of the above described territory to the City of La Porte;
then such portion of the above described territory is hereby excluded and the
remaining territory is hereby annexed to the City of La Porte and the boundary
limits of said City of La Porte are hereby amended to conform to the territory
so annaxad.
Section 7, Upon the introduction of this ordinance in the City Com-
llmission of the City of La Porte, Texas, it shall be published in the official

newspaper as adopted by the said City Commission in the City of La Porte one (1)~
time and it shall not thereafter be finally acted upon until at least thirty (30
days have elapsed after the first notification thereof. Any citizen of the City
of La Porte, or of the territory to be annexed, shall have the right to contest
such annexation by filing with the City Commission of the City of La Porte a
written petition setting out the reason for said contest, and after such citizen.
or citizens shall have been given an opportunity to be heard, this ordinance, in
its original or amended form, as the said City Commission in its judgment may
determine, shall be finally passed., and the territory so annexed shall be a part
of the City of La Porte, Texas, .and the inhabitants thereof shall be entitled to
all rights and privileges of other citizens anal shall be bound by the acts, ordi~
nances, resolutions and regulations of said City.
Section 8. If any portion of this ordinance be invalid then so much
thereof as shall not be invalid shall be and remain in full force and effect.
Section 9. This ordinance shall be in force and effect from and af-

,ter it has been published and finally passed by the City Commission of the City
Iof La Porte, in accordanee with the provisions of Section 7 of this ordinance.
