!AN ORDINANCE FIXING THE BOUNDARY LIMITS OF THE CITY OF LA PORT E, TEXAS, AND EN-
''LARGING AND EXTENDING THE BOUNDARY LIMITS OF SAID CITY AND ANNEXING ADDITIONAL
;;TERRITORY LYING ADJACENT TO SAID CITY WITHOUT THE CONSENT OF THE TERRITORY AND
~~THE INHABITANTS ANNEXED; PROVIDING FOR PUBLICATION OF THE ORDINANCE AFTER ITS
;.INITIAL INTRODUCTION AND PASSAGE BY THE GITY COMINISSION OF SAID CITY; PROVIDING
;'THAT ANY CITIZEN OF THE SAID CITY OR OF THE TERRITORY TO BE ANNEXED SHALL HAVE
:;THE RIGHT TO CONTEST SUCH ANNEXATION AND BE GIVEN AN OPPORTUNITY TO BE HEARD;
SAND PROVIDING A SAVINGS CLAUSE.
WHEREAS, under and by virtue of Section 2, Article 1175, of the Re-
vised Civil Statutes of the State of Texas, of 1925, as amended, and Section 10
of the Home Rule Charter of the City of La Porte, the said City is authorized
and empowered to fix the boundary limits of said City, and to provide for the
extension of said boundary limits and the annexation of additional territory ly-
ing adjacent to said City, with or without the consent of the territory and the
inhabitants annexed; and
WHEREAS, the City Commission of the City of La Porte, after due and
careful consideration, determined that the territory within the hereinafter de-
scribed limits, lying adjacent to the City of La Porte, is adaptable to, and
necessary for, the economical and municipal needs and growth of the City of La
Porte, and should be annexed to said City:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
LA PORTE, TEXAS, THAT:
Section 1. The boundary limits of the City of La Porte, Texas, be en-

larged and extended, as hereinafter set out, so as to include within the boun-
dary limits of said City all that territory lying adjacent to said City within
the following described limits, without the consent of the territory and the in-
habitants annexed, to-wit:
All the territory lying within the limits described as follows,
to-wit:
Beginning at the point where the South right-of-way line of
South "J" Street intersects with the West right-of-way line of
the TGNO Railroad (also known as GHvSA Railroad), such point
being on the present City Limits of the City of La Porte;
Thence in a Westerly direction along the South right-of-way
line of the said South "J" Street to the point which is due South
of the point on the South right-of-way line of Spencer Highway
located five hundred (5G0) feet West from the intersection of
the South right-of-way line of Spencer Highway ,and tt~e East right-
of-way line of Underu~ood Road projected Southerly;

Thence due North to the North right-of-way line of Spencer
Highway and the present City Limits of the City of Houston;
Thence in a Resterly direction along the North right-of-way
line of the said Spencer Highway and along the present City
Limits of the said City of Houston to the point where the same
intersects with the Restern boundary line of the La Porte In-
dependent School District;
Thence in a Southerly direction along the said Restern boun-
dary line of the said La Porte Independent School District
to the point where the same intersects with the North boundary
line of the George IdcKinstry Survey, Abstract No. 47, in Har-
ris County, Texas;
Thence in an Easterly direction along the said North boundary
line of the said George 61cKinstry Survey to the point where the
same intersects with the Rest right-of-way line of the said
TGNO Railroad;

Thence in a Northerly direction along the Rest right-of-way
line of the said T~NO Railroad to the place of beginning.
Section 2. The territory included within the above described boundary
limits be hereby annexed to, and made a part of, the City of La Porte, Texas,
and the inhabitants thereof shall be entitled to all rights and privileges of
other citizens of said City and shall be bound by the acts, ordinances, resolu-
tions and regulations of said City.
Section 3. If any portion or portions of the territory included in

`the above described limits is validly included within any other incorporated
City, Town or Village, then such portion or portions of such above described
~~ territory is hereby excluded and the remaining territory is hereby annexed to
r the City of La Porte, Texas, and the boundary limits of said City are hereby

amended to conform to the boundary limits of such other City, Town or Village,
or .such other Cities, Towns or Villages along the area of conflict.
Section 4. If any portion or portions of the above described terri--

tory legally may become included within the limits of any other incorporated
City, Town or Village, by reason of a valid annexation ordinance heretofore in-
troduced before the Council, Commission or other governing body of such City,
Town or Village, then such portion or portions of the above described territory
is hereby excluded and the remaining territory is hereby annexed to the City of
La Porte and the boundary limits of said City of La Porte are hereby amended to
conform to the boundary limits of such other City, Town or Village or such other
Cities, Towns or Villages along the area of conflict.

Section 5. If any legal impediment exists, preventing the valid an-
vexation of any, portion of the abovh described territory to the City of La Porte,
.then such portion of the above described territory is hereby excluded and the
remaining territory is hereby annexed to the City of La Porte and the boundary
limits of said City of La Porte are hereby amended to conform to the territory
so annexed.
Section b. Upon the introduction of this ordinance in the City Com-~

mission of the City of La Porte, Texas, it shall be published in the official
newspaper as adopted by the said City Commission in the City of La Porte one (1)
time and it shall not thereafter be finally acted upon until at least thirty (3d
days have elapsed after the first notification thereof. Any citizen of the City!
of La Porte, or of the territory to be annexed, shall have the right to contest
such annexation by filing with the City Commission of the City of La Porte a
written petition setting out the reason for said contest, and after such citizen;
or citizens shall have been given an opportunity to be heard, this ordinance,
in its original or amended form, as the said City Commission in its judgment
may determine, shall be finally passed, and the territory so annexed shall be a
part of the City of La Porte, Texas, and the inhabitants thereof shall be en-
titled to all rights and privileges of other citizens and shall be bound by the
acts, ordinances, resolutions and regulations of said City.
Section 7. If any portion of this ordinance be invalid then so much
thereof as shall not be invalid shall be and remain in full force and effect.
Section 8. This ordinance shall be in force and effect from and after

it has been published and finally passed by the City Commission of the City of
La Porte, in accordance with the provisions of Section b. of this ordinance.
Introduced and approved and passed by the City Commission of the City
