HomeMy WebLinkAboutO-1958-560• I~ ORDINANCE N0. ~ C~ ~ AN ORDINANCE ALTERING THE PRIMA FACIE SPEED LIMITS ESTABLISHED FOR VEHICLES UP- ~~ ON STATE HIGHWAY N0. 146 (ALSO KNOWN AS SOUTH BROADWAY), ALONG THE SECTION FROM K STREET TO THE SOUTH CITY LIMITS OF THE CITY OF LA FORTE AT THE BRIDGE OVER LITTLE CEDAR BAYOU, WHILE THE CONSTRUCTION OPERATIONS OF THE STATE HIGHWAY DE- PARTMENT ARE IN PROGRESS; PROVIDING THAT THE ORDINANCE SHALL BECOME INEFFECTIVE' UPON COMPLETION OF THE ROADWAY CONSTRUCTION; AND PROVIDING THAT ANY PERSON VIO- EATING ANY OF THE PROVISIONS OF THIS ORDINANCE SHALL BE DEEMED GUILTY OF A MIS- ; DEMEANOR AND UPON CONVICTION THEREOF SHALL BE FINED IN ANY SUM NOT MORE THAN TWO HUNDRED DOLLARS ($200.00), WHEREAS, the Texas Highway Department will begin construction opera- tions in the near future for the placement of hot-mix asphaltic concrete on State Highway 146 (:also known as South Broadway Street) along the section of roadway from G Street, in the City of La Porte, to the City Limits at the bridge over Little Cedar Bayou; and WHEREAS, in the interest of safety it is desirable to establish a construction speed zone not to exceed forty (40) miles per hour along the high- way construction project, NOW, THEREFORE, BE IT ORDAINED BY THE CITY CO MMISSION OF THE CITY OF 1 LA FORTE, TEXAS, THAT: Section 1. On the basis of an engineering and traffic investigation heretofore made as authorized by the provisions of Section 8 of Article 827a, Vernon's Texas Penal Code, it is hereby determined and declared that forty (4G) miles per hour is the reasonable and safe rate of speed while the construction operations of the State Highway Department, for the placement of hot-mix as- phaltic concrete, is in progress on State Highway 146 (also known as South Broad- way) along the section of road from K Street to the South City Limits of the City of La Porte at the bridge over Little Cedar Bayou, and such speed limit is' hereby fixed at the rate of forty (40) miles per hour for vehicles travelling upan said highway, or parts thereof, along the section from K Street to the said South City Limits, Section 2. Any person violating any of the provisions of this ordi- nance shall be deemed guilty of a misdemeanor, and upon conviction thereof shall; be fined in a sum not more than Two Hundred Dollars ($2f~0.0O). Section 3. This ordinance shall be in force and effect while the Texas Highway Department is engaged in the said construction operations, and • -2- • upon the completion thereof this ordinance shall become ineffective and shall be of no further force and effect thereafter. Section 4.
