HomeMy WebLinkAboutO-1959-566• • • u r • ORDINANCE N0..S~ AN ORDINANCE FIXING, AND ORDERING PAID, REASONABLE ATTORNEY'S FEES FOR ANNEXA- TION PROGRAM; i'ROVIDING THAT SUCH FEES BE PAID OUT OF CURRENT REVENUES AND APPRO- PRIATING AN AMOUNT OUT OF CURRENT REVENUES TO PAY SUCH FEES. WHEREAS, Kiibler L Kiibler, attorneys, of La Porte, Texas, have represented the City of La Porte in handling annexation matters, ordinances and agreements covering the area northwest of La Porte, to ultimately include within the corporate limits of the City of La Porte the area of certain properties owner by E. I. du Pont de Nemours C Co., Celanese Corporation of America, National Petro-Chemicals Corporation, Houstong Lighting C sower Company and Phillips Petroleum Company, hereinafter called Industries, during the period from January, 1956 to and including passage of the final ordinance No. 558 as amended, finally passed December 22, 1958, and to the present date; and WHEREAS, during said period said attorneys represented said City in the controversy with the said Industries and the settlement of such controversy and impending litigation, resulting in an agreement with said Industries whereby certain portions of their property have been finally annexed to the City of La Forte, with an agreed amount of taxes to be paid thereon each year for a perm of five (5) years, in an amount equal to the total sum of One Hundred Twenty-Five Thousand Dollars ($125,000.00) per year, and totalling Six Hundred Twenty-Five Thousand Dollars ($625,000.00) tax revenue to the City during said five (5) year period; and WHEREAS, the legal services furnished to the City in connection witl such matters has been with the understanding that reasonable compensation there- for would be paid by the City to said attorneys upon the conclusion of such matters; and WHEREAS, it is agreed by the City Commission of the Gity of La Porn and said attorneys that the sum of Twenty Thousand Dollars ($20,000.00) is a fair, reasonable, just and proper fee to be paid for the services so rendered: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LA FORTE, TEXAS, THAT: Section 1. The City of La forte shall pay the sum of Twenty Thousar Dollars ($20,000.00) to Kiibler ~ Kiibler as reasonable attorneyts fees for them services rendered to the City in the annexation of certain properties owned by E. I, du Pont de Nemours C Co., Celanese Corporation of America, National Petro- chemicals Corporation, Houston Lighting C Power Company and Phillips Petroleum ~d ~d -2- Company, resulting in an agreement that the sum of Six Hundred Twenty-Five Thou- sand Dollars ($625,000.00) shall be paid to the City by said Industries over a ~ period of five (5) years, beginning January 1, 1959. j Section 2. The said sum of Twenty Thousand Dollars ($20,000.00) ~ shall be paid to said attorneys out of current revenues of the City of La Porte and there is hereby set aside and appropriated the sum of Twenty Thousand Dollar ($20,000.00) out of said current revenues for the purpose of paying such attorney fees.
