J"8o AN ORDINANCE CALLING THE REGULAR BIENNIAL ELECTION OF THE CITY OFFICIALS OF THE CITY OF LA PORTE, TEXAS; PROVIDING FOR POLLING PLACE: APPOINTING ELECTION OFFICIALS: PROVIDING FOR RETURN AND CANVASS OF VOTES OF SAID ELECTION: PROVIDING FOR NOTICE; PROVIDING FOR FILING FEES FOR CANDIDATES: AND SAVING CLAUSE. BE IT ORDAINED BY THE CITY COMMISION OF THE CITY OF LA PORTE, TEXAS, THA T : I 'I 1 Section 1. An election be held wi thin the corporate lim-'i its of the City of La Porte, Texas, on the 26th day of April, 1960; ~ such day being the fourth Tuesday in April, between seven o.clock . . (7:00) A. M. and seven o'clock (7:00) P. M., for the purpose of electing a Mayor and four (4) Commissioners of said City. Section 2. There shall be but one (1) polling place, which shall be the City Hall, located within the corporate limits of the City of La Porte, Texas. Section 3. MRS. H. M. RALSTON is hereby appoint- I ed Judge of said election, vms. or IS HARRISON and are hereby appointed Assistant Judges of said election, and liffiS. LOIS CO~WTON vms. REX BAKER and MRS. HALLIF; 'i/lUGHT are hereby appointed Clerks of said election. Section 4. Immediately after the close of the polls on , ithe 26th day of April, 1960, the election officials shall make due ! i II return thereof to the City :1 It il canvass the returns on the Monday next following the 26th day of If Ii IIApril, 1960, or sooner, provided that in the event of a failure, Ii ii from any cause, of the Commission to convene on the said Monday II Ii II then the Commission shall be convened for that purpose upon the 11 ii JI earliest day practicable thereafter, and shall immediately after Ii . II canvassing the returns declare the results of the election and the I' !I I : Commission and the City Commission shalll ! -_ I' ~ . ~ ~ .. :. <I :\ 'i ;1 ~ ~ ii !:; 1~ e e -2- Mayor shall immediately thereafter deliver to the candidates for whom the greatest number of votes have been polled for the office of Mayor and for the offices of Commissioner a certificate of elec- tion, and such elected officials shall assume their duties within ten (10) days thereafter, Sundays excluded. Section 5. Notice of said election shall be given by publication in the La Porte Liberal, not less than thirty (30) days., I prior to the date of the said election, of the following notice: "NOTICE OF ELECTION I, H. P. Pfeiffer, Mayor of the City of La- Porte, Texas, by virtue of the power vested in me by law, do hereby order that an election be held in the said City of La Porte, Texas, on the 26th day of April, 1960, for the purpose of electing a Mayor and four (41 Commissioners of said City, and that said election shall be held at the City Hall in said City between seven o'clock (7:00) A. M. and seven o'clock (7:00) P. M. on said date, and the following named persons are the appointed officials of said election, to-wit: Judge MRS. H. M. Upon a candidate tendering his app11cation onl form prescribed, the City Clerk shall furnish to such candidate! Section 7. The City Clerk is hereby authorized and di- rected to give notice of said election in accordance with Section 5 hereof. Section 8. The filing fee for each candidate shall be as follows: For Mayor $ 100.00 For Commissioner $ 50.00 Section 9. Each and every provision, paragraph, sentenc and clause of this ordinance has been separately considered and passed by the City Commission of the City of La Porte, Texas, and each said provision would have been separately passed without any other provision, and if any provision hereof shall be ineffective, invalid or unconstitutional, for any cause, it shall not impair or affect the remaining portion, or any part thereof, but the vali portion shall be in force just as if it had been passed alone. RESOLUTION BE IT RESOLVED by the City Commission of the City of La Porte that it is the wish and desire of the City Com- mission that local labor, both skilled and unskilled, be employed by all contractors performing contracts for the City for street improvements, city hall and fire station buildings, and swimming pool, whenever possible, and further ~ that the prevailing wage scales for such labor be paid by such contractors. AND IT IS SO ORDERED. .
