AN ORDINANCE PROVIDING FOR AN ELECTION TO BE HELD APRIL 26, 1960,
FOR THE ELECTORS OF THE CITY OF LA PORTE, TEXAS, TO ACCEPT OR RE-
JECT A PROPOSED AMENDMENT TO THE CITY CHARTER OF SAID CITY FOR A
CITY COMMISSION COMPOSED OF A MAYOR AND FOUR (4) COMMISSIONERS;
PROVIDING FOR DECLARING THE TWO (2) CANDIDATES FOR COMMISSIONER
RECEIVING THE FIRST AND SECOND HIGHEST NUMBER OF QUALIFIED VOTES
AT THE REGULAR CITY ELECTION ON APRIL 26, 1960, TO BE DECLARED
ELECTED FOR A TERM OF TWO (2) YEARSj PROVIDING THAT THE TWO (2)
CANDIDATES RECEIVING THE THIRD AND FOURTH HIGHEST NUMBER OF QUALI-
FIED VOTES AT THE SAID REGULAR CITY ELECTION ON APRIL 26, 1960, TO
BE DECLARED ELECTED FOR A TERM OF ONE (1) YEAR: AND PROVIDING FOR
A SPECIAL ELECTION IN THE EVENT OF A TIE IN THE FOURTH HIGHEST
NUMBER OF VOTESj PROVIDING THAT A MAYOR AND TWO (2) COMMISSIONERS
SHALL BE ELECTED ON THE FOURTH TUESDAY OF APRIL, 1962, AND EACH
EVEN-NUMBERED YEAR THEREAFTERj PROVIDING THAT TWO (2) COMMISSIONERS
SHALL BE ELECTED ON THE FOURTH TUESDAY OF APRIL, 1961, AND ON THE
FOURTH TUESDAY OF APRIL IN EACH ODD-NUMBERED YEAR THEREAFTERj PRO-
IVIDING THAT THE FOUR (4) POSITIONS OF THE COMMISSIONERS ON THE CITY
COMMISSION SHALL BE NUMBERED ONE (1), TWO (2), THREE (3) AND FOUR

City of La Porte, Harris County, Texas, on the 26th day of April,
! 1960, at which election there shall be submitted to the resident

iqualified electors of the City of La Porte, for their acceptance or
rejection of the following amendment to the Horne Rule Charter of
the City of La Porte, Texas, to-wit:
AMENDMENT NO I
Article II, Section 12, of the Horne Rule Charter of the City
of La Porte, Texas, as amended, shall be amended so that the same
shall hereafter read as follows:
"Section 12. City Commission, Number, Selection, Term:

The members of the City Commission of the City of La Porte
shall hold their offices for a term of two (2) years, except
that two (2) Commissioners elected at the regular election

for City Officers to be held on April 26, 1960, shall hold
their offices for the term of one (1) year as hereinafter
provided, and until their successors have been elected and
duly qualified.
After the regular City Election to be held on the fourth
Tuesday in April, 1960, the City Commission shall be com-
posed of a Mayor and four (4) Commissioners, and thereafter
a Mayor and two (2) Commissioners shall be elected on the
fourth Tuesday in April, 1962, and the other two (2) Com-

missioners shall be elected on the fourth Tuesday in April,
1961, and thereafter a Mayor and two Commissioners shall be
elected on the fourth Tuesday in April of each even numbered
year and two Commissioners shall be elected on the fourth
Tuesday in April of each odd-numbered year. After the votes
of the election have been canvassed and the results of the
regular City Election on the fourth Tuesday in April, 1960,
have been declared, the candidate for the office of Mayor
and the two (2) candidates for the offices of Commissioner
receiving the highest number of qualified votes at such elec-
tion shall be declared elected and shall serve as Mayor and
Commissioners, respectively, for a term of two (2) years,
upon qualifying as required by law; the two (2) candidates
for the offices of Commissioner receiving the third and fourth
highest number of qualified votes for the offices of Commis-

candidates receiving such tie vote with the fourth highest
number of qualified votes, and the candidate receiving the
highest number of qualified votes at such special election
shall be declared elected and serve for a term of one (1)

Thereafter, in the election of Commissioners at the elec-
tions to be held annually on the fourth Tuesday in April of
each year, the two (2) candidates receiving the highest num-
ber of qualified votes shall be declared elected, and there
shall be no run-off electionsi in the election of a Mayor,
the candidate receiving the highest number of qualified votes
shall be declared elected and there shall be no run-off elec-
tions. In the event the election of a Mayor or a Commissioner
cannot be determined because of a tie vote, the City Commis-
sion shall call a Special Election within thirty (30) days
to determine the winner between the candidates receiving such
tie vote, and the candidate receiving the highest number of
qualified votes in such special election shall be declared

Commission shall be numbered One (I), Two (2), Three (3),
and Four (4), and at the first regular meeting of the City
Commission after the results of the regular City Election
on the fourth Tuesday in April, 1960, have been declared,
the four (4) Commissioners elected shall determine by lot
the number of the position of each Commissioner. In all
subsequent elections all candidates for City Commissioner
shall be voted on and elected separately for positions on
said City Commission, and all candidates shall be desig-
nated on the official ballot according to the number of
such positions to which they seek election."

A RESOLUTION PROVIDING THAT NOTICE BE GIVEN OF THE INTEN-
TION OF THE CITY COMMISSION OF THE CITY OF LA PORTE, TEXAS, TO
SUBMIT TO THE QUALIFIED VOTERS OF THE CITY, FOR APPROVAL OR REJEC-
TION, ONE (1) CERTAIN AMENDMENT TO THE EXISTING HOME RULE CHARTER
OF THE CITY OF LA PORTE.
WHEREAS, the City Commission of the City of La Porte deem
it advisable at this time to submit to the qualified voters of the
City of La Porte one (1) amendment to the existing Charteri and

been altered or amended within two (2) years next preceding the da e

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF

the La Porte Liberal, a newspaper published in the City of La Port
and the official newspaper of said City, as notice of the intentio1
of the City Commission to submit said Amendment, and the same, whe
marked "NOTICE OF INTENTION TO SUBMIT CHARTER AMENDMENT," SIGNED
BY THE Mayor of the City of La Porte and attested by the City Cler
and published as aforesaid, is to be due notice thereof.
SECTION 3: That said notice shall be published in the
~ La Porte Liberal, the official newspaper as aforesaid, for not les
than ten (10) days and the first publication thereof shall be not
less than twenty (20) days prior to the date on which the proposed
ordinance submitting the amendment to the City Charter is to be
