ORDINANCE No.5 88 AN ORDINANCE DISANNEXING THE CERTAIN HEREINAFTER DESCRIBED TERRITORY FROM THE CITY OF LAPORTE; PROVIDING THAT SAID TERRITORY WILL NO LONGER BE CONSIDERED A PART OF THE CITY OF LAPORTE FOR ANY PURPOSES; PROVIDING IN ALL OTHER RESPECTS THAT THE LIMITS OF THE CITY OF LAPORTE SHALL REMAIN UNCHANGED; PROVIDING A SEVERABLE CLAUSE; DECLARING AN EMERGENCY; AND FIXING EFFECTIVE DATE OF THE ORDINANCE. WHEREASJ certain vacant and unimproved property presently located within the limits of the City of LaPorte, consisting of more . than ten acres and complying in all respects with the requirements of Art. 973 of Vernon's Revised Civil Statutes, should be discon- tinued and disannexed from the City of LaPorte; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LAPORTE: SECTION 1. That the hereinafter described territory be and the same is hereby discontinued and disannexed from the City of LaPorte; and that the boundary limits of the City of LaPorte be and the same are hereby amended to exclude such described territory from the city limits of the City of LaPorte, and that the same shall not hereafter be included within the territorial limits of the said city, .. and the inhabitants thereof shall no longer be governed by the acts, ordinances, resolutions and regulations of said city. That the territory discontinued and disannexed herein, consisting of more than ten acres, is described as follows, to-wit: TRACT NO.1: BEGINNING at a point in the South ROW line of Spencer Highway located 500' West from the point of intersection of the South ROW line of Spencer Highway with the East ROW line of Under- wood Road; THENCE due North to the North right-of-way line of Spencer Highway and the present city limits of the City of Houston; THENCE Westerly along the North ROW line of Spencer Highway right-of-way and along the present city limits of the said City of Houston to the point where the same intersects the Western boundary line of LaPorte Independent School District; .. e e . THENCE Southerly along the Western Boundary of LaPorte Independent School District across Spencer Highway to a point for corner in the South right-of-way line of Spencer Highway; THENCE Easterly along the South right-of-way line of Spencer Highway to the Place of Beginning. TRACT NO.2: BEGINNING at the Northeast corner of Outlot 481, said point being the Southeast corner of City of Houston 100' strip in the North city limits line of the City of LaPorte as of June 1, 1960; THENCE Westerly along the North line of Outlots 481 - 490, inclusive, to a point in the East line of Underwood Road for corner; THENCE Southerly along the East ROW line of Underwood Road a distance of 10' to a point for corner; . THENCE Easterly along a line 10' south of and parallel to the North line of Outlots 490-481, inclusive, to a point in the East line of said Outlot 481 for corner; THENCE Northerly along the East line of Outlot 481 a distance of 10' to the Place of Beginning. SECTION 2. That the limits of the City of LaPorte shall remain unchanged except as may be modified herein by discontinuing from the limits of the city the territory described in Section 1 hereof. SECTION 3. That it is the intention of the governing body of the City ofLaPort~o disannex only such territory as may be properly discontinued and disannexed by it, and should any portion of this ordinance be declared to be void and unenforcible and should ~ any portion of the area sought to be disannexed not be subject to disannexation by the City of LaPorte, the remaining portions of said territory and the remaining provisions of said ordinance shall remain in full force and effect. SECTION 4. That the City Commission of the City of LaPorte in the exercise of its discretion has concluded that the above described area, being vacant and unimproved land consisting of more than ten acres, and being subject to disannexation under the pro- visions of Art. 973 of Vernon's Revised Civil Statutes, should be discontinued and disannexed for the benefit of the inhabitants of . said city. -2- . . . . e e SECTION 5. The fact that the areas described in this ordinance are vacant and unimproved territory consisting of more than ten acres and which are subject to disannexation under the pro- visions of Art. 973 of Vernon's Revised Civil Statutes and the fact that the disannexation of said territory will be for the benefit of the inhabitants of the City of LaPorte creates an urgency and an emergency in the preservation of the public health, safety and welfare and requires that this ordinance shall take effect immediately from and after its passage, and that said territory shall no longer be considered part of the City of LaPorte after the Mayor of said City shall enter an order to that effect in the minutes or records of said City, as the law in such cases provides.
