FJ~NSE FOR rrr-m CITY OF LA POETE.
BE IT ORDAINED BY THE crry COlVUHSSION OF rrHE CITY OF LA POHTE,
'rEXAS, THNr :
Section 1. H. P. PFEIFFEH is hereby appointed
Assistant Director of Civil Defense for the City of La Porte,
and shall serve in such office for the term beginning the
~O;t:/J day of )n.7 ' 1960.
This ordinance shall take effect and be in force
from and after its passage and approval, and it is so ordained.

TO THE MAYOR AND CITY COMMISSIONERS OF THE CITY OF LA PORTE:

WHEREAS, by Ordinance No. 548 the Mayor and City Com~ission-
ers of the City of La Porte created a Planning and Zoning Commission
with the primary duty of adopting a comprehensive plan and report
its plan and recommendations to the City Commission of the City of
La Porte; and,
WHEREAS, the Planning and Zoning Commission created by said
Ordinance immediately set about a study for planning and zoning the
City; and,
v'iHEREliS, the Planning ana Zoning Commission after numerous
and frequent public meetings and numerous and frequent hearings, 8S

reflected in the minutes of the Planning and Zoning Commission, bas
come to a conclusion and finds as follows, to-wit:
1. To provide for an orderly development and redevelopment
of tbe City of La Porte as it presently exists, it is unanimously
recommended that the enclosed proviSions for Planning and Zoning
be adopted by the City Commissioners of the City of La Porte.
2. It is unanimously the opinion of the Planning and
Zoning Commission that the enclosed comprehevsive zoning plan should
be adopted as a City Ordinance within as short a time as possible in
order that the citizens of the City of La Porte may have a compre-
hevsive plan to rely upon and in order that further derrogation of
. property values may be brought to a halt.
3. It is the unanimous opinion of the Planning and Zoning
Commission that the recommendations made herein will best promote
the bealth, safety, morals, and general welfare of the inhabitants
of the City of La Porte.

WHEREAS the City Conrrnission has been advised by Mr. John F. Duncan, Jr.,
Houston, Texas that he intends to use his best efforts to arrange for the
development of 219 acres of land on the west side of Highway 146, north and
adjacent to Shore Acres and that in order to properly develop this area he
desires to create a fresh water supply district to provide water and sewer
facilities in this area.
The City of La Porte has already passed an ordinance annexing this
area on first reading. Sl10uld this annexation be completed before the water
district can be formed and can issue and deliver its bonds, then this allllexa-
tion would completely stop and would dissolve the water district. Therefore
Mr. Duncan has requested the City to give him an expression to the effect
that the City has no objection to the creation of this district and that it
does not intend to oomplete the annexation until the district has been completed
and funds have been made available for the construction of water and sewer
facilities.
Whereas the State Statutes provide that when a city annexes an
entire fresh water supply district or water control and improvement district
then the City acquires all of the assets of this district and assumes all of
the debts of this district. It is the position of the City of La Porte that
it is fully justified in asking that the developer agree to the following
conditions:
(a) It is intended that the Board of Supervisors of the
proposed District will submit to the City of La Porte
all pl~ns and specifications for the construction of
water and sewer facilities and that these plans and
specifications meet the City of La Porte standards.
(b) That all water and s~ver facilities constructed ,vill be
so designed that they vall be readily integrated with the
City of La Porte facilities should they be extended to
this area.

(c) It is understood that the owners and developers intend to
have Mr. Ernest L. Brown, Jr. employed as Fiscal Agent for
This District and have Mr. Brown instructed to keep in mind
the City of La Porte and its financial pDsition in determining
all terms and conditions of the proposed bonds to be sold by
the Fresh Water Supply District.
(d) That the District give serious consideration to the possibility
of tying the proposed District system into the City of La Porte
system. This proposition is a suggestion that these matters
be explored and of course if it is determined that this procedure
is both feasible and economical then it would be the wishes of
the City Commission that it be carried out.
Subject to the v~itten acceptance of the conditions contained in this
resolution the City Commission does hereby assure all interested parties that
so long as this development is carried out in a manner consistent with the
future demands of the area and acceptable to the City of La Porte, then it is
not the intention of Ule City Commission to annex this area until after the
District has been created and monies have been made available for the con-
struction of the water and sewer facilities within the area and assuming that
this project will be carried through to completion wi thin the normal length
of time.
The City Commission wishes to clearly state that this is an expression
of intent made in good faith.
