ORDINANCS NO. ~21 AN ORDINANCE ANNEXING THE HEREINAFTER DESCRIBED rrERRITORY rro THE CITY OF LA PORrrE, rrEXAS, AND EXrrENDING THE BOUNDAHY LIMITS OF SAID CITY SO AS rro INCLUDE SAID HEREINMFrEH DESCHIBED TERHITOEY WrI'HIN SAID CITY LIJ.VlIfrS, AND GRANTING TO j\LL THE INHABITAWrS AND OWNERS OF SAID PHOPERTY ALL OF THE EIGHTS AND PRIVILEGES OF OTHER CITIZENS AND BINDING SAID INHABITANTS BY ALL rrHE ACTS, ORDINANCES, RESOLUTIONS AND REGULArrIONS OF SAID CI'l'Y. WHEREAS, the City of La Porte has heretofore adopted a Home Hule Charter authoriz it to annex territory and extend the corporate limits of said city by action of the City Commission; and, WHEHEAS, the hereinafter described land is adjacent to the present city limits of the City of La Porte and members of the City Commission of the City of' La Porte have concluded that said al'ea should be annexed and made a part of the City of' La Porte, 'Texas; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COJVIMISSION OF THS CITY OF LA PORTE, TEXAS: SECTION 1. That the following described territory be and the same is hereby annexed to the City of La Porte, Texas, and the boundary limits of the City of La Porte be, and the same are hereby extended to include the following descI'ibed territory wi thin the city limits of the City of La Porte, and the same shall hereafter be included within the territorial limits of said city, a,ld the inbabi- tants thereof shall hereafter be entitled to all rights and privileges of other citizens of the City of La Porte, and they shall be bound by the acts, ordinances, resolutions and l'egulations of said city. That the territory to be so annexed is more particularly described as follows, to-wit: BEGINNING at the intersection of the East right-of-way line of State Highway 13Lj. (also known as Battleground Hoad) with the North line of the 'l'exas Alkyls, Inc., 12. '7'79 acre trac t as described in that certain deed from Phillips Petroleum Company to 'Texas Alkyls, Inc., dated May 22, 1959, and re- corded in Volume 3712, Page 95 of the Deed Records of Harris County, Texas; 'l. . . . THENCE, North 880 05' East with the North line of the said Texas Alkyls, Inc., 12.779 acre tract to the Northeast cor- ner of the said Texas Alkyls, Inc., 12. '779 acre tract; THENCE, South 200 55' West a distance of 861.7 feet to the Southeas t corner of' the said Texas .Alk:yls, Inc., 12.7'79 acre tI'act; rrHENCE, continuing Sou.th 200 55' West to a point 100 feet North of the South line of the Arthur McCormick Survey # A_L~6 ; InmNCE, in an EasteI'ly direction parallel to and 100 feet North of the South line of the Arthur McCormick Survey #A-46 to a point of intersection with a West line of that certain 29 acre tract of land conveyed by R. E. Smith to The Carwin Company by deed dated February 3, 1960, recorded in Volume 3930, Page 5 of the Deed Hecords of Harris County, Texas; . Waldene Hine to Houston Lighting & PoweI' Company as l"ecorded in Volume 2643, Page 11.~5 of' the Deed Records of Harris County, Texas; . THENCE, South 010 11' 3411 East along the WeE?t line of the said Houston Lighting & Power Company 14.156 acre tract and the East line of the said The Carwin Company 29 acre tract a dis- tance of 913.03 feet to a point in the South line of the Arthur r1icCormick Survey #A-46 being also the Southwes t cor- ner of the said Houston Lighting & Power Company 14.156 acre tract and being the Southeast corner of the said The Carwin Company 29 acre tract; THENCE, in a westerly direction along the South line of the Arthur McCormick Survey #A-1.~6 to the Southwest cor>ner of the said Arthur IVIcCormic:< SUI'vey #A-46; THENCE, in a noriherly direc tion along the Wes t line of the Arthur McCormick Survey #A-46 to the Southeast corner of that certain 3 acre tract conveyed to Texas Alley-Is, Inc., by Jeff E. Fleming, Trustee, by that certain deed recorded in Volume 3705, Page 326 of the Deed Hecords of Harris County, Texas; . THENCE, South 890 251 West a distance of 305.58 feet to the East right-of-way line of State Highway 134; THENCE, in a northerly direction along the East right-of-way line of State Highway 134 to the PLACE OF BEGINNING. . . . . .. e . That should any portion of the territory sought to be annexed herein not be subject to annexation by the City of La Porte) then it is the intention oJ:' the City Commission of the City of La Porte to annex only such portion of said area as may be legally subject to annex.ation by the City of La Porte) and the fact that a portion of said area may not legally be subject to annexation by said city shall not affect the validity of the annexation of the remaining portions of said territory) it being the intention of the City Commission to annex all or such portions of the above described area as it may legally annex.
