AN ORDINANCE PROVIDING FOR THE GIVING OF NOTICE
TO BIDDERS AND NOTICE OF INTENTION TO ISSUE TIME
WARRANTS OF CITY OF LA PORTE; AND CONTAINING
OTHER PROVISIONS RELATING TO THE SUBJECT
WHEREAS, it is necessary that certain extensions and im-
provements be made to sanitary sewer system of the City of La Porte,
Texas j and
WHEREAS, said City does not have on hand sufficient moneys
to pay for such extensions and improvements; and
WHEREAS, it will be necessary that time warrants of said
-'Ci ty be issued so that such purpose may be accomplished; and
~mEREAS, the City Commission of said City wishes to pro-
ceed with the giving of notice to bidders and notice of intention
to issue said time warrantsj Therefore
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LA
PORTE:
Section 1: That the Mayor and the City Secretary of the
City of La Porte, Texas, are hereby authorized and directed to cause
to be published for the time and in the manner required by law,

NOTICE TO BIDDERS AND NOTICE OF
INTENTION TO ISSUE TIME WAImANTS
TO BIDDERS AND TO THE QUALIFIED VOTERS OF THE CITY OF LA PORTE, TEXAS, WHOSE NAMES
APPEAR ON THE LAST APPROVED TAX ROLLS OF PROPERTY TAXPAYERS OF SAID CITY, AND TO
ALL OTHER INTERESTED PERSONS:
NOTICE IS HEREBY GIVEN that sealed proposals, addressed to the Mayor and
Commissioners of the City of La Porte, Texas, will be received at the regular meet-
ing place of the City Commission in the City Hall of said City, until 7:00 o'clock
P.M. on the 15th day of December, 1961, for furniShing all materials, tools, ma-
chinery, apparatus, appliances, and facilities for the construction of certain ex-
tensions and improvements to the sanitary sewer system of said City, at which time
said bids will be publicly opened and read aloud.
A cashier's check or certified check, payable without recourse to the
City Commission of the City of La Porte, Texas, or an acceptable bidder's bond, in
an amount in either event of not less than five per cent (5%) of the bid submitted
by each bidder must accompany the bid.
Attention is directed that this is a public works project, and that
there must be paid on this project not less than the general prevailing rates of
wages, which minimum wage scale has been established by the City Commission and
which is of record in the office of the City Clerk. Said minimum wage scale is
applicable to all contracts awarded by the City.
Info~ation in detail, bidding documents, and plans and specifications
are available and may be examined without charge at the office of the City Clerk
in the City Hall and at the office of the City's Engineer: wyatt C. Hedrick,
Consulting Engineer, 5201 Fannin Street, Houston, Texas, and plans and specifica-
tions may be procured from said Engineer upon making of the deposit required by
him. The successful bidder receiving the award of the contract shall furnish (a)
a perfo~ance bond in the amount of 100% of the total contract price conditioned
upon the faithful perfo~ance of the work in accordance with the plans, specifi-
cations, and contract documents, and (b) a payment bond in the amount of 100% of
the total contract price for the protection of all claimants supplying labor and
material in the prosecution of the work provided for in said contract for the use
of each such claimant, as provided by Article 5160, Vernon's Texas Civil Statutes,
as amended in 1959. Each such bond shall be executed by a corporate surety or
corporate sureties duly authorized to do business in the State of Texas.
In case of ambiguity or lack of clearness in stating prices in the pro-
posal, the City reserves the right to accept the prices written in words, or to
reject the proposal. The City expressly reserves the right to waive fo~alities
and technicalities, and to reject any and all bids. No bids may be withdrawn
after the scheduled closing time and for 30 days thereafter. Any bid received
after the scheduled closing time will be disqualified, and will be returned un-
opened to the bidder.
It is the intention of the City Commission of said City to authorize and
issue time warrants of said City in the maximum amount of $50,000, bearing inter-
est at a rate or rates not exceeding 6% per annum, and maturing serially over a
period not to exceed ten years from their date, with maximum maturity date of
December 31, 1972, for the purpose of evidencing the indebtedness of said City for
all or part of the cost of making the extensions and improvements mentioned above.

Section 2: That the notice set forth in Section 1 of this
rdinance shall be published in the La Porte Liberal once a week for
two consecutive weeks prior to December 15, 1961, the date of the
first publication to be at least fourteen days prior to December 15,
1961. It is hereby found and declared that the La Porte Liberal is
a newspaper published in, and of general circulation within, said
City of La Porte, Texas.
Section 3: That this ordinance shall be effective upon
and after its adoption.
