'. . .....--...........,. . . . ----- ORDINANCE NO. 638 AX ORDINANCE PRESCRIBIlm RATES TO BE CHARGED FOR DIST!ITBUTION AND SALE OF NATURAL GAS \'JITHIN THE CITY, AND REPEALING ALL OTHER ORDDrANCES OR PARTS OF ORDINANCES IN COIiJFLICT HERE'iJITH. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LA PORTE, HARRIS COUNTY, TEXAS : Section 1. '!he follOldng rates and charges are hereby fixed as the ma.x:imum monthly net rates and charges, and are hereby authorized for distribution and sale of natural gas in the city named in this ordinance to be applied and used by HotliSton Natural Gas Corporation (the "Company"), its successors or assigns. Residential and Cormnercial Use '. First Next Next Next Next All over 400 Cubic Feet or less 2,600 Cubic Feet @ 7,000 Cubic Feet @ 40,000 Cubic Feet @ 50,000 Cubic Feet @ 100,000 Cubic Feet @ $2.00 10.2~ per Ccf 8. 7~ per Ccf 7.6, pei:' Ccf 7.l~ per Ccf 6.l~ per Ccf ~finimum Monthly Bill $2.00 The above base. rates are net rates and will apply to all bills paid ldthin ten (10) days of date of rendition. If bills are not paid within ten (10) days, gross rates shall apply, which rates shall be the above net rates plus one cent (l~) per Ccf of gas consumed per month. Ccf as used herein means one hundred (100) cubic feet of natural gas. The Railroad Commission of Texas, after notice and hearing of its Docket No. 246, b.Y its order dated December 1, 1958, established and fixed the rate to be paid at the City Gate for gas purchased for re- sale to the consumers affected by this ordinance. If such City Gate ~te is hereafter decreased or increased by subsequent order of the Railroad Commission (and from time to time as such orders may issue) the rate herein fixed for residential and cormnercial use shall fortht.n th be likewise adjusted by changing the price per Ccf of each step of the above schedule in an amount equivalent to the change in the Gate Rate, minus or plus, as may be appropriate. '!he rates in effect hereunder shall also be adjusted tfy the Compaqy (1) so as to accomplish a decrease or increase of such rates equiv- alent to the change in the amount of taxes or other government imposition payable solely by reason of any change in rates pursuant to the provisions ",---- . .,.- ../",~-., . ,...---.... . . . Ordinance No. 638 Page 2 of the preceding paragraph; and (2) upon the imposition of any neti or increased rate of tax or similar charge imposed by any governmental agency on the Company and determined or measured by the volume, proceeds, or receipts of gas delivered to such customers, to the extent necessary to pass the effect thereof on to such consumers. Such increase or decrease in rates, as appropriate, shall be passed along b,y the Compaqy to its consumers b,y an adjustment in the above net monthly rates after the Company has filed with the City Clerk a sworn statement setting forth the changes in the gate rate and/or taxes and the adjusted residential and commercial rates which result therefrom. The rates hereinabove set out shall be effective and applicable to distribution and sale of natural gas billed after the effective date of this ordinance, unless and until such rates shall be changed hereafter in accordance with law. Section 2. The Company shall establish and post in its office rate schedules providing monthly billing rates complying If.Lth Section 1, of this ordinance and may, in addition, establish special contract rate schedules for large volume commercial or industrial use providing other rates and charges. Section 3. All ordinances, resolutions, franchises, or parts thereof in conflict herewith are hereby repealed insofar but only insofar as such conflict exists. Section 4.
