'. , ORDINANCE NO. tIJ 7 AN ORDINANCE FIXING THE BOUNDARY LTh1ITS OF THE CITY OF LA PORTE, TEXAS, AND ENLARGING AND EXTENDING THE BOUNDARY LIMITS OF SAID CITY AND ANNEXING ADDITIONAL TERRITORY LYING ADJACENT TO SAID CITY WITHOUT THE CONSENT OF THE TERRITORY AND THE INHABITANTS ANNEXED; PROVIDING FOR PUBLICATION OF THE ORDINANCE AFTER ITS INITIAL INTRODUCTION AND PASSAGE BY THE CITY COMMISSION OF SAID CITY; RESERVING AND PRESERVING ALL RIGHTS, POWERS AND DUTIES UNDER ALL ORDINANCES HERETO- FORE ADOPTED BY THE CITY COMlVlISSION OF THE CITY OF LA PORTE; AND PROVIDING A SAVINGS CLAUSE. WHEREAS, under and by virtue of Section 2, Article 1175, of the Revised Civil Statutes of the State of Texas, of 1925, as amended, and Section 10 of the Home Rule Charter of the City of La Porte, the said City ....., is authorized and empowered to fix the boundary limits of said City, and to provide for the extension of said boundary limits and the annexation of additional territory lying adjacent to said City, with or without the consent of the territory and the inhabitants annexed; and WHEREAS, the City Commission of the City of La Porte, after due and careful consideration, has determined that it is necessary to more carefully define the outer limits of the City of La Porte; and NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMIS- SION OF THE CITY OF LA PORTE, TEXAS, THAT: Section 1. The boundary limits of the City of La Porte, Texas, be and hereby are established, enlarged and extended, as hereinafter set out, so as to include within the boundary limits of said City all that terri'" tory lying adjacent to said City within the following described limits, without the consent of the territory and the inhabitants annexed, to"'wit: BEGINNING at a point in the East Boundary Line of the Original Corporate Boundaries of the City of La Porte, said point being located at the intersection of the East Right-of- Way line of Donaldson Street with the South Right-of- Way line of East Main Street; THENCE, in a Southeasterly direction following the present East boundary line of the City of La Porte along the East Right-of"'Way line of Donaldson Street and Southeasterly along a projection thereof to a point of intersection with the waters of Galveston Bay a dis. tance of 3, 250 feet, more or less; . . ...,.'--- --. . ~--... . . . THENCE, in a Southwesterly direction following the meanders of the shoreline of Galveston Bay and the present City Limit Line of the City of La Porte to the North bank of Little Cedar Bayou; THENCE, in a Southwesterly direction across the mouth of Little Cedar Bayou to the point of inter- section of the South bank of Little Cedar Bayou with the shoreline of Galveston Bay; THENCE, in Southwesterly, Southerly, Southeasterly and then Southwesterly directions along the shoreline of Galveston Bay to its intersection with the South line of the Wm. P. Harris Survey, being also the North boundary line of the Ritson Morris Survey and also being the most Easterly Southeast corner of the City of La Porte; THENCE, in a Westerly direction along the survey line being the North line of the Ritson Morris Survey and the South line of the Wm. P. Harris Survey, said survey line being also the South Boundary Line of the City of La Porte a distance of 3, 700 feet, more or less, to the intersection of said survey line with the West Right-of-Way line of Toddville Road; THENCE, in a Southerly direction along the West Right-of-Way line of Toddville Road a distance of 4,300 feet, more or less, to the intersection of the West Right-of-Way line of Toddville Road with the North Right-of-Way line of Red Bluff Road; THENCE, in a Westerly direction along the North Right-of- Way line of Red Bluff Road along its curves and meanderings to its point of intersection with the East Right-of-Way line of Texas State Highway # 146; THENCE, in a Northeasterly direction along the East Right-of-Way line of Texas State Highway # 146 to its intersection with an imaginary line perpendicular to the centerline of Texas State Highway # 146 that would intersect the North Right-of-Way line of Red Bluff Road at its point of intersection with the West Right- of-Way line of Texas State Highway # 146; THENCE, crossing said Texas State Highway # 146 along an imaginary line perpendicular to the center- line of Texas State Highway # 146 drawn from a point where it intersects the point of intersection of the North Right-of-Way line of Red Bluff Road with the West boundary line of Texas State Highway # 146 to said point of intersection of the North Right-of-Way line of Red Bluff Road with the West Right-of-Way line of Texas State Highway # 146; THENCE, in a Northwesterly direction along the North- east Right-of-Way line of said Red Bluff Road and follow- ing its various curves and meanderings for a total dis - . tance of 37, 840 feet, more or less, to its intersection ~~- --- . , _/ . .' - ---..........- . .----.-, . . . Jones Survey, Abstract No. 482; THENCE, in a Northerly direction along the West survey line of the W. M. Jones Survey, Abstract No. 482, a distance of 6, 750 feet, more or less, to the South Right-of-Way line of Spencer Highway; THENCE, in an Easterly direction along the South Right-of-Way line of Spencer Highway a distance of 9,600 feet, more or less, to a point of intersection with the East Right-of-Way line of Underwood Road; THENCE, in a Northerly direction across Spencer Highway to a point of intersection of the North Right- of- Way line of Spencer Highway with the East Right- of- Way line of Underwood Road; . THENCE, in a Northerly direction along the East Right-of- Way line of Underwood Road, following its various curves and meanderings a distance of 14,100 feet, more or less, to the point of inter- section of a Northerly projection of the East Right- of- Way line of said Underwood Road with the North Right-of-Way line of Texas State Highway No. 225; THENCE, in a Northwesterly direction along the North Right-of-Way line of the said Texas State Highway No. 22~, to the point where the same inter- sects with the East Right-of- Way line of Texas State Highway No. 134 (also known as .Battleground Road); THENCE, in a Northerly direction along the East Right-of- Way line of the said Texas State Highway No. 134, to the point where the same intersects with an imaginary line 2, 500 feet distant from, parallel to, and South of the centerline of the Houston Ship Channel, said imaginary line also being the City Limit Line of the City of Houston; THEN CE, in a Northeasterly direction along the said imaginary line 2, 500 feet distant from, parallel to, and South of the center line of the s~id Houston Ship Channel, to the point where the same intersects with the Southerly boundary line of the San Jacinto Battleground State Park of Texas; THENCE, in a Southeasterly direction along the said Southerly boundary line of the said State Park to the Southernmost point of said boundary line; THENCE, in a Northeasterly direction along the Easterly boundary line of said State Park, extended in the same direction, to the point where the same inter- sects with an imaginary line 2,500 feet distant from, parallel to, and Southwest of the centerline of the Houston Shi p Channel; ..- --- . . . . ORDINANCE NO. tb /f l' Page # 4 THENCE, in a Southeasterly and Southerly direc- tion along an imaginary line 2,500 feet distant from, parallel to, and Southwest of the center line of the Houston Ship Channel, to the point where said imaginary line intersects with the shoreline of Galveston Bay; said point being also in the Harris County Line; . THENCE, in a Southwesterly direction following the meanders of the shoreline of Galveston Bay to the point of intersection of the shoreline of Galveston Bay with the East Right-of-Way of Donaldson Street projected; THENCE, in a Northwesterly direction along the East Right-of- Way line of Donaldson Street projected, and the East Right-of-Way line of Donaldson Street to the point of intersection with the South Right-of-Way line of East Main Street, THE POINT OF BEGINNING. Section 2. The territory included within the above described boundary limits be hereby annexed to, and made a part of, the City of La Porte, Texas, and the inhabitants thereof shall be entitled to all rights and privileges of other citizens of said City and shall be bound by the acts, ordinances, resolutions and regulations of said City. Section 3. If any portion or portions of the territory included in the above described limits is validly included within any other incorpor- . ated City, Town or Village, then such portion or portions of such above described territory is hereby excluded and the remaining territory is here- . by annexed to the City of La Porte, Texas, and the boundary limits of said City are hereby amended to conform to the boundary limits of such other City, Town or Village, and such other Cities, Towns or Villages along the area of conflict. Section 4. If any portion or portions of the above described territory legally may become included within the limits of any other incor- porated City, Town or Village, by reason of a valid annexation ordinance heretofore introduced before the Council, Commission or other governing body of such City, Town or Village, then such portion or portions of the /--., . . Page # 5 ~~~ . above described territory is hereby excluded and the remaining territory '--- --- "-.. . . .----.... . is hereby annexed to the City of La Porte and the boundary limits of said City of La Porte are hereby amended to conform to the boundary limits of such other City, Town or Village or such other Cities, Towns or Villages along the area of conflict. Section 5. If any legal impediment exists, preventing the valid annexation of any portion of the above described territory to the City of La Porte, then such portion of the above described territory is hereby excluded and the remaining territory is hereby annexed to the City of La Porte and the boundary limits of said City of La Porte are hereby amended to conform to the territory so annexed. Section 6. Upon the introduction of this ordinance in the City Commission of the City of La Porte, Texas, it shall be published in the official newspaper as adopted by the said City Commission in the City of La Porte one time and it shall not thereafter be finally acted upon until at least thirty (30) days have elapsed after the first notification thereof. Any citizen of the City of La Porte, or of the territory to be annexed, shall have the right to contest such annexation by filing with the City Commission of the City of La Porte a written petition setting out the reason for said contest, and after such citizen or citizens shall have been given an oppor- tunity to be heard, this ordinance, in its original or amended form, as the said City Commission in its judgment may determine, may be finally passed, and the territory so annexed shall be a part of the City of La Porte, Texas, and the inhabitants thereof shall be bound by the acts, ordinances, resolutions and regulations of said City. Section 7. There is hereby reserved and preserved unto the City of La Porte all rights, powers, duties and effect of any and all prior ordinances adopted by the City Commission of the City of La Porte and in no way releases nor relinquishes any part or portion of any territory .~ . Page # 6 ~~If '" . heretofore annexed and the effect of this ordinance is not intended to make ~..-- final the annexation of any territory not heretofore finally annexed to the City of La Porte unless and until this ordinance in its present form or in amended form is finally passed and approved by the City Commission of the City of La Porte. Section 8. If any portion of this ordinance be invalid, then so much thereof as shall not be invalid shall be and remain in full force and effect. -- -- Section 9. This ordinance shall be in force and effect from . and after it has been published and finally passed by the City.Commission of the City of La Porte, in accordance with the provisions of Section 6 of this ordinance.
