ESMT- Browning & Golden_City Of La Porte-a %o THE STATE OF TEXAS § u�N FEE § COUNTY OF HARRIS § PP-2016-184262 05/03/2016 RP2 $0.00 DRAINAGE EASEMENT KNOW ALL MEN BY THESE PRESENTS: THAT, Harris County Flood Control District, a political subdivision of the State of Texas, (hereinafter "Grantor"), for and in consideration of Grantor's intention of donating to the City of La Porte, a municipal corporation of Harris County, (hereinafter "Grantee"), as a political subdivision of the State of Texas, an easement to be used by the Grantee for the respective public purpose of drainage and flood control for the people of Harris County, being a public purpose that benefits and serves the public interest of Grantor, such donation being made pursuant to Local Government Code § 272.001(1.), have GRANTED and CONVEYED, and by these presents do GRANT and CONVEY unto the Grantee an easement to be used for Drainage and flood control purposes over, upon, in, under, across, along and through the following described land in the County of Harris, State of Texas, more particularly described as follows, to wit: 0.0413 acre tract of land in Outlot No. 377 of LaPorte Outlots, Harris County, Texas, being further described in Exhibit "A" attached hereto and made a part hereof. TO HAVE AND TO HOLD the said easement, unto the Grantee to be used for said purpose; and GRANTOR does hereby bind itself, its successors and assigns to warrant and forever defend all and singular the said easement unto the said Grantee, its successors and assigns, against every person whomsoever lawfully claiming or to claim the same, or any part thereof, by, through or under Grantor, but not otherwise. This conveyance is subject to all easements, restrictions and reservations of record in the County Clerk's Official Public Records of Real Property of Harris HOLD FOR IRIS COUNTY ROW County, which affect the easement herein conveyed and which are other otherwise enforceable against a political subdivision of the State of Texas. The easement herein conveyed will be vested in Grantee for so long and only for so long as it is used for drainage and flood control purposes. If the property herein conveyed ceases to be used, the estate hereby conveyed to Grantee will revert to Grantor without any further action on the part of Grantor.
