WATER AND WATER SERVICE BY THE CITY OF LA PORTE, TEXAS,
TO CONSUMERS INSIDE AND OUTSIDE THE CORPORATE LIMITS OF THE

CITY OF LA PORTE, TEXAS; PRESCRIBING THE TIME FOR PA YMENT
THEREFOR; PROVIDING FOR TEN PERCENT (lO%) DISCOUNT FOR PROMPT
PA YMENT OF BILL, AND PRESCRIBING OTHER MATTERS RELATED THERETO,
AND PROVIDING A PENALTY OF NOT LESS THAN $lO. 00 NOR MORE THAN
$200.00 FOR VIOLA nON OF THE TERMS AND PROVISIONS OF THIS ORDINANCE.

BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LA PORTE,
TEXAS, THAT:
Section 1. Rates. The following rates shall be charged each month for
water and water service furnished by the City of La Porte:
Each water service connection within the City of La Porte shall bear
a charge of $2.00 for each month or any part thereof.
Each water service connection outside the City. of La Porte shall bear
a charge of $2.50 for each month or any part thereof. '
No additional charge shall be made for water consumed if not more

than 2, 000 gallons.
In addition:
A charge at the rate of $0.75 per one thousand gallons for water metered
to each water service connection during any month shall be made for 2,000
through 5,000 gallons.
, A charge at the rate of $0.50 per one thousand gallons for water
metered to each water service connection during any month shall be made
for 5, 000 through lO, 000 gallons.
A charge at the rate of $0. 40 per one thousand gallons for water metered

to each water service connection during any month shall be made for 10,000
through 50, 000 gallons.

A charge at the rate of $0.30 per one thousand gallons for water
metered to each water service connection during any month shall be made
for all over 50, 000 gallons.
Section 2. Water Meter Inoperative. If a water meter fails to
operate properly, the consumer may be charged at the average daily
consumption as shown by the meter when in order. The consumer shall
pay for all water metered, whether used or not.
Section 3. Discount Allowed. A discount of ten per-cent (10%) shall
_ be allowed on all monthly water bills paid on or before the 10th day of the
month succeeding that for which the bill is rendered. All bills paid after
the 10th day of the calendar month succeeding that for which such bill is
rendered shall not be subject to such discount.
Section 4. Multiple Units
A. Definition of "Multiple Units." For the purpose of this Ordinance,
"Multiple Units" shall be defined as apartments, apartment projects, trailer
parks, business establishments, and other such installations (as contrasted
to motels, hotels and other such establishments), having three (3) or more
_ units.
B. Single Meter. Owners of multiple units may be permitted a single
meter to supply water to all units. In such cases the owner shall be required
to pay the additional cost necessary for a larger meter, if one is required.
The size of the meter required shall be determined by the City Engineer.
C. Rates for Multiple Units. In cases of multiple units on a single
meter, the rates shown in Section 1 shall apply. The minimum charge of
$2.00 shall be charged to each unit occupied during the preceeding month.

D. Occupancy. The owner, or owners, of multiple units on a single
meter may certify to the City Water Department on or before the second (2nd)
day of each calendar month the maximum number of units occupied on any
one day during the preceeding month, upon which the City shall place the
minimum charge of $2.00 on each unit so occupied. Such certificate must
be in writing and shall be sworn to before a Notary Public. If the owner
shall fail to make this certification by the time required, the City Water
Department shall consider the minimum as applicable to all units, which
shall not be subject to adjustment.

Section 5. General Provisions
A. Application for Water Services. It shall be unlawful for any
person to make any connection to the mains or pipes of the water works
system of the City without first making proper application to the City, stating
fully the several and various uses for which water is desired, giving the
name of the owner of the property, the number of the lots and block, the name
of the street and the house number. Upon the payment of the tapping fee, and
the deposit, if required, the city shall make the necessary connections and
furnish a curb stop box and curb cock, provided water services are otherwise
--
available, and provided further that the size of meter and size of the connection
with City mains and laterals necessary to furnish adequate water service
shall be determined by the City Engineer.
B. Water Tapping Charges. The tapping charges for connecting
with the City water mains and laterals shall be as follows:
5/8" Connection - - - - - - - - - - - - $65.00
3/4'Connection - - - - - - - - - - - - 75.00
1" Connection - - - - - - - - - - - - 96.00
1-1/4" Connection - - - - - - - - - - - - 60.00 plus meter cost
2" or larger connection - - Actual cost of installation,
plus meter cost.
These charges shall apply where the connection is made in dirt, shell
~ or asphalt. There shall be an additional charge of twenty-five dollars ($25.00)
where the excavation is made in concrete paving.

C. Meter Deposit. A deposit, determined as follows, shall be
required of each water user or customer, unless waived by the City Clerk
for good and justifiable reasons:
Businesses, Commercial, Homeowners - - - - $8.00
Renters - - - - - - - - - - - - - - - - - - - - - 10. 00
Users outside City Limits - - - - - - - - - - - 10. 00
Section 6. Unauthorized Interference with Water Meter. All water
meters, whether privately owned or belonging to the water works system,
shall be set by employees of the City only. It shall be unlawful for any person,
other than designated employees of the City, to remove any water meter
. that has been placed, or in any manner to change, interfere with, or tamper
with any water meter.
Section 7. Obtaining Water by]v1e!hQgs..NotJ?r9=v,!Q~s!.B~!e~!).. It
shall be unlawful for any person to resort to any device or arrangement for
the purpose of obtaining city owned water for himself or others by methods
not provided herein.
Section 8. Administrative Regulation~
The City Commission shall make, or

cause to be made, necessary administrative rules and regulations to insure
proper collection of water accounts due and the maintaining of proper records
and reporting; provided that such rules and regulations do not conflict with
other provisions of this Ordinance.
B. Water Accounts due by lOth of the MOl}t~. Water Accounts shall
become due and payable on or before the tenth (10th) day of the calendar month
following the date of billing, and if not paid by the close of business on the
lOth day ( or by the close of business on the following Monday if the 10th should
fall on Saturday or Sunday), shall be classed as "Past Due and Delinquent. "
C. Notification. The City Clerk shall notify the responsible person,
firm or corporation by mail that the account is past due prior to the 10th day
of the calendar month after the account is past due.

D. Account to be Cleared. The delinquent customer shall be required
to clear the balance of his account, including current charges, on or before
the next following lOth ( 60 days from the date the account becomes delinquent) .
E. Extra Charges. Failure to clear the account within the time
specified ( 60 days from the date of delinquency) and in the absence of other
satisfactory arrangements, shall cause a service charge of two dollars ($2. 00)
to be added to the balance of the account for expenses incurred in handling.
In such cases water services shall be discontinued and shall not be restored
until the balance of the account, plus service charge, is paid. There shall be
no charge for restoration of water services unless the water meter is removed.
In case it becomes necessary to remove the water meter, as determined by
the City Water Department, an additional charge of three dollars ($3.00)
shall be made for re-installing the meter.
F. Deposit Applied to Deling~uent ~ccount. The meter deposit shall
be applied to the delinquent account, and when so applied, a new deposit shall
be required before water services are restored.
G. Other Arrangements. Any arrangement not herein provided for
paying the water account must have the unanimous approval of the City Commission
and be entered in the minutes of the meeting at which such arrangement is
approved.
Section 9. Violations a Misdemeanor. Any act declared unlawful
in the specific terms of this ordinance is hereby declared a misdemeanor
and each day that such violation is allowed to exist shall be deemed a separate
offense. The offender, upon a finding of guilty, shall be punished by a fine
of not less than $lO.OO nor more than $200.00 for each day charged.
Section lO. Conflicting Ordj.lli!.!l~ All Ordinances and/or parts
of Ordinances in conflict herewith are repealed to the extent of such conflict

Section 11. Validity. In the event that any section, clause, sentence,
or paragraph, or part of this Ordinance shall, for any reason be adjudged
by any court of competent jurisdiction to be invalid, such invalidity shall
not affect, impair or invalidate the remainder of this Ordinance.
This Ordinance shall become effective and in full force and effect
, on the 11th day after the first of two publications of the caption hereof in the
official newspaper of the City of La Porte.
