AN ORDINANCE DEFINING GARBAGE, TRASH, AND REGULATING THE KINDS AND SIZE OF RECEPTACLES IN WHICH TO PLACE SAME; THE MANNER OF ITS PREPARATION AND WHERE IT MUST BE PLACED TO BE COLLECTED; PROVIDING REGULATIONS FOR COLLECTING SAME; PROHIBITING THE PLACING OF GARBAGE OR ANY ARTICLE OR MATERIAL IN STREETS AND ALLEYS; PROVIDING FOR SERVICE CHARGES; PRO- HIBITING THE MEDDLING, SCATTERING OF CONTENTS, PILFERING OR JUNKING; PROVIDING REGULATIONS AND CHARGES FOR USE OF CITY GARBAGE DUMP; AND PROVIDING A PENALTY OF NOT MORE THAN TWO HUNDRED AND NOIIOO DOLLARS ($200.00) FOR VIOLATION OF THE TERMS AND PROVISIONS OF THIS ORDINANCE. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LA PORTE, TEXAS: ., Section 1. Definitions. This Ordinance shall be known as the "Gar- bage and Trash 'Ordinance." The.following words andlor terms, as used in this Ordinance, shall carry the meaning and intent as shown. "Premises" as used in this Ordinance shall mean business houses, boarding houses, offices, theaters, hotels, restaurants, cafes, eating houses, tourist C()urts, apartments, rooming houses, schools, private residences, vacant lots and all other places within the city where garbage, trash or rubbish accumulates in ordinary quantities. "Dry Kitchen refuse" means the solids after the liquid or - slop has been drained off. "Kitchen garbage" means dry kitchen refuse, meat, vegetable and fruit refuse, small dead animals and dead fowl from any premises. "Rubbish" means tin can, bottles, glass, scraps of iron, tin, wire or any other metals from any premises within the city limits. "Trash" means papers of all kinds, rags, old clothing, paper containers, old rubber, pieces of wood, boxes, barrels, crates, feathers, weeds, grass and tree limbs, from any premises within the city limits. Section 2. Container Specifications. It shall be the duty of every person owning, managing, operating, leasing or renting any premises or .~ any place where kitchen garbage accumulates to provide a portable garbage Page 2 Ordinance No.: ; 6'6 '5 ; . . "'. can constructed of galvanized iron, tin, or other suitable material, with two (2) handles and a tight fitting cover and of a capacity of not less than five (5) gallons nor more than thirty-five (35) gallons. The daily accumu- lation of kitchen garbage and dry kitchen refuse from such premises shall be placed in such garbage can. It shall be the duty of every person owning, managing, operating, leasing or renting any premises to place all trash and rubbish from such premises in boxes, sacks or barrels or other receptacles of reasonable size, the gross weight of which shall not exceed one-hundred (100) pounds. .'. Section 3. Placement for Collection. Garbage cans and boxes, sacks or barrels of trash and rubbish and tree . limbs (which shall be cut into lengths not exceeding 4 feet), shall be placed inside the property line at the edge of the alley or 'where there is no alley, the same shall be placed so as to be readily accessible to the City garbage vehicles. The City Sanitation Department shall not make collection of garbage or trash where it is not prepared for collection and placed as designated by this Ordinance. Section 4. Maintenance~ Garbage cans shall be kept in sanitary condition and closed tightly. Whennecessary, lime shall be used at places where receptacles for garbage, trash and rubbish are located to be collected . by the City Sanitation Department to keep down odor and flies. The contents of all receptacles shall be so protected that the wind cannot scatter the same over the streets, alleys and premises of the city. Section 5. Meddling and Pilfering. The meddling with garbage cans or trash or rubbish receptacles or in any way pilfering from the same or scattering the contents thereof in any alley or street within the city limits is strictly prohibited. Section 6. Frequency of collection by City. In the business district and from hotels, restaurants, cafes, boarding houses, tourist courts, and . . . . .' . e Page 3 Ordinance No. 6 6 5 motels, collection by the city of garbage, trash and rubbish shall be made at least three (3) times weekly, and more often if neces~ary to assure sanitary conditions. In the residential districts, kitchen garbage shall be prepared for collection to be made two (2) times per week, or as often as may be necessary to comply with sanitary requirements of the City. Section 7. . :Unauthorized Use of City Dump, Ground Prohibited. It shall be unlawful for any person, firm, company, partnership, corporation or association, to deposit upon the City of La Porte Dump Grounds any trash, waste, garbage, or refuse of any nature whatsoever 'without having first applied for and obtained a Permit from the office of the City Clerk, or from the City Dump Grounds Attendant. .I Section 8. Permit Fees for Use of Dump Groun ds. The following fees shall be assessed and paid to obtain a Permit to deposit trash, waste, garbage, or refuse on the City's Dump Grounds: $5. 00 per dump truck or eq ui valent 1. 00 per pick-up truck load or equivalent .50 per barrel or equivalent .25 per garbage can or ~uivalent Section 9. . Exception to Permit Fees. It shall not be necessary for a householder of the City of La Porte to apply for a permit to dispose of trash, waste, garbage, or refuse of any nature at the City's Dump Grounds, so long as said householder is personally disposing of trash, waste, garbage, or refuse, collected from the premises that constitutes his residence, if said residence is located within the City limits of the City of La Porte, Texas. Section 10. Monthly Service Charge for Garbage Collection. There shall be charged, assessed and collected for garbage, trash and rubbish collection by the city a monthly fee determined as follows: Single family residence, or each family dwelling unit; to include not more than two (2) dwelling units under same owner- ship or management . . . . . . . . . . . . Page 4 Ordinance No. 6 6 5' Apartment Houses and Trailer Courts, with not less than three (3) uriits occupied at any time during the month. . . . . . . . . . . $ .60 per unit Said charge shall be effective July 1, 1962. The owner or his designated representative shall on the first day of each calendar month certify in writing to the City Clerk of the City of La Porte the number of occupied units on that day. But in the event such certificate is not in the hands of the City Clerk by the end of the 4th day of each calendar month, the charge shall be based on the maximum number of units that could be occupied and in addition the failure to report shall be considered a violation of this Ordinance and f?uch person delegated with the authority to make such report shall be subject to the penalty provisions established in para- graph 12 of this Ordinance. Offices, commercial firms or businesses, the monthly rate charged shall be determined by an actual time study, to determine the actual average time per month required to collect the garbage, trash or refuse. Rate charged shall be based on $9. 00 per hour. A Time Study shall be made each six (6) months, and any adjustment will be made as a result of such time study. Section 11. Method of making 'Charge and Paying Bill. The charge for garbage and trash cpllection shall be entered on the same bill along with charges for water and sewer services., but as a separate item therefrom, e and shall be due and payable with the water bill; with the amount charged being included in the balance due as shown on water bill. . Section 12. Penalties. Any person violating the terms and provisions of this Ordinance shall be guilty of a misdemeanor and may be punished by a fine of not more than $200.00. Section 13. All ordinances andlor parts of ordinances in conflict herewith are repealed to the extent of such conflict only. ~ t I . .' ". -'" '-..-. . .
