" - ~, '.' ,~ ... e e ." - ; . . --, " . .::- "'- ORDINANCE NO. 676 AN ORDINANCE ALTERING THE PRIMA FACIE SPEED LIMITS ESTABLISHED FOR VEHICLES UNDER THE PROVlSIONS OF SECTION 8 OF ARTICLE 827s, VERNON'S TEXA,S PENAL CODE, UPON TH;E "BASIS OF AN ENGINEERING AND TRAFFIC INVESTIGATION, UPON CERTAIN STREETS ANDmGHWA YS, OR PARTS THEREOF, WITHIN THE CORPORATE LIMITS OF THE CITY OF LA PORTE, AS SET OUT IN THIS ORDINANCE; PROVlDING A PENALTY OF A FINE NOT TO EXCEED TWO HUNDRED DOLLARS ($200.00) FOR THE VlOLA- TION OF THIS ORDINANCE; AND REPEALING ALL ORDINANCES ANDIOR PARTS OF ORDINANCES -IN CONFLICT HEREWITH. WHEREAS, Section 8 of Article 827s, Vernon's Penal Code of the State of Texas, provides that whenever the governing body of the City shall de- . termine upon the basis of an. engineering and traffic investigation that any prima facie speed therein set fortb.,is greater or less than is reasonable or safe un- der the conditions found to exist at any intersection or other place or upon any part of a street or highway within the City, ,taking into consideration the width and condition of the pavement and other circumstances on such portion of said, street or highway, as well as the usual traffic thereon, said governing body may determine and declare a reasonable and safe prima facie speed limit thereat or thereon by the passage of an orqinance, which shall be effec- , . ' tive when appropriate signs giving notice. thereof are erected at such intersection or other place or part of the street or highwl;l-'y, now therefore, BE IT ORDAlNED BY THE CITY CONlNlISSIQN OF THE crTY OF LAPORTE, TEXAS, THAT:, Section 1. Upon the basis of an engineering and traffic investigation heretofore made as authorized by the previsions of Section 8 of Article 827s, Vernon's Texas Penal Code, the following prima facie speed limits hereafter indicated for vehicles are hereby determined and declared to be reasonable and safe; and such speed limits are hereby fixed at the tate of speed indi- cated for vehicles traveling upon the named streets and highways, or parts thereof, described as follows: . On State Highway 146-, North 10th Street, from the La Porte North City Limit at a point 2,500 feet South of the centerline of the Houston Ship Channel, to a 'point 2,600 feet .south of the centerline of the Houston Ship Channel, a distance of approximately 0.019 mile, Forty-five (45) miles per hour. .. - '. .. . ~ '.' Any person violating any of the provisions of this ordinance shall be deemed ~uilty of a mi,sdemeanor and upon conviction there- of shall be fined in any sum not more than ~o Hundred Dollars' ($200.00). Section 3. All ordinances and/or parts of ordinances in conflict with the provisions of this ordinance are hereby expr~ssly repealed to the extent of such conflict. Section 4. This ordinance shall become effective and be in force upon the 11th day after the first publ~cation of the caption hereof. PASSED AND APPROVED this the 20th day of May 1963.
