ORDINANCE NO. 681

AN ORDINANCE CREATING A PLANNING.AND ZONING COMMISSION FOR
THE CITY OF LA PORTE; SETTING FORTH THE QUALIFICATIONS, NUM-
BER OF MEMBERS, RULES OF PROCEDURE AND THE RIGHTS, POWERS,
AND DUTIES OF SUCH COM:MlSSION; AND REPEALING ANY AND ALL OR-
DINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH.
BE IT ORDAINED BY THE CITY COM:MISSION OF THE CITY OF LA PORTE,
THAT:
Section 1.
That there is hereby created and established for the
City of La Porte, a Planning and Zoning Commission, which shall be composed
of five members. The members shall be resident citizens, taxpayers who
own real estate in the City of La Porte and qualified voters of the City, all
of whom shall be appointed by' the Mayor subject to confirmation by the City
4t Commission in the form of an Ordinance duly passed at a regular or special
meeting, to serve for terms of two years. However, of the first appointed
members, two shall be appointed for a term of one year and the other three
members shall be appointed for a term of two years. The Mayor shall
appoint or re-appoint members no less than one month prior to the expira-
tion of their respective terms of office and in the event of death, resignation
or incapacity of a member shall within two weeks appoint to fill such vacancy.
Section 2.
The Planning and Zoning Commission shall elect a
Chairman and Vice Chairman from its membership and the City Commission

:p shall furnish such qualified persons as may be necessary for the proper
conduct and undertakings of the Planning and Zoning Commission. The
Planning and Zoning Commission shall have the power to make rules, regula-
tions and bylaws for its own government, which shall conform as nearly
as possible with those governing the City Commission and same shall be
subject to approval by such City Commission. Such by-laws shall include,
among other items, provisions for:

(a) Regular and special meetings, open to the public;
(b) record of its proceedings, to be open for inspection by the
public;

to time and annua.lly; and

(d) for the holding of public hearings on its recommendations.

Section 3.
The Planning and Zoning Commission shall have the
power and-it shall be its duty to make and recommend for adoption a Compre-
hensive City Plan, as a whole or in parts, for the future development and
redevelopment of the municipality and its environs. The plan among other
things, but not limited thereto, will include:
(a)' To make studies and project plans for the improvements of the
City of La Porte, with a view of its development and extentions, and to
recommend to the City Commission all matters for the development and ad-

vancement of the city facilities, layouts, and appearance, and to perform the

duties imposed upon the City Planning Commission by the Statutes of the
State of Texas.
(b) To make plans and maps of the whole or any portion of the City
of La Porte, and of land outside the City Limits located within the planning
area of such City Limits, and any other land outside the City of La Porte
which in the opinion of the City Planning Commission bears a relation to the
planning of the City of La Porte, and to make such changes in additions and
extensions of plB:ns or maps within the City as it deems same advisable.

(c) To aid and assist the City Commission in the preparation of the

City Budget and determination of sources of funds and in procuring of financial
and other aids and assistance for the City from the State and Federal Govern':'
ments and their agencies for each and all of the purpose herein enumerated.
(d) To act with and assist all other municipal and governmental
agencies and especially tlhe CIty Commission in formulating and executing
proper plans for municipal development.
(e) To plan and recommend the location development and extent of
city alleyways, parks, playgrounds, airports, automobile parking places,

and other public grounds and public improvements, for the location and
planning of public buildings, schools, and other properties, and of public

utilities, including bus terminals, railroad depots and terminals, whether

public or privately owned, for water, lights, sanitation, sewage disposal,
drainage, flood control, transportation, communication and shipping
facilities, and for the removal, relocation, widening, extension, narrowing,
vacation, abandonment or change of use of any of the foregoing public places,
work buildings, facilities or utilities.
(f) To select and recommend to the City Commission routes of
streets, avenues and boulevards and particularly to investigate and
recommend the opening, w~dening, or abandonment of streets, avenues,
boulevards, and alleyways or the changing thereof to conform to the City's
system, present and future, all streets, avenues, boulevards, alleyways
e and parks.
(g) To investigate, consider and report to the City Commission on the
layout and plan of any new subdivision to the City of La Porte, or property
situated within the Planning Area and to approve all plans, plats or replats
of additions within the City Limits or within the Planning Area.
(h) To recommend to the City Commission for adoption, rules and
regulations governing plats and subdivisions of land within the corporate
limits of the City or within the Planning Area to promote health; safety,
moral and general ' welfare of the community, and the safe, orderly and
e, healthful development of the community.
(i) To recommend plans to the City Commission for improving,
developing, expanding and beautifying the bayshore, beaches, parks, lakes
and public buildings in or adjacent to the City and to coopera.t';e with the
City Commission and other agencies of the City in devising, establishing,
locating, improving, selecting, expanding and maintaining the public bay-
shore, beaches, parks, playgrounds and lakes for public recreation.
(j) To aid and assist the City Commission by recommending plans
for the development of a Civic Center and to make investigations, consider

regulations, routing and controlling and highway designations.
(k) To make recommendations to the City Commission for building
codes.
Section 4.
All Ordinances or parts of ordinances that conflict with
the terms and provisions of this ordinance are hereby repealed.
This ordinance shall become effective immediately when passed and
approved by the City Commission of the City of La Porte.
