<br />....". - <br /> <br />. <br /> <br />, <br /> <br />. <br /> <br />.. <br /> <br />,~,. <br /> <br />ORDINANCE NO. <br /> <br />t r () <br /> <br />........ <br />'.: <br /> <br />AN ORDINANCE FINDING AND:DECLARING A GRAVE PUBLIC NECESSITY FOR <br />EMERGENCY EXPENDITURES WHICH COULD NOT BY REASONABLE FORETHOUGHT <br />AND INTENTION HAVE, BEEN INCLUDED IN THE ORIGINAL BUDGET FOR THE <br />PRECEDING ~ND CURRENT FISCAL YEAR, AUTHORIZING THE APPROPRIATION <br />OF MONEY AND CREATI9N OF A SPECIAL LEGAL DEFENSE FUND, THE MAKING <br />OF LOANS FOR SUCH PURPOSE, AUTHORIZING THE EXPENDITURES THEREFROM, <br />DIRECTING THE KEEPING OF 'RECORDS THEREOF, THE FILING OF COPIES OF <br />THIS AMENDMENT TO THE BUDGET AS REQUIRED BY rAW, AND DECLARING AN <br />EMERGENCY. <br /> <br />BE IT ORDAINED BY THE ,CITY COMMISsioN OF THE CITY OF rA PORTE, TEXAS: <br /> <br />Section ,1. The members of this Commission having been <br /> <br />served with citation in Cause No. 595,022, styled the "State of <br /> <br />Texas, Et Al vs. The City of La Porte, Et AI," in the District <br /> <br />4It. Court of Harris County, Texas, and said cause having been tried <br /> <br />and presently being appealed, and no adequate provision having <br /> <br />been heretofore made for the defense of such litigation, which has <br /> <br />been instituted by municipal corporations and persons of great <br /> <br />wealth and 'influence, this Commission now finds and declare.s the <br /> <br />eXiste~ce of grav~, public,. necessity for emergency expenditures <br /> <br />which could not by reasonable forethought and intention have been <br /> <br />included in, the origirtal budget for the preceding and current fiscal <br /> <br />year. <br /> <br />It- <br /> <br />Section 2. It is therefore accordingly Ordered and <br /> <br />Ordained that there shall be, and there is hereby created a Special <br /> <br />Fund in the budget t.o be' ,known as "Special, Legal Defense Fund" and <br /> <br />it is hereby appropriated and set aside in such fund the sum of <br /> <br />One hundred :thousand andno/100 <br /> <br />Dollars <br /> <br />($ 100,000.00 <br /> <br />) out: of the general revenues of the City of La Porte. <br /> <br />Should current revenues from taxes and other sources collected, or <br /> <br />collectable in the immediate future prove insufficient to create <br /> <br /> such fund, the Mayor and the City'Clerk are hereby authorized to <br /> arrange a loan or 'loans, and to execute such instruments as are <br />. necessary to insure, repay.ment thereof.
