AN ORDINANCE FINDING AND:DECLARING A GRAVE PUBLIC NECESSITY FOR
EMERGENCY EXPENDITURES WHICH COULD NOT BY REASONABLE FORETHOUGHT
AND INTENTION HAVE, BEEN INCLUDED IN THE ORIGINAL BUDGET FOR THE
PRECEDING ~ND CURRENT FISCAL YEAR, AUTHORIZING THE APPROPRIATION
OF MONEY AND CREATI9N OF A SPECIAL LEGAL DEFENSE FUND, THE MAKING
OF LOANS FOR SUCH PURPOSE, AUTHORIZING THE EXPENDITURES THEREFROM,
DIRECTING THE KEEPING OF 'RECORDS THEREOF, THE FILING OF COPIES OF
THIS AMENDMENT TO THE BUDGET AS REQUIRED BY rAW, AND DECLARING AN
EMERGENCY.
BE IT ORDAINED BY THE ,CITY COMMISsioN OF THE CITY OF rA PORTE, TEXAS:
Section ,1. The members of this Commission having been
served with citation in Cause No. 595,022, styled the "State of
Texas, Et Al vs. The City of La Porte, Et AI," in the District
4It. Court of Harris County, Texas, and said cause having been tried
and presently being appealed, and no adequate provision having
been heretofore made for the defense of such litigation, which has
been instituted by municipal corporations and persons of great
wealth and 'influence, this Commission now finds and declare.s the
eXiste~ce of grav~, public,. necessity for emergency expenditures
which could not by reasonable forethought and intention have been
included in, the origirtal budget for the preceding and current fiscal
year.

Section 2. It is therefore accordingly Ordered and
Ordained that there shall be, and there is hereby created a Special
Fund in the budget t.o be' ,known as "Special, Legal Defense Fund" and
it is hereby appropriated and set aside in such fund the sum of
One hundred :thousand andno/100
Dollars
($ 100,000.00
) out: of the general revenues of the City of La Porte.
Should current revenues from taxes and other sources collected, or
collectable in the immediate future prove insufficient to create
such fund, the Mayor and the City'Clerk are hereby authorized to
arrange a loan or 'loans, and to execute such instruments as are
. necessary to insure, repay.ment thereof. The Mayor is authorized to

draw, issue and deliver any such amounts from time to time as
are necessary or desirable in his judgment to adequately protect
the interests of the City of La Porte and this Commission in its
official capacity in such litigation and all matters related
thereto, to be evidenced by warranmin the usual manner. A re-
cord of .all expenditures and their purpose shall be kept by the
Clerk, and shall be reported to the Commission from time to time
as required by it. The Clerk shall make' such transfers and ad-
justments in other budget.funds as may be found necessary to
effect the object of this ordinance.
Section 3. This.'~ 9~dinance' ,shall take effect from and
after its passage, ,and 'the Commission hereby finds and declares
that a state of emergency ,exists, and that there is a public neces-
sity therefor. The Clerk ,shall file copies as required by law
with the County Clerk and the State Comptroller. The foregoing
ordinance having been introduced by Commissioner Stabs
seconded by Commissioner Osburn
duly put and
unanimously carried, it is Approved, Adopted and Ordered entered
in the minutes this. 26th
day of November, 1963.
