ORDINANCE NO. 705-A
AN ORDINANCE AMENDING ORDINANCE NO. 705 (AN ORDINANCE PROVIDING
RULES AND REGULATIONS'GOVERNING THE PLATTING OR RE-PLATTING OF
LAND IN THE SUBDIVISIONS IN THE CITY OF LA PORTE AND WITHIN THE
EXTRATERRITORIAL JURISDICTION OF THE 'CITY OF LA PORTE); AND
PROVIDING THAT ANY PERSON VIOLATING THE TE&~S OF THIS ORDINANCE
SHALL BE DEEMED GUILTY OF A MISDEfilEANOR AND UPON CONVICTION SHALL
BE FINED IN ANY SUM NOT LESS THAN TEN DOLLARS ($10.00) NOR MORE
THAN TWO HUNDRED DOLLARS ($200.00) AND EACH DAY OF VIOLATION SHALL
BE DEEMED A SEPARATE OFFENSE. .
BE IT ORDAINED BY THE CITY COMMISSION OF
THE CITY OF .LA PORTE, TEXAS, THAT:
Section 1. Section 4.03, ~ar~graph 8, of City of
La Porte Ordinance No., 705, is' hereby amended to read as follows:

8. Before the final or record plat is approved, a bond
,equal to the estimated cost of the proposed improve-
, ments to the subdivision as prepared by the Owner's
registered engineer and approved by the Planning
Con~ission shall be presented to the City. Said cost
shall include the cost of off-site construction neces-
sary to serve the subdivision but shall be less the
Ci ty' s share" of any improvements.
.
As an alternative to presenting a bond to the City,
the develqper or owner of the' land may, .after obtain-
ing approval of the final plat" ,construct the proposed
improvements prior to actual delivery and recording of
the final plat. In such case, the owner or developer
shall follow the procedure provided for in Section 4.04,
Ordinance No. 705 ~ ,and, .upon receipt of written notice
of intent from the City Planning Commission that it
has approved the final plat, the developer or owner
may proceed with the construction of the proposed
improvements. In the event the developer or owner
elects not to present a bond to the City, as provided
for herein, the City Commission and the Planning
Commission shall not sign and deliver a copy of the
plat to be recorded, nor shall such final plat be
recorded, ,until such proposed improvements are com-
pleted, and approved by the City Engineer. The City
Engineer shall certify his approval to the Planning
Commission and the City Commission, which bodies shall
thereafter sign and deliver said final plat to the
owner or dev~loper, who may then have the plat recorded.
Pending' final execution and delivery of the final plat,
it shall be unlawful for any such owner or agent to
offer for saie or sell property therein or thereby,
on the basiS of said final plat.
Section 2. Section 11.05 of Ordinance 705 is hereby
amended to read as follows:

11.05 STREE~ LIGHTING. Street lighting at all street
intersections and cul~de-sacs shall conform to the latest edition
of the Illuminating Engineering Society Handbook. Round tapered
standards with bracket arms shall be used. Lighting levels are
recommended for very light traffic, medium traffic on feeder
streets, .and heavy traffic on thoroughfares. Street lighting at

other points within the subdivision need not conform to the l~ght
intensity requirements of the said Illuminating Engineering
Society Bandbook~ .. ,
Section 3. Penalties. Any person violating this
Ordinance, or any portion thereof shall upon conviction be
guilty of a misdemeanor and shall be fined not less than Ten
Dollars ($10.00) nor more than Two Hundred Dollars ($200.00) and
each day .that such violation continues shall constitute a separate
offense and be punishable accordi~gly.
Section 4. This Ordinance shall take effect and be in
force from and after its pass~ge and approval and publication
as required by law.
