AN ORDINANCE AMENDING ORDINANCE NO. 705 (AN ORDINANCE PROVIDING
RULES AND REGULATIONS GOVERNING THE PLATTING OR RE-PLATTING OF
LAND IN THE SUBDIVISIONS IN THE CITY OF LA PORTE AND WITHIN THE
EXTRATERRITORIAL JURISDICTION OF THE CITY OF LA PORTE); AND
PROVIDING THAT ANY' PERSON VIOLATING THE TERMS OF THIS ORDINANCE
SHALL BE DEEMED. GUILTY OF A MISDEMEANOR AND UPON CONVICTION
SHALt BE FINED IN ANY SUM NOT LESS THAN TEN DOLLARS ($10.00) NOR
MORE THAN TWO HUNDRED DOLLARS ($200.00) AND EACH DAY OF VIOLATION
SHALL BE DEEMED A SEPARATE OFFENSE; AND PROVIDING AN EFFECTIVE
DATE HEREOF.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LA PORTE:
-Section 1. Section 4.03, of City of La Porte Ordinance
No. 70S, is hereby amended by adding thereto a Sub-paragraph 11,
as follows, to-wit:
..
"11. If any part. of this plat lies in a flood hazard
area, then one-foot contour lines shall be shown
on the'plat and the 100-year flood elevation con-
tour shall be drawn with a very heavy line and
designated. The plat shall also show the
following statement in print equal in size to the
certificates of approval: 'Parts of this plat
lower than the 100-year flood elevation have a
one percent (1%) chance each year of being
inundated by flooding.'"
Section 2. Section 11 of City of La Porte Ordinance
No. 705, is hereby amended by adding thereto a Sub-paragraph
II. 06, "E'lood. Pron~ Areas," as follows, to-wit:
"11.06 FLOOD PRONE AREAS.
(a) Definitions.

(1) Flood prone area. The term 'flood prone
area' shall mean any area which can reasonably
be expected to be subject to periodic flooding.
(2) 100-year flood. The term 'lOO-year
flood' shall mean a flood of such magnitude as
may, reasonably be expected to be equaled or
exqeeded on an average of once every 100 years;
the term also means that level of flooding having
one percent (1%) probability of occurrence each
year.
(b) Flood Prone Area Requirements.
(1) Development of flood prone areas is
prohibited except as permitted by this ordinance
and the Flood Hazard Area Regulations Ordinance.
. (2) Subdivision of flood prone areas is
prohibited where the cost of providing utilities
and governmental services would pose an unreason-
able economic burden.

(3) The location, elevation, and construction
of all' utilities and facilities, such as sewer,
gas, electrical and water systems and streets shall
be in such manner as to minimize or eliminate
damage by flooding.

(4) Adequate drainage shall be provided as
to reduce the community's exposure to flood hazards
with respect to adjacent, upstream, and downstream
developments.
(5) No platted residential lot shall be
approved that does not contain a suitable building
site of sufficient elevation to permit construction
utilizing a first floor elevation above the level
of the 100-year flood."
Section 3. penalties. Any person violating this Ordi-
nance or any portion thereof shall upon conviction be guilty of
a misdemeanor and shall be fined not less than Ten Dollars
($10.00) nor more than Two Hundred Dollars ($200.00) and each
day that such violation continues shall constitute a separate
offense and be punishable accordingly.
Section 4. This Ordinance shall be effective fourteen
(14) days after its passage and approval. The City Clerk shall
give notice of the passage of this ordinance by causing the
caption hl3reof to bepublished in the official newspaper in
the City of La Porte' at least twice within ten (10) days after
the passage of this ordinance.
