AN ORDINANCE AMENDING ORDINANCE NO. 705 (AN ORDINANCE PROVIDING, RULES AND REGULATIONS GOVERNING THE PLATTING OR RE-PLATTING OF LAND IN ~~HE SUBDIVISIONS IN THE CITY OF LA PORTE 'AND WITHIN THE' EXTRATER~ITORIAL JURISDICTION OF THE CITY OF LA 'PORTE); AND PROVIDING THAT ANY PERSON VIOLATING THE TERMS OF THIS ORDINANCE SHALL BE DEEMED GUILTY, OF A MISDEMEANOR AND UPON CONVICTION SHALL BE FINED IN ANY SUM NOT LESS THAN TEN DOLLARS ($10.00) NOR MORE THAN TWO HUNDRED DOLLARS ($200.00) AND EACH DAY OF VIOLATION SHALL BE DEEMED A SEPARATE OFFENSE; AND PROVIDING AN EFFECTIVE: DATE HEREOF. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LA PORTE: Section 1. Section 5.09, Park, Playground and School Sites, Paragraph 1, Sub-paragraphs (a), (b), and (c), of City of La Porte Ordinance No. 705, is hereby amended, and shall hereafter read as follows, to-wit: . "1. Parks and Playgrounds: A subdivider shall be required to dedicate a suitable site for park purposes, or to make a deposit to the City in lieu thereof, for residential subdivision which shall include all zoning districts for family residences whether single or multi-family types, in accordance with the following regulations: . (a) On any residential subdivision, the subdivider, at the discretion of the planning and zoning commission, shall be required to dedicate either five per cent (5%) of the total area of the sub- division for park purposes, or its equivalent in money of the fair market value of the undeveloped land. If required, the subdivider shall deposit in the City's park development fund money equiva- lent to the fair market value of the undeveloped land five per cent (5%) of the area within the subdivision for the development of the closest park to the subdivider. If the planning and zoning commission should require land, the location of such land shall be designated by the planning and zoning commission upon recommen- dation from the director of parks and recreation under the following stipulations: . (1) The area of the park to be dedicated shall be measured and calculated to the center line of any ~treet within the subdivision which bounds the park area. (2) When a subdivision is to be developed in stages, or by units, so that the actual platting of the park area to be dedicated is not done until the second or later stages, the subdividers shall complete and deliver to the planning and zoning commission with the final plat of the first stage of the subdi- vision a form furnished by the planning and zoning commission which shall provide for the dedication of the park area, or the equivalent amount of money. ~~...~~\.-\~,. :::.~:' . .... ... f~~'" ';, j- ; : '" ~ ;+ " . ./ .:'J. . . . . . ~. , . . (3) The City of La Porte, Texas, shall improve the dedicated park area when the subdivider has completed all permanent improvements required of him on the area which is adjacent to the dedicated park land. The City shall improve any dedicated park by filling and grading as may be required, and may place basic playground equipment, watering systems, park shelter, arid necessary greenery. (b) In accordance with the provisions of this section, it is not intended that any area be required to be dedicated for park purposes when the land embraced in the plat is zoned for business or industrial purposes under the existing zoning ordinance of the City of La Porte. II Section 2. Penalties. Any person violating this Ordi- nance' or any portion thereof shall upon conviction be guilty of a misdemeanor and shall be fined not less than Ten Dollars ($10.00) nor more than Two Hundred Dollars ($200.00) and each day that such violation continues shall constitute a separate offense and be punishable accordingly. Section 3. This Ordinance shall be effective fourteen (14) days after its passage and approval. The City Clerk shall give notice of the passage of this ordinance by causing the caption hereof to be published in the official newspaper in the City of La Porte at least twice within ten (10) days after the passage o~ this ordinance.
