'I2Q AN ORD:!:NANCE DES IGNATING A PART OF THE AREA LOCATED IN THE EXTRATERRITORIAL JURISDICTION OF THE CITY OF LA PORTE, TEXAS, AS AN INDUSTRIAL DISTRICT, TO BE KNOWN AS THE IlBATTLEGROUND INDUSTRIAL DISTRICT OF LA PORTEll; RESERV- ING AND PRESERVING ALL RIGHTS, POWERS AND DUTIES OTHER- WISE REPOSING BY LAW IN THE CITY COMMISION OF LA PORTE; AND PROVIDING A SAVINGS CLAUSE. WHEREAS, it is the established policy of the City Commission of the City of La Porte, Texas, to adopt such rea- sonable measures, from time to time, as are permitted by law and . which will tend to enhance the economic stability and growth of the City and its environs 'by attracting the location of new, and the expansion of old industries -therein; and WHEREAS, in furtherance of such policy the City Commis- sion did, during the year 19,58, by the final passage of Ordinance No. 558 and entry into certain agreements attendant thereto, annex to the City of La Porte a strip or strips of land encircling an area of land not then included within the corporate limits of La Porte, but deemed by the Commission to be within its area of in- .' terest, for the primary purpose of thereby establishing an area within the sole municipal control of the City of La Porte, Texas, but outside the corporate limits thereof, to be developed as an industrial area or district, primarily devoted to the use and occupancy by industrial plants; and WHEREAS, during the year 1961, the arrangement referred to in the immediately preceding paragraph was further implemented by the adoption of Ordinance No. 637, and agreements attendaht thereto; and WHEREAS, by virtue of the acts above enumerated the ~ City Commission of the City of La Porte has done and performed . , ..,./ . . .. .., . . -2- all things then permissible under the laws of Texas to establish an industrial area or ~istrict; but during the year 1963 the Legis- lature of the State of Texas enacted into law the "Municipal Annexation Act", H.B. 13, Acts of the 58th Legislature, Regular Session, 1963, wherein provision is expressly made in Article I, Section 5, for the establishment of industrial districts by municipalities in this'" State; and WHEREAS, the City Commission of the City of La Porte, after due and careful consideration, has determined that it is in the public interest to now officially and expressly adopt this Ordinance No. '72" . ' " pursuant to Section 5, Article I, of the Texas Municipal Annexation Act, and to herein designate that part of the hereinafter described area lying within the extrater- ritorial jurisdiction of the City of La Porte as an industrial district to be treated with from time to time as the City Commission may deem to be in the best interest of said City. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LA PORTE, TEXAS, THAT: Section 1. The hereinafter described unincorporated area now lying within and subjectID the extraterritorial juris- diction of the City of La Porte, Texas, as established by the Texas Municipal Annexation Act of 1963, is hereby designated as an industrial district o,f the City of La Porte, Texas, to-wit: All that certain unincorporated territory and lands included within and bounded by the innermost boundary lines of the City of La Porte, Texas, as the same were extended and established by Ordinance No. 637, passed on final reading by the City Commission of said City on December 30, 1961, to which ordinance and the record thereof in the office of the Secretary of the City of La Porte, Texas, reference is here made for further description, it being intended to describe and de- signate herein all of the extraterritorial jurisdiction of the City of La Porte that is completely encircled by the incorporated limits of said City, but not included therein, as of the date of this action, and that lies North of State Highway:NG. 225. I . '. -3- Section 2. The industrial district hereby designated and established shall be known as ','.The Battleground Industrial District of La Porte, Texas. II Section 3. It is hereby declared to be the purpose of the City Commission of the City of La Porte, Texas, to treat with such area from time to time as may be in the best interest of said City, and in the attraction and maintenance of industry therein. Section 4. Any and all existing contracts or agreements between the City of La Porte and the owner or owners of land in ~ such industrial district guaranteeing the immunity of such land from annexation by said City for a term permitted by law, and ~ I containing other agreements pertinent thereto, are hereby ratified and conf irmed accord,ing to the ir terms. Section 5. The City Commission of the City of La Porte may enlarge or diminish such industrial district from time to time as permitted by law, and the City of La Porte hereby reserves and preserves all rights and powers of the City of La Porte with re- spect to such industrial district, except as herein expressly other- wise stated. Section 6. Should any portion of the area hereill desig- nated as an industrial district be not actually situated within the extraterritorial jurisdiction of the City of La Porte, Texas, and not therefore capable of being so designated, such fact shall not affect the validity of this designation as to the remaining portions of said area. Section 7.
