ORDINANCE NO. '7.3 -st - J
AN ORDINANCE RATIFYING AND CONFIRMING THE APPOINTMENT
AND EMPLOYMENT OF CARLOS SMITH AS CITY. ENGINEER AND
DIRECTOR OF PUBLIC WORKS OF THE CITY OF LA PORTE;
ESTABLISHING A SALARY THEREFOR; AND PROVIDING AN
EFFECTIVE DATE.

WHEREAS, at a special meeting thereof on April 30, 1962,
the City Commission of the City of La Porte employed Carlos Smith
as City Engineer "at salary of Eight Hundred Dollars ($800.00) per
month, plus two and one-half per cent (2~) of new construction in
excess of Forty Thousand Dollars ($40,000.00), per fiscal year,
per clarification of agreement as to working conditions"; and
WHEREAS, the laws of the State of Texas make it unlawful
for any City to engage in the construction of any public works
involving professional engineering, where public health, public
welfare, or public safety is involved, unless the engineering
plans and specifications and estimates have been prepared by, and
the engineering construction is to be executed under the direct
supervision of a registered professional engineer, where the
contemplated expenditure for the completed project exceeds Three
Thousand Dollars ($3,000.00); and
WHEREAS, on or about January 1, 1965, the said Carlos
.1It Smith began preparation of preliminary designs, as a basis for
the City's Bond Election held during April, 1965, and has, since
the date of said bond election, continued with the preparation of
further designs, estimates, plans, specifications, and in general
provided the professional engineering :services for the City's
current capital improvement program; and
WHEREAS, the City of La Porte will require further
professional, engineering services from the said Carlos Smith, for
the completion of construction of the improvements authorized at
a bond election during April, 1965, the construction of which
improvements will probably not be completed until December 31,

WHEREAS, the employment of the said Carlos Smith as
full-time City Engineer and Director of Public Works, and as

professional engineer for said capital improvements program,
rather than the employment of an outside engineering firm on a
percentage fee basis, will result in a savings of approximately
Forty Thousand Dollars ($40,000.00) to the City of La Porte, in
engineering fees for said capital improvement program; and
WHEREAS, the City Commission of the City of La Porte
deems it to be in the best interest of the City of La Porte that
said contract of employment with Carlos Smith as City Engineer .
and Director of Public Works, be clarified, and that the compensa-
tion of the said Carlos Smith thereunder be in the form of salary

NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF LA PORTE, TEXAS:
Section 1. The City Commission of the City of La Porte
hereby confirms and ratifies its prior employment of Carlos Smith
as City Engineer, by its Resolut~on dated April 30, 1962, and
further ratifies all salary payments to the said Carlos Smith
subsequent to that date, and prior to and including December 31,
1964.
Section 2. The City Commission of the City of La Porte
hereby confirms and ratifies all actions of the said Carlos Smith,
. ,41' in preparing preliminary designs, for the capital improvement
program included in the bond election of April, 1965, and in the
preparation of all estimates, plans, specifications, and all
other professional engineering services, subsequent to the date
of said bond election, and prior to the date of this Ordinance.
The City Commission of the City of La Porte hereby ratifies and

confirms said employment,.and continues the employment of Carlos
Smith to provide the professional engineering services for the
City's capital improyement program, and all improvements c~nstructed
by the City, through completion thereof, which date of completion
is estimated at December 31, 1966.
Section 3. The said Carlos Smith shall receive during
the design and construction of said capital improvements, which
is the period from January 1, 1965, through December 31, 1966, for

his professional engineering services~ and as City Engineer and
Director of Public Works of the City of La Porte~ a monthly salary
of Seven Hundred Seventy Dollars and Seventy Cents ($770.70)~ and

a monthly expense allowance of One Hundred Fifty Dollars ($l50.00)~
which sums are hereby appropriated for said purpose~ fifty-six per
cent (56%) from the General Fund of the City of La Porte~ and
forty-four per cent (44%) from the Water & Sewer Revenue Fund of
the City of La Porte~ and the further monthly salary of Nine
Hundred Dollars ($900.00), which is hereby appropriated for said
purpose from the Construction Fund of the City of La Porte.
Section 4. The City Commission of the City of La Porte
hereby finds, determines and declares that the employment of the
said Carlos Smith as full-time City Engineer and Director of
Public Works of the City of La Porte, and as professional engineer
for said capital improvement program, rather than the employment
of an outside engineering firm on a percentage fee basis, will
result in a savings of approximately Forty Thousand Dollars
($40,000.00) to the City of La Porte, for engineering fees for
said capital improvement program.
Section 5. This Ordinance shall be effective from and
after its passage and approval.
