'7JP AN ORDINANCE VACATt~GJ .ABANDONING AND CLOSING THE PORTION OF "1" STREET LYING WITHIN THE AREA BOUNDED BY BROADWAY STREET AND FIRST STREETJ AND BETWEEN BLOCK ONE HUNDRED FIFTY-SEVEN (157) AND BLOCK ONE HUNDRED EIGHTY (180), IN THE TOWN OF LA PORTEJ HARRIS COUNTY J TEXAS. WHEREASJ the City Commission of the City of La Porte has been requested by the record owners of all of the property abutting "lit Street between South Broadway Street and First Street to vacateJ abandonJ and permanently close that portion of ItI" Street; and WHEREASJ the City Commission of the City of La Porte heretoforeJ to-witJ on the 21st day of MarchJ 1958, under Ordinance No. 533, vacatedJ abandoned and permanently closed all of that portion of "I" Street lying and being situated East of Texas StreetJ which vacated and closed portion of "I" Street is now a part of'the La Porte Indepepdent School District school grounds; and WHEREAS, the City Commission of the City of La Porte heretofore, ,to-wit" on the 25th day of A,pril, 1963, under Ordinance No. 673, vacatedJ abandoned, and permanently closed all of that portion of "I" Street lying and being situated be- tween Broadway Street and Texas Street, after the passage of which Ordinance all of "I" Street East of Broadway has been permanently vacated, abandoned and closed; and WHEREAS" the said portion of "III Street between Broadway Street and First Street has never been opened or used as a public road or street; and WHEREAS" "J" Street" First Street" and South Broadway Street are presently" and will in the future continue to furnish all needed access and thoroughfares for traffic of any nature; and WHEREAS, said portion of "III Street is one block North of and parallel to ItJIt Street, also known as Fairmont Parkway in La Porte" Which 1s a ,main traffic artery and thoroughfare in the -.J ~.' ~e .- . . -2- City of La Porte, ahd will in the future continue to furnish all needed access and thoroughfares for traffic of any nature, together with State Highway 146; and WHEREAS" that portion of "Ill Street located between Broadway Street and First Street, should it ever be opened between said streets, would "aead-endll at the West right-of-way . ' line of said State Highway 146, only one block from a major intersection of State Highway 146 with "J" Street, also known as.FMrmont Parkway, and would therefore be a hazard to pedes- trians and traffic of all natures; and WHEREAS, the City Commission of the City of La Porte has determined and does hereby find, determine and declare that the hereinafter described portion of "I" Street is not suitable, needed, or beneficial to the public as a public road or street, and that the closing of the hereinafter described portion of 111" Street is for the protection of the public and for the public benefit, and that such portion of "I" Street should be vacated, abandoned and permanently closed; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LA PORTE, TEXAS, THAT: Section 1.- Under and by virtue of the power granted to the City of La Porte under its Home Rule Charter and Chapter 13, Title 28, Article 1175, of the Revised Civil Statutes of the State of Texas, 1925, all of that portion of "I" Street lying and being situated between South Broadway Street and First Street and between Block One Hundred Fifty-seven (157) and Block One Hundred Eighty (180), in the Town of La Porte, Harris County, Texas, all accord- ing to the map or plat thereof recorded in the office of the County Clerk of Harris County, Texas, is hereby permanently vacated, abandoned and closed by the City of La Porte. Section 2. This Ordinance shall take .effect and be in force from and "after i tspassage and approval.
