AN ORDINANCE TO PROTECT THE PUBLIC HEALTH AND PROMOTE THE PUBLIC
WELFARE OF THE CITY,OF LA PORTE" TEXAS" BY PROHIBITING THE THROW-
ING" PLACING" ETC." OF GARBAGE AND TRASH ON STREETS, OR HIGHWAYS"
SIDEWALKS AND ALLEYS OF THE CITY OF LA PORTE; REQUIRING THE
REMOVAL OF SUCH MATERIAL FROM HIGHWAYS; MAKING IT UNLAWFUL FOR
ANY PERSON TO THROW PAPER OR TRASH ON ANY STREET, OR .sIDEWALK;
MAKING IT UNLAWFUL TO THROW MANURE" HULLS" PEELINGS" HANDBILLS"
ETC." ON SIDEWALKS". STREETS OR OTHER PUBLIC PLACES; PROVIDING
THAT ANY PERSON VIOLATING THE TERMS OF THIS ORDINANCE SHALL BE
DEEMED GUILTY OF A MISDEMEANOR" AND UPON CONVICTION SHALL BE
FINED IN ANY StJ1V.l NOT LESS THAN TWENTY-FIVE DOLLARS ($25.00) NOR
MORE THAN TWO HUNDRED DOLLARS ($200.00) AND EACH DAY. OF VIOLATION
SHiALL BE DEEMED A SEPARATE OFFENSE; DEFINING TERMS; PROVIDING A
REPEALING. AND SAVING CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE
HEREOF.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LA PORTE"
TEXAS" THAT:
Section 1. Definitions
As used in this Ordinance" unless the context clearly
requires otherwise:
(1) Vehicle means every device in or by which any person
or property is or may be transported or drawn upon a
publiC highway.
(2) Garbage means all animal or vegetable matter" such
as waste material and refuse from kitchens" resi-
dences" grocery stores" butcher shops" restaurants"
hotels" rooming and boarding houses" and other
deleterious substances and any other matter commonly
understood to be garbage.
(3) Trash means rubbish" such as feathers" coffee
grounds" ashes" tin cans" paper" boxes" glass" grass"
shrubs" yard cleanings" grass clippings" leaves and
tree trimmings" and any other matter commonly under-
stood to be trash.
Street or Highway means the entire width between the
boundary'lines of every way publiCly maintained when
any part thereof is open to the use of the public
for purposes of vehicular travel"

Sidewalk means that portion of a street between the
curb lines" or the lateral lines of a roadway" and
the adjacent property lines intended for the use of
pedestrians.
Se:ction 2.' Putting glass" etc." on highways prohibited
No' person shall throw or deposit upon any highway any
glass bottle" glass" nails" tacks" wire" cans" or any other substance
likely to injure any person" animal or vehicle upon such highway.

Section 3. Removing materials from highway
(a) Any person who dropsl or permits to be dropped or
thrownl upon any highway any destructive or injurious
materiall or other material such as dirtl shelll oill
etc.1 which would be detrimental to the use or
appearance of said highwaYI shall immediately remove
the same or cause it to be removed.
(b) Any p~rson removing a wrecked or damaged vehicle
from a highway shall.remove any glass or other
injurious substance dropped upon the highway from
such vehicle.
Section 4.. Dumping at designated grounds only
It shall be unlawful for any person to dumpl unloadl
discharge I or in any manner 'place thereon or cause to be placed
thereonl any garbagel trash or other waste materials on any lotI
tract or parcel of land located within the city limitsl except at
garbage dumps or dumping grounds which are ownedl maintained or
operated by the ci tY'1 or at such places as are designated for
garbage disposal by the director of health of the city.
Section 5. Throwing paper or trash on streets or
sidewalks
It.shall be unlawful for any person to cast or throw
any paper or other trash into or upon any public street or side-
walk or any part thereof of the city.
Section 6. Ma,nurel peelings or other litter on streets
It shall be unlawful for any person to throw~ dispose
or place any,stable manure~ hullsl peelingsl handbills or other

deposits or litter upon sidewalksl streets or other public places
in the city.
Section 7. Penalty
Any person violating any of the provisions of this
Ordinance shall be deemed guilty of a misdemeanorl and upon con-
viction shall be fined in any sum not less than Twenty-five Dollars
($25.00) nor more than Two Hundred Dollars ($200.00)1 and each day
of such violation shall be deemed a separate offense.
Section 8. Repealing of conflicting ordinances
All ordinances or parts of ordinances in conflict herewith
are hereby repealed.

Section 9. Saving clause
If any section~ paragraph~ clause or sentence shall be
declared void and unenforceable or unconstitutional~ it is hereby
declared to be the intention of the Commission that the remainder
of such Ordinance shall remain in full force and effect.
Section 10. Effective date
This Ordinance shall take effect and be in force from
and after its passage and approval and publication as required
by law.
