ORDINANCE NO. 759-C

AN ORDINANCE AMENDING SECTION 2 OF ORDINANCE NO. 759, AS
AMENDED BY ORDINANCE 759-B, AND PROVIDING AN EFFECTIVE
DATE HEREOF.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LA
PORTE:
Section 1. Section 2 of Ordinance No. 759, as amended
by Ordinance 759-B, is hereby amended, and shall hereafter
read as follows:
"Section 2. A connection charge shall be made
against each lot, tract, or parcel of land and the owner
thereof whose water'and sewer line shall be hereafter connected

with any water main or sanitary sewer main of the City of
La Porte, which charge shall be at the following rates, which
rates are a portion of the total cost of such water and sewer
mains,to-wit:
"(1) $1.25 per front foot of the lot, tract, or
parcel of land to which water connections may be made, plus
a water tapping charge of:
"(a) On connections requiring a 5/8"x3/4"
meter, a fee of $100.00
"(b) On connections requiring a 1" or
larger meter, at the actual cost of

the materials, plus 10% thereof, and
the labor, plus 20% thereof.
"(c) On existing connections requiring a
larger meter, the cost of the new,
larger meter shall be discounted by the
cost of the existing smaller meter;
"(d) If the connection-requires an excavation
in an asphalt or concrete street, necessi-
tating street repairs, there will be an
additional charge of the actual cost of
said street repairs.

~(2) $2.00 per front foot of the lot, tract or
parcel of land to which sanitary sewer connections may be
made; a stack fee of $75.00; and an inspection fee of
$5.00.
Section'2. Sub-paragraph (3) of Section 5 of Ordinance
No. 759, is hereby amended, and shall hereafter read as
follows:
"(3) For lots or tracts that are intended to be

used for, or are being used for, school, church, institutional,
business, commercial or lndustrial purposes, including apart-
ment, shopping center, and other multi-building and multi-
tenant projects, the connection charge shall be, in the case
of water, $1.50 per 120 square,"feet of the connected area
served, plus a flat fee per connection, as provided in Section
2 hereof, and all applicable inspection fees, provided, however,
that in no event shall such connection charge be less, in the
case of water, than an ',amount equal to $1.50 per front foot,
nor more than an amount equal to the total cost of constructing
required water mains to provide water service .to such property.
"In the case of sewer lines, the lots or tracts

that are intended to be used for,' or are being used for, the
purposes noted in the preceding paragraph, the connection
charge shall be $2.50 per 120 square feet of connected area
served, provided, however, that in no event shall such
connection charge be less than an amount equal to $2.50per
front foot, nor more than an amount equal to the total cost
of constructing required sewer mains to provide sewer service
to such-: property.

"The area served shall be the area developed and
improved, including off-street parking areas, but shall not
include areas intended for future development. As to those

undeveloped and,unimproved areas for which a connection
charge is not paid, a connection charge in an amount determined
in accordance with the provisions of the ordinances of the City

"The City will accept ownership and maintenance of
those water lines, on the source of intake side of the water
meter or meters, c~nstructed within the area served when such
lines are located within easements dedicated or conveyed to
the City at no cost to it by a duly recorded plat or by an
instrument meeting the approval of the City Attorney, and
the lines located therein are conveyed to the City, at no
cost to it, by a bill of sale meeting the approval of the
City Attorney. rhe City will not accept ownership nor
maintenance of water lines and facilities located on the
customer side of the meter."

Section 3. This Ordinance shall be in full force and
effect from arid after its passage and approval.
