<br />AN ORDINANCE DETERMINING THAT CERTAIN ACTIONS HAVE HERETOFORE
<br />BEEN TAKEN IN CONNECTION WITH THE IMPROVEMENT OF NORTH 7TH STREET,
<br />AND SUNDRY OTHER STREETS AND AVENUES IN THE CITY OF LA PORTE,
<br />TEXAS, WITHIN THE LIMITS HEREINBELOW IDENTIFIED; 'ACCEPTING THE BID
<br />OF, AND AWARDING THE CONTRACT TO, GULF BITULITHIC COMPANY, A
<br />DIVISION OF WARREN BROTHERS COMPANY, FOR THE. CONSTRUCTION 'OF SAID
<br />IMPROVEMENTS; APPROPRIATING AVAILABLE FUNDS OF THE CITY OF LA PORTE,
<br />TEXAS, TO PAY.THE CITY'S SHARE OF THE COSTS OF SAID IMPROVEMENTS
<br />UNDER SAID CONTRACT; APPROVING THE ,CONTRACT AND AUTHORIZING THE
<br />EXECUTION ~HEREOF ON BEHALF OF THE CITY; APPROVING AND ACCEPTING
<br />THE PERFORMANCE BOND AND PAYMENT BOND, HERETOFORE EXECUTED BY
<br />SAID GULF BITULITHIC COMPANY 'AND ITS SURETY IN CONNECTION WITH
<br />SAID CONTRACT; DIRECTING THE 'CITY ENGINEER AND DIRECTOR, DEPARTMENT
<br />OF PUBLIC WORKS, TO PREPARE AND FILE WITH THE CITY COMMISSION
<br />CERTAIN ESTIMATES OF THE COSTS OF SAID IMPROVEMENTS', AND OTHER
<br />PERTINENT INFORMATION IN CONNECTION THEREWITH; AND PROVIDING FOR
<br />AN EFFECTIVE DATE HEREOF.

<br />BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LA PORTE,
<br />TEXAS, THAT:
<br />
<br />Section 1. The City Commission of the City of La Porte,
<br />
<br />Texas, hereby finds and determines:
<br />
<br />(a) That by Ordinances No. 749 and 750, both duly
<br />enacted on the 7th day of June, 1966, the City Commission did
<br />determine the necessity for and ordered the improvement of North 7th
<br />Street, and sundry other streets and avenues in the City of La Porte,
<br />Texas, within the limits defined and as described in said Ordinances,
<br />and did, among other things, by said Ordinances approve certain
<br />plans and specifications' for such improvements and ordered that
<br />advertisement be made for competitive bids for the construction of
<br />such improvements; and
<br />
<br />(b) That pursuant to said Ordinances advertisement for
<br />bids ,for the construction of said improvements was published and
<br />, had in full compliance with all requirements of the law, the
<br />Charter of the City of La Porte, Texas, and of said Ordinances
<br />and upon the date and at the time in such advertisement stated,
<br />bids were ,received and opened, whereupon the bid of Gulf Bitulithic
<br />Company, a division of Warren Brothers Company, in the amount of
<br />Eight Hundred Fifty-one' Thousand Two Hundred Fifty Dollars
<br />($851,2,50.00) for the construction of said improvements was received
<br />and found to be the lowest responsible bid for said work and improve-
<br />ments and such bid was accepted; and
<br />
<br />(c) That thereafter the City Engineer and Director,
<br />Department of Public Works, did prepare and file with, the City
<br />Commission an estimate 'of the portion of the costs o~ said
<br />improvements to be paid by the City of La Porte, Texas, such
<br />estimated costs to be paid by the City of La Porte, Texas, bei~g
<br />the sum of Three Hundred Ninety Thousand Dollars ($390,000.00);
<br />and it is hereby found and determined that there are current funds
<br />on hand in the Treasury of said City of La Porte, Texas, sufficient
<br />to cover said costs to the City of La Po-te, Texas, and available
<br />for such use and that same has been so certified by the Director
<br />of Finance of said City; and
